Ross Aiken, Monday, May.17, 1965 at 7:59 P. M. at the Town Hall, 26379 .Fremont Road, Los Altos Hills, California. ROLL CALL: - PRESENT: Councilmen Bowler, Clayton, Fowls - - Mayor pro tem Aiken ABSENT: Councilman Henley PLANNING COMMISSION REPRESENTATIVE: APPROVAL OF MINUTES Commissioner Helen Ashby. May 3, 1965. ACTION: Adopt .Minutes of ,May 3, 1965 as submitted. �) COMMUNICATIONS: 1. Mr. and Mrs. C arles A. Bittmann, 14350 Manuella Road - Transmittalletter, -dated ay 13, 1965 and petition with 65 signatures, requesting a horse crossing at intersection of Fremont. and Manuella. Referred to. Staff for its recommendations at June 7n meeting. 2. Clyde C. Shaw, 10940 Magdalena Avenue Letter dated May 17, - 19 g, concerning paths along the 10,000 to 12,000 blocks of Magdalena. A study will be made by the Council and the matter was ordered placed on the June 7W Agenda. ANNOUNCEMENTS: 1. Lea ue of California Cities Peninsula Division - Dinner Meeting; -"Thursday, May 2?, 1965, :30.P. M., Host City - SanFrancisco. COMMITTEE REPORTS: 1. In response to the Mayor pro tem'.s inquiry as to the status of the :Citizens' Committee authorized to be formed at the May 3rd City Council meeting, it was learned that while - - COMMITTEE REPORTS (Cont'd.): Councilman Clayton had available his appointee to serve, - Councilman Bowler was not prepared to announce any appoint- ment at this time. - Mayor pro tem Aiken requested the appointment at the earliest possible moment and offered his help in order that the mission of the Committee would not be delayed. OLD BUSINESS: 1. Councilman Fowls introduced and read, as part of the record, a summary of chronological events which led to the present vacancy in the office of Mayor, submitted by Councilmen Bowler, Fowle and Henley and dated May 19, 1965. Councilman Clayton took issue with the facts as .presented in that some were correct and some unwholly true, and stated his position on each item. - Councilman Fowle then submitted a letter from Councilman Henley dated May 10, 1965 reporting on the status of his suggestion regarding County Grand Jury investigation, and further proposed, that if for. any reason the current - Grand Jury refuses to make the inquiry, then the Council -(J). itself must exercise its legal powers and take up the matter l at once. - Comments were heard from the Floor regarding the above communications and discussion: Messrs. Ewing, Cathcart, Jansson, Cowie, George, Mellquist, Corduan; Bittman, Nichols and l"esdames Roselaar and Smith. NEW BUSINESS: 1. Santa Clara County Safety Council - Request for Budget Allocation. .ACTION: That the request of the Santa Clara County Safety Council for budget allocation be denied. MOTION: Fowls; SECOND: Clayton; VOTE: Passed unanimously. 2. County Library Commission - Appointment. ACTION: That the City Council of the Town of Los Altos Hills recommends the reappointment ' of Mrs. Josephine Guerrero to the County . Library Commission. -- MOTION: --Fowls; SECOND: Clayton; VOTE: Fassed unanimously. -2- _NEW BUSINESS: 3. Matadero Hills - Request for Acceptance of Cash Bond ::.,.. for a�caping. ACTION: That the Town of Los Altos Hills accept'a cash bond in the amount of $2,040, to be held until such time as two years have elapsed following acceptance of the landscaping plan. MOTION: Clayton; SECOND: Bowler; VOTE: Passed unanimously. DIVISIONS OF LAND: Tentative Maps. - 1. Laureleen Acres (293-65') 4 lots - Engr. L. G. Brian. ACTION: That the Tentative Map of Laureleen Acres (293-65), 4 lots, be approved, subject to the recommendations of the Planning Com- mission and City Engineer. _ MOTIOPi: Bowler; SECOND: Clayton; VOTE:. Passed unanimously. 2. Hillcrest Estates, Unit #1 (294-65) - Engr. Hammond Assoc. ACTION: That the Tentative Map of Hillcrest Estates, Unit #1 (294-65) be approved, subject to the approving agencies and recommendations of the Planning Commission, including the recommenda- tion that the driveway easement width be retained as thirty-two (32')feet and dedicated a public road. MOTION: Bowler; SECOND: Fowle; VOTE: Passed unanimously. RErOLUTIONS: 1. Resolution No. 302, a Resolution of the City Council of the Town of Los Altos Hills accepting improvements in Tract #2955 (Olive Tree Hills), #3504 (McDougall) and #3491 (Malmquist), was read in its entirety by the City Clerk. ACTION: That Resolution No. 302 be adopted as read. _;..� MOTION:. Resolution No. 303, a Resolution of the City Council of the Town of Los Altos Hills abandoning a certain.General Public Easement, was read in its entirety by the City Attorney. This easement, located in Fremont Hills Unit , Tract #1947 and more particularly described in Exhibit "A", was granted for purposes of storm -drainage and now considered no longer necessary. ACTION: That Resolution No. 303 be adopted as read. MOTION: Clayton; SECOND: Bowler ROLL CALL: AYES: Bowler, Clayton, Fowle Mayor pro tem Aiken NOES: None ABSENT: .Henley 3. Resolution No. 304, aResolution of the .City Council of the Town of Los Altos Hills approving an amendment to the agree- ment between State and Town for financial assistance pursuant to the emergency flood relief law and designating the repre- sentative of said Town for transactions in connection there- with, was read in its entirety by the City Attorney. ACTION: That Resolution No. 304 be adopted as read. MOTION: Bowler; SECOND: Clayton ROLL CAI:L: AYES: Bowler, Clayton, Fowle,Mayor pro tem Aiken NOES: None ABSENT: Henley ORDINi:NCES : 1. Fire Ordinance No. 105• Since additional changes were requested by the Pacific Gas and Electric Co. and insasmuch as the ordinance is still under consideration by the Planning Commission, the City Attorney requested another first reading be held when the ordinance is reproduced incorporating these changes. Fire Chief Bassett and Lt. Farwell were present and discussed the changes requested by P. G. & E. Co. as presented in their letter of May 17, 1965• Briefly, these changes concerned, a.. ,! -4- ORDINANCES: Fire Ordinance No. 105 (Cont'd.): 1) Section ISI - request the permit be for 1 year 2) Section XII, B - include welding torches, etc. at scenes of emergenciesT 3) Section XV - compliance within six months These changes were considered and modifications made, and will be incorporated by the City Attorney. Chief Bassett announced there will be a ban on all open burning beginning June 1st. In discussing the need for an encompassing fire ordinance, the Chief stressed the cost of suppression fire -fighting to the Community. Councilman Bowler expressed the thanks of the Council for Chief Bassett's attendance at the public hearings on this ordinance so that the citizens will be aware of their responsibilities. WARR'.NTS: 1. Bills, in the amount of TWO THOUS�'ND SEVEN HUNDRED AND SEVEN DOLLARS and Ten Cents (?,"2,707.10), were presented by Councilman Fowle. ACTION: That the bills, as presented, be approved; that the City Clerk be authorized to draw the appropriate warrants. The City Attorney submitted.' and read in its entirety a revocable agreement between Miriam E.
