CON_T'D. DISCUSSION OF TR_UC_K_I_NG VIOLATI_0_N_S ON MAGDALIPTA_: <br />of cooperation and in a reasonable way. Mr. Neary has offered to <br />negotiate with these contractors. <br />Deputy City Clerk reported the portion of hagdalena between <br />Ravensbury and Hooper Lane, a strip 1265' long, was repaved <br />by the Town in April, 1964, at the cost of 12,300; today, it <br />would cost approximately 12,900. due to increased costs for <br />labor and materials. The cost to replace in the condition it <br />was a month before the trucks would be approximately 1650.00. <br />Reconstruction of that area wouldbe approximately 19,600., or <br />greater if an increased amount of base rock were necessary. <br />Mr. George H. Neary, Jr. commented on his negotiations and the <br />proferred solutions. Mr. Neary did not agree that he does not <br />have the right to use this road for trucks and any compromise <br />would be on the basis of reasonableness. <br />Mr. A. S. Alter, 24290 Elise Court, commented that the present <br />ordinance should be enforced. <br />In reviewing Councilman Fowle's report, Council discussion <br />suggested two courses open to the Town - 1) enforce the <br />ordinance as written, taking the legal view that it is <br />enforceable, or 2) enter into a compromise with the contractors <br />involved (for whom Mr. Neary is only the supplier), and enforce <br />that compromise by not relying on expressions of good will but <br />enacting an emergency amendment to the existing ordinance to <br />cover the situation, which at a later date could be repealed <br />when the situation has been accomplished. <br />The Mayor requested comments from the Floor. There were none. <br />ACT=T: <br />: <br />That the City Attorney be instructed to prepare <br />a temporary emergency ordinance covering a period <br />of thirty (30) days and providing for a temporary <br />alternate truck route for unladen vehicles going <br />in a westerly direction over the Town -owned portion <br />of I;agdalena Road. <br />MOTION: Bowler; SECO_^D: Fowle <br />There being no objection, the I',ayor instructed the City Attorney <br />to so proceed. <br />Comments regarding the Motion were heard from Messrs. G. Bullis, <br />14085 Hanuella Road, J. D. Giulie, 11181 Magdalena Road, and <br />Mrs. J. Sweeney, 27990 Via Ventana. <br />At 8:35 F. M., the Mayor adjourned the Continued Special Council <br />i meeting to the adjoining offices within the Town Hall to continue <br />its meating in order the Planning Commission might call to order <br />its regularly scheduled meeting in the Council Chambers. <br />-2- <br />
