ATTNOUNCEMEN_TS : <br />1. Santa Clara Inter -City Council fleeting, Thursday, May 7, 1964, <br />7:30 P. P.., at the ull Brave BRestaurant, Ios Altos Host City. <br />Program: 'Mass Transit in Santa Clara Count <br />The Mayor encouraged all Council Members to attend. <br />2. Peninsula Division, League of ualriornla <br />Thursday, May 21, 1964, 7:30 F. M., Host City San Jose, at <br />Flateau 7, 777 North First Street, San Jose. <br />COMMUNICATIONS_(AGENDA): <br />1. California Water Service Co. - Notice of Filing Application <br />£or Rate Increase. <br />This matter is on the Agenda in order to bring to the attention <br />of the Council the intention of the California Water Service <br />Co. to apply for a rate increase. <br />The City Attorney and City Clerk will keepinclose touch <br />with this matter. The City Attorney requested a Study Session <br />after the meeting to discuss franchise payments. <br />COMMITTEE REPORTS: None. <br />PLP_T.NING COMMISSION REFERRALS: <br />1. Letter o£ Objection_to Secondary Living Unit. <br />The City Clerk referred to Mr. Wayland C. Griffith's letter <br />of objection dated April 22, 1964. <br />Mr. Griffith was present and as per his letter stated his <br />objections to a construction with separate living quarters <br />and only an external connection. Mr. McDougall was present <br />and stated the building plans remained the same as approved <br />and claimed it was not a two-story apartment but that its <br />use was a single residential dwelling. <br />The City Clerk explained that when Mr. McDougall desired a <br />second .kitchen, a variance was applied for and thus the petition <br />was circulated. However, upon clarification from the City <br />Attorney, it was deemed that a variance was not necessary as <br />the Town's Ordinances do not control the number of sinks or <br />kitchens in a single residence. The City Attorney further <br />clarified that use is the governing factor and that the Town <br />does not have control over architectural design, plans or <br />facilities (except in the case of a secondary dwelling with <br />kitchen facilities on 1.99 or less acre); that in case of any <br />violation of the use, there are several quick and effective <br />avenues to take. <br />-2- <br />
