Smith's inquiry as to the synchroniza- tion of the signal lights on 31 Monte, Councilman i:iken stated there has been alate delivery of parts and as soon as they arrive, -signals would be timed. OLD BUSINESS: 1. Cluster Use Permit - Howard Carver. l At the request of the Council, the City Manager contacted CJ the Santa Clara County Planning Commission regarding the use of. the common area. A cony of the format was obtained (includes development rights), but the specifics relating to the control of the common areas will not be spelled out until their January. 20m meeting. A Council reviewed the map and was informed by Engr. J. W. Riley, rer:resenting Mr. Carver, the 25 lots (27 acres) would not 'exceed the total coverage of one family per acre. There is a septic tank system with individual drainfields on each lot (YS, and in the event of any failure, there are. revokable drain£iel.d easements in the reserve areas adjacent to each individual lot. Thisreserve land would not be issued building permits until,such time as sewers are available. There will be an Improvement '.ssociation controlling limita- tions, rights, maintenance, landscaping and assessments. The Council did question whether there would be a path and trail easement leading to the Foothills Fark. The Mayor asked for comments from the Floor;. however, as there were none, the Council had no objection to the issuance of the cluster use permit. The City Manager will attend the Santa Clara Planning Commission meeting, January 20th. G -4-
