SCHEDULED ITEM NO. 1 cont'd.: <br />5) No free rides will be allowed and any one wishing to connect to sewers <br />at a future date would have to pay their fair share in cash. <br />6W 6) Future payments in LAM 1 by those property owners who do not choose <br />to connect now would go directly to the benefit of others in LAM 1. <br />7) Los Altos would be responsible for maintenance of the sewer lines and <br />administration of sewer fees. <br />Council discussion ensued with Mayor Aiken clarifying the following points: <br />a) Borders may be modified to exclude those not wanting sewers. <br />b) Everyone in LAM 1 must pay for capacity rights, whether excluded or <br />included in the sewer district. <br />c) That the Council has been assured that formation of sewer districts <br />according to the Town sewer policy is legal, but since the procedure <br />is new, problems in the mechanics of the plan need to be resolved. <br />Council discussion ensued with Floor participation by: Messrs. V. Voorhees, <br />12710 B1 Monte Road, Thomas D. Boyd, 11921 Hilltop Drive, C. R. Boyenga, <br />12425 Hilltop Drive, and Henry Lindau, 1232 Lane Street, Belmont, owner of <br />property on Hilltop Drive. <br />Mayor Aiken pointed out that if someone not in LAM 1, 2, or 3 wishes to <br />participate, this Council would do whatever is necessary with the County to <br />allow them to join. There being no further comments from the Floor, this <br />matter was deferred to Resolutions later in the Agenda. <br />MOTION, SECONDED AND CARRIED: Councilman Benson moved, seconded by <br />Helgesson and carried unanimously, that the Council express their <br />appreciation to the Los Altos Hills Association for their assistance in <br />distributing and tabulating results of the Town's survey. <br />Mayor Aiken stated that 4--0 of the questionnaires were returned and commented <br />on the consistency of the survey, which indicated two out of three property <br />owners desired capacity rights reservations. <br />City Clerk presented map indicating the following results of survey regard- <br />ing Los Altos sewer capacity rights: 400 replies were received representing <br />a 42.6% return, with 66.5% indicating a desire to reserve capacity rights; <br />favorable responses represented 282 parcels, while unfavorable responses <br />represented 142 parcels of land. The survey also indicated that 123 parcels <br />desire sewers immediately, 102 parcels desire sewers some time in the <br />future, 145 parcels never desire sewers, and 53 parcels indicated uncertain <br />desires regarding construction of sewers. <br />SECHEDULED ITEM NO. 2: <br />CONSIDERATION OF REQUEST FROM CITY OF LOS ALTOS REGARDING SEWAGE CAPACITY. <br />Following Council discussion, and with Council approval, the Mayor noted he <br />would inform the City of Los Altos that based on the foregoing discussion <br />440 in Scheduled Item No. 1, the Council will presumably grant extra -territorial <br />jurisdiction and that based on the survey conducted by the Town that it <br />seems certain there will be at least 500 voluntary initial reservations; <br />however, the exact number will be determined after the County conducts <br />necessary hearings. <br />- 3- <br />
