Wm. B. Clayton, Monday, April 5, 1965 at 7:58 P. M. at the Town Hall, 26379 Fremont Road, - Los Altos Hills,. California. ROLL CALL: PRESENT: Councilmen Aiken, Bowler, Fowls ABSENT: PLANNING COMMISSION REPRESENTATIVES: APPROVAL OF MINUTES:. COMMUNICATIONS: AISTNOUNCEMENTS: Mayor Clayton Councilman Henley Commissioners Walter A. Benson and Don T. Hibner 1. March 15, 1965. ACTION: Adopt Minutes of March 15, 1965 as submitted. 2. March 23, 1965. Correction: OLD BUSINESS, Item 1, Quarry - Page Mill Road. Correct Action by adding, "unless -he has had satisfactory action from the property owner." None. None ACTION: Adopt Minutes of March 23, 1965 as corrected. MOTION: Bowler; SECOND: Fowle; VOTE: Passed unanimously. ^ STAFF..REPORT; 1 1. Landscaping Report -Survey of Landscape Requirements in New Subdivisions -Cities in the Counties of San Mateo and Santa Clara. . The City Manager submitted landscaping survey for Council perusalwith no specific recommendation since the Planning Commission is discussing this project as a continuing item of its Agenda. ACTION: That the landscape survey be forwarded to the Planning Commission for its study and recommendation.. MOTION: Bowler; SECOND: Aiken; VOTE:: Passed unanimously: NEW BUSINESS: 1. Planning Commission Appointment. Walter A. Benson was appointed to the Planning Commission to fulfill the unexpired term of Commissioner Proctor Mellquist. This term has now expired. .ACTION: That Commissioner Walter A..Benson be reappointed to the Planning Commission £or term o£ £our (4) years, expiring April 5, 19�•`"' .MOTION: Bowler; SECOND: Aiken Councilman Bowler commented he would be interested in seeing a change in the practice of fulfilling unexpiredterms.. The Question was called.. VOTE: Passed unanimously.. P. Study of Increased Lot Size on Steep Lands. City Manager read letters from property owners Mrs. K. Carberry, and Harold Wood and Irene M. Griswold (Mrs. Harold Wood) protesting any action which would reduce and change the require- ment for one acre per dwelling. Councilman Aiken proposed the following Motion for the purpose of clarifying and defining Town Policy as stated in the 1959 General Plan and General Plan Revision of 1963 regarding a specific formula for steep areas.. There have been requests I �from the Planning Commission to better define this area of Town policy, as well as numerous requests from residents of the Town who feel that the rural character of the steep land cannot be preserved unless the acreage is increased.. -2- NEW BUSINESS: Study on Steep Lands (Cont'd.): - ' ACTION: That the Planning Commission be directed to make a study and hold whatever public hearings are necessary with a view toward decreasing the density of the higher area lands and produce some formula according to their findings. MOTION: Aiken; SECOND: Fowle 'Mr. David Jansson, 27440 Sherlock Road, read .and submitted to the Council a petition containing 25 signatures objecting to any action on the part ofthe Council or Planning Commission that would change the one acre zoning. Mr. Edward W. Heidler, 2371 Carmel Drive, Palo Alto, owner of property on Moody Road, also objected to. changing the minimum acreage.. Councilman Aiken stressed he was not speaking of a blanket two -acre zoning and urged the citizens to attend the public I earings set by the Planning Commission and, make known their desires. Messrs. Donald E. Spencer, 27490 Sherlock Road, Arthur C / Lochinvar, of Buena Vista Drive, and T. Kendall, 27961 Central Drive, expressed the opinion the proposed study would benefit the Town. Councilman Bowler contended. a study was not necessary, that for every real problem there is a real solution covered by the Zoning and Subdivision Ordinances. Messrs.•Glen S. Taylor, 1229 Forest Avenue, Palo Alto, Gerald Ferrari, 25791 Moody Road, Los Altos Hills, B. J. Benjamin, 325 Stanford Avenue, Menlo Park, and W. R. Ayers, 918 Dartshire Way, Sunnyvale Gall owners of property in Los Altos Hills) were of the opinion the steep areas were presently being handled effectively and objected to any change of the one acre zoning. In view of the discussion, Councilman Aiken, with the consent of Councilman Fowls, withdrew the original Motion and Second .and proposed the following: ACTION: That the Planning Commission be directed to make a study and hold whatever public hearings are necessary with a view toward clarifying the 5� Town's requirements for land use in the higher and steeper areas of the Town. .MOTION: Aiken; SECOND: Fowls, -3- <NEW BUSINESS: Study on Steep Land (Cont'd.): The Council requested the Planning Commission to carry out this 'study with all possible dispatch. It was suggested from the Floor that the word "higher" be struck from the Motion. AMENDED MOTION: That the Planning Commission be directed to make a study. and hold whatever public hearings are necessary with a view toward clarifying the Town's requirements for land use in the steeper. areas of the Town. AMENDED BY: Aiken; SECOND: Fowls Councilman Bowler challenged this Motion since it would embark on a study which was reflected in the 1963 Revision of the General Flan. He contended higher acreage is not called for in the 1963 Revision as it reflects a change since the adoption of the General Flan in 1959• The Question was called. ROLL.0".LL: AYES: Aiken, Fowle, Mayor Clayton NOUS: Bowler ABSENT: Henley 3• Sanitary Sewers - Dawnridge Drive. City Manager read petition submitted by residents of Dawnridge Drive requesting the Council to make such necessary arrange- ments as may be necessary to enable them to obtain sewer service in the new Country Club -Summerhill Sewer Assessment District now being formed. The City Manager reported the Town has an agreement with Los Altos that when and if facilities are available, the residents are at liberty to connect. Mr. J. R. Millmoe, representing the residents, requested no action but merely that the petition inform the Council of their needs and desires. ACTI ON: That said petition from residents of Dawnridge Drive, Los Altos Hills, dated March 27, 1965 be made a part of the record, that it be noted the Council has received this information, and that it is interested- ;` in doing whatever it can to alleviate the matter when the proper time comes. MOTION: Aiken; SECOND: Bowler; VOTE: Passed unanimously. -4- VARI l NTCES : 1. Murray, James R. (V-215-65) - Reaue§t for Setback Reduction for Carport. Although the Planning Commission recommended approval of the location of carport ten feet (10') from the property line, it was the opinion of the Council a fifteen foot (15') reduction would suffice. :,CTI ON: That a setback reduction of fifteen feet (15') to fifteen feet (15') from the pr6perty line be granted to James R. Murray (V-215-65)• MOTION: Fowle; SECOND: Aiken; VOTE: Passed unanimously. 2. Hunde£ord, Jack (V-216-65) - Request for setback reduction from Public Road for Portico. ACTION: That the request of Jack Hundeford (V-216-65) for reduction of setback requirement to twenty feet (20') be approved. MOTION: :liken; SECOND: Fowle; VO'T'E: Passed unanimously. ORDINf.NCES : 1. Proposed Fire Ordinance.- An Ordinance of the Town of Los Altos Hills adopting regulations for the prevention, suppression, and control of fire hazards, repealing ordinances in conflict therewith, and providing penalties for violation thereof. _ Fire Chief Bassett, Fire lnspector Farwell and Fire Commissioner Hibner were present at the discussion of the draft of the proposed fire ordinance. The City Attorney presented additional amendments, as a result of a meeting with the County Fire Marshal. The draft was discussed as follows, with note to those sections which would be of particular interest and concern to the residents of the Town: Definition of "Hazardous Fire Area" Addition and definition of "Combustible" and "Permit" Retroactive requirement of a spark arrester on all ') mobile equipment and on each chimney, outdoor fire- place, permanent barbecue or grill, and element of time in which to comply (Was suggested the requirement of spark arresters be incorporated in both Building Code and Fire Ordinance) -5- - ORDINANCES: Proposed Fire Ordinance (Cont'd.): Delete reference to incinerators t - Maintenance of firebreak of not less than 30' on each side of any structure- - Regulations for Fire Department access to swimming pool and other stored water In lieu of above access, owner may provide permanent suction pipe - specifications stated for minimum size pipe and fittings - but that this requirement only be applicable to pools, tanks, etc. under constructionsubsequentto the effective date of the ordinance. l.ddition of "Nuisance" Section. The City Attorney will submit a revised draft for a first reading, April 19th. Copies will be forwarded to the Planning Commission for their individual comments as residents of the Town. BUILDING SITE APFROV:'.L: - 1. Smith, Phil (BSP. -8-65) - Request for Building Site 1pproval. The Mayor requested the Council to consider Mr. Smith's request for Building Site Approval_, although not an item of the Sgenda. Engr. Riley, representing Mr. Smith, presented a completed survey map and requested the original Record of Survey stand. The City Manager recommended approval only with the provision a new record of survey map be recorded and filed before a building permit is issued, since the original survey was made for the purpose of changing the lot line and the points ware not closed on the lot being approved. Councilman Bowler objected to this provision asitwas his thought that if any record of survey existed it was not the intention of Ordinance No. 102 to require a new one. Councilman Fowle agreed. In view of the requirements of the City Engineer that a completed record of survey be filed and in accor0ance with the requirements of Ordinance No. 102, Councilman Aiken proposed the following: ACTION: That the request of Phil Smith (BSA -8-65) for - Building Site 2.pproval be granted, with the re- quirement to file a Record of Survey Map as required by Ordinance No. 102. MOTION: Aiken;. SECOND: Bowler -6- BUILDING SITE APPROVAL: Smith, F. (Cont'd.): Upon assurance from Engr., Riley that a recorded Survey Ilan would be presented at the Town Hall in the shortest possible time, the Council concurred building permit could be issued noting such stipulation. - The Question was called. VOTE: Passed unanimously. OTHER BUSINESS: 1. Review of Study of Page Mill-.lrastradero Interchange. Councilman Fowle referred to Planning Commission Minutes of March 22nd wherein a telegram was sent to the State Highway Commission (at the request of the Green Foothills Committee), requesting a restudy of the Page Aiill-Arastradero Interchange. In view of the reduced projected residence density, this restudy was requested in order to eliminate cloverleaf elements, thereby reducing cost and damage to the. adjacent area. Councilman Fowle reported Mr. R. A. Hayler, of the State Highway Engineering Department, was in favor of reviewing the study and asked that the Council endorse the action of the Planning Commission. ACTION: That the City Council of the Town of Los Altos Hills go on record as endorsing the telegram sent. to the State Highway Commission by the Planning Commission on March 2P, 1965 and approving said action. MOTION: Fowle; SECOND: Aiken; VOTE: Passed unanimously. ARR.'SITS : 1. Bills, in the amount of FIFTEEN THOUS°.AID FIFTY-FIVE DOLLIES .and Thirty-two Cents 0',15,055.32), were presented by Councilman Fowls. ACTION: That the bills, as presented., be approved; that the City Clerk be authorized to draw the appropriate warrants. NOTION: Towle; SECOND: Aiken ROLL CILL: AYES: Aiken, Bowler, Fowls,. Mayor Clayton NOES: None CABSENT: Henley - =7- OTHER BUSINESS Cont'd.: 2. Traffic - Fremont-4rastradero Intersection. The City Manager referred to Council Minutes of December 7, 1964 wherein he was requested to direct a letter to the City of Palo 1�lto and County of Santa Clara regarding the above intersection, and reported as follows: On December 24t, Mr. James T. Pott, Director of the County Department of Public Works replied that si.gnalization is not justified due to the close proximity of the Freeway and it was his belief that the Foothill Expressway will bring a change in the traffic patterns and have considerable effect upon the problem intersection. March 31,7965, the City of Palo Alto advised they had con- ducted traffic counts and submitted a Planning Manual of the State of California with the result this intersection does not meet the criterion of the State for signalization. 1.t Mr. Salfen's suggestion, the Palo B.lto Traffic Engineer checked the possibility of installing the necessary signs to merge the: two lanes of southbound Hillview traffic into one lane but did not feel this would alleviate the problem, and that the only satisfactory long range solution is the opening of the Foothill Expressway. Request of Manuella Residents to lnnex to Los f:.ltos Hills. The Mayor announced the appointment ofCouncilmen:;ikon and Fowls to meet with Councilmen from Palo "Ito in regard to the above request. The Mayor will so advise Palo Uto of the appointments in order that a melting date can be arranged. i.t 11:12 P. M., the Mayor adjourned the meeting to an Executive Session on legislative matters. ?.t 11:40 P.
