B. Clayton, Monday, April 19, 1965 at 5:10 P. M. at the Town Hall; 26379 Fremont Road, Los Altos Hills, California. ROLL CALL: PRESENT: Councilmen Bowler, Fowls, Henley Mayor Clayton ABSENT: Councilman Aiken PLANNING COMMISSION REPRESENTATIVES: Commissioners A. C. Prentice, Jr. and Don T. Hibner PPROV.P.L OF MINUTES: April 5, 196 Correction: Page 2, New Business, Item 1, Planning—Commission Appointment, correct Action to read: "expiring April 5, 1969.° ACTION:- ; Adopt Minutes of April 5, 1965 as corrected. MOTION: Fowle; SECOND: Henley VOTE: Passed unanimously. ' Chief Richard E. Bassett presented showing of film "Protective Greenbelt - USA" depicting the hazardous conditions contributing to fires and the solutions of brush removal and greenbelting with fire resistant plantings. ANNOUNCEMENTS: 1. Mr. Clark Smith, of Los Altos Hills, made the announcement from the Floor that Councilman Gordon E. Bowler was not in residence in the Town of Los Altos Hills from July 1, 1964 through December 23, 1964 and that his seat should have been vacated July 1, 1964. The City Attorney was consulted, however, he deferred a ;�% legal opinion not having the entire facts before him. (Cont'd.): Councilman Bowler contended his residency was a valid one and explained the circumstances. Councilmen Henley and Fowle supported Councilman Bowler's statements, and the following Motion was proposed: ACTION: That I, Councilman Fowle, wish to go on record that Gordon E. Bowler has always been and still is acitizen of Los Altos Hills. MOTION: Fowle; SECOND: Henley .Comments from the Floor were heard from the following residents: Mrs. Benson, Messrs. Cathcart, Janssen, Towle, George,Hogle, Cowie, Hawley, Steele,and Kirk, Having a personal interest in the matter, Councilman Bowler requested the Motion be withdrawn. The Motion and Second were duly withdrawn. Discussion followed on the legality of Councilman Bowler's vote. The Mayor declared this announcement necessitated an investigation, and, since Councilman Bowler had no objection, the City Attorney was instructed to assemble facts for the Council. ACTION: That the Council move on to the next order of business. MOTION: Fowle; SECOND: Henley; VOTE: Passed unanimously. Mayor Clayton stated that on the next item of business, since there was a questionable quorum, he would remove himself from the Council Table and extend to himself, as he would to anyother member, the courtesy of a full Council. In the absence of the Mayor, Councilman Fowle assumed the Chair at 9:05 P. M. -2- NEW BUSINESS: 1. Election of Mayor. ACTION: - -- Because the Deputy Mayor is absent tonight I move that for the purposes of the present meeting, Councilman Fowle be appointed Deputy Mayor pro':tem. MOTION: Bowler; SECOND: Henley; VOTE: .Passed -unanimously. ACTION; I move that the Office of Mayor be declared vacant and that the Deputy Mayor pro tem be authorized to assume the chair as Mayor pro tem pending a meeting of the full Council at which nominations for the Office of Mayor will be received and acted upon. MOTION: Bowler; SECOND: Henley Councilmen Bowler, Henley and Fowle each read a written statement clarifying his stand in supporting the foregoing Motion, each sharingthe view that the element of confidence - does not presently exist between the Council and its Mayor. Comments from the Floor were heard from the following residents: Messrs. Kirk, Hawley, Eastman, Watson, Janssen, Towle, Cathcart, Jones, Haines, Cowie, George, Hibner, Flood, Boyd, Pfeiffer, Hall, Young and Mesdames Weisbart., Benson and Spangenberg. Mr. R. Towle, spokesman for the Los Altos Hills Association, reported on their investigation. Mr. Towle suggested that the Question be called, the Agenda carried out, and the meeting adjourned; then a Chairman could be appointed from - the Floor to hold an open discussion with all parties concerned, with the understanding this would not be a Council action. The Question was called. ROLL CALL: AYES: Bowler, Henley, Deputy Mayor pro tem Fowle NOES: None ABSENT: Aiken, Mayor Clayton -3- VARIANCES: 1.. Kammeyer, George(V-21%-65) - Reduction in Setback Requirement. ACTION: That the request of George Kammeyer (V -2i7-65)... for reduction of setback requirement of twenty- eight inches (28") be approved, in accordance with the recommendation of the Planning Commission. MOTION: Henley; SECOND: Bowler; VOTE: Passed unanimously. 2.. Armi, Philip -(V-218-65) - Reduction of Setback Requirement. Commissioner Hibner stated he hadvoted"No" on this variance (April 12% Planning Commission Minutes were in error) as he felt the trees were not an issue and that the house could be redesigned without a variance. ACTION: That the request of Philip Armi (V-218-65) for setback reduction be approved, in accordance with the recommendation of the Planning Commission. MOTION: Bowler; SECOND: Henley; VOTE: Passed unanimously. BUILDING SITE APPROVALS: Applicants N. Perry Moerdyke (BSA -11-65) and John .E. Cobb (BSA -12-65) withdrew from the Agenda, without prejudice. DIVISIONS OF L..ND: Final Maps: 1. MataderoHills- Resubd. of Lots #1 and #2, Tract No. 3659 - Engr. G. S. Nolte. ACTION: That the Final Map of Matadero Hills, Lots #1 and #2, Tract #3659, be approved. MOTION: Henley; SECOND: Bowler; VOTE: Passed unanimously. ORDINANCES: 1. Proposed Fire Ordinance. Mayor pro tem Fowle suggested n First Reading of the fire ordinance, simply as a matter of record, ,for suggestions and �..�% objections, since this is an extensive and comprehensive ordinance requiring duties by the citizens. -4- ORDINANCES: Fire Ordinance Cont'd.: Due to an omission in the draft, the City Attorney requested the underlinedaddition be inserted on Page 9, Section SVI, - 2,9tb line after words "vegetation located more than 'thir'FY feet from such building or structure and less. than .... ..—. The City Attorney read the title of Ordinance No. 105,:.an Ordinance of the Town of Los Altos Hills adopting regulations for the prevention, suppression,-andcontrol -of-the fire hazards, repealing ordinances in conflict therewith, .and providing penalties for violation thereof. ACTION: That the reading of the balance of Ordinance -No. ---105 be waived. The City Manager referred to letter dated April 15, 1965 from the District Engineer, Division of Highways, requesting aformal resolution of the City Councilregarding the restudy to eliminate cloverleaf elements at the Page Mill-Arastradero interchange with Junipero Serra Freeway. The City Attorney presented and read, in its entirety, Resolution No.. 301,.a Resolution of the City Council of the Town of Los Altos Hills requesting restudy of the Traffic Requirements .for the Page Mill Road-Arastradero Road Inter- change of the Junipero Serra Freeway. ACTION:. Adopt,Resolution No. 301 as read. MOTION: Bowler; SECOND: Henley ROLL CALL: .AYES: Bowler, Henley, Mayor pro tem Fowle NOES: None ABSENT: Aiken, Clayton WARRANTS: 1. Bills, in the amount of ONE THOUSAND SIX HUNDRED FIFTY-ONE DOLLARS and One Cent ($1,651.01), were. presented by Council- man'Henley. _ —5— WARRANTS Cont'd.: ACTION: That the bills, as presented, be approved; that the City Clerk be authorized to draw the appropriate warrants.
