Roscoe Wendell w. - Appeal of Planning Commission Recommendation <br />Rot- P�irik-Hers—e_ranch Unit No. 2. <br />Deputy Clerk Smith referred to the letter of August 10, 1965 from <br />Mr. Roscoe in which he requested approval of his subdivision. <br />Planning Commission's recommendation of July 12, 1965, rejecting <br />the map without prejudice, was read. <br />Discussion followed regarding the three major problems, namely: <br />a. Existing water line: easement through Lot #127— <br />b. Substandard lots - #22 and #23. <br />c. Lack of deeded and improved free access from a public <br />road (Topa Way). <br />Mr.. Faisant, City Attorney, stated that the two substandard lots <br />could -'be treatedas Conditional Exceptions; that relative to the <br />access, Tepa was never accepted by the Town (Pink. Horse Ranch No. 1). <br />Mr.,Roscoe explained that he had started the Pink Horse Ranch -#1 <br />under the requirements of Santa Clara County prior to the incor- <br />poration of the Town, during which time the Town incorporated. <br />He stated that improvements were completed and impacted by the <br />City Engineer, but were not accepted by the Town. <br />Mr. McCandless, City Engineer, commented on the background of <br />action on Pink Horse Ranch Unit 1, stating that during the early <br />stages.of the Town when the first specifications for improvements <br />were being set up there frequent changes during the time Mr. <br />Roscoe's subdivision was.being improved. He stated that M". Roscoe <br />met the requirement, then in effect; that due to subsequent <br />changes, the.improvements were never accepted. <br />Mr. McCandless recommended that leniency be shown and recommend— <br />ed acceptance of improvements, subject to completion of work, <br />- The City Engineer was requested to inspect the improvements in <br />PinIc Horse Ranch. Unit No. 1 to determine status of improvement <br />and what is required prior to acceptance, <br />The Mayor directed that the Tentative Lisp of Pink Horse Ranch <br />No. ,2 be returned to the Planning Commission for the completion <br />of the Check List and requested that the Planning Commission's <br />objections be set forthclearly in order for the Map to be con- <br />sidered by the Council. He announced that the appeal of Mr.-Ros- <br />coewill be continued to the next meeting ofthe Council or until <br />such time as" he ready to have the appeal considered. <br />-3- <br />
