• • RESOLUTION NO. 78-08 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS APPROVING A PURCHASE AND SALE AGREEMENT BETWEEN THE TOWN OF LOS ALTOS HILLS AND STEVE AND KARLA JURVETSON FOR THE SALE OF APN 182.21-003 WHEREAS, the Town of Los Altos Hills is the owner of APN 182-21-003, which is an approximately 8,712 square foot parcel located on the north side of Altamont Road near Black Mountain Road (the"Property"); and WHEREAS, on November 13, 2008, following a public hearing and consideration of comments received therein, by Resolution No.76-08 the City Council ordered that the Property be abandoned and sold pursuant to the Municipal Park Abandonment Law of 1939 (the "Act"); and WHEREAS, pursuant to the Act the City Council is authorized to sell the Property on such terms as it deems most advantageous; and WHEREAS, Steve and Karla Jurvetson, owners of residential property adjacent to the Property, (the "Proposed Buyers") desire to purchase the Property for$139,218 in cash (the"Purchase Price") and to enter into a purchase and sale agreement(the "Purchase and Sale Agreement") with the Town setting forth the terms and conditions for their acquisition of the Property; and WHEREAS, the City Council has duly considered the Purchase Price and its supporting appraisal data, and all of the terms and conditions of the Purchase and Sale Agreement, and believes that the sale of the Property to the Proposed Buyers for the Purchase Price pursuant to the Purchase and Sale Agreement is most advantageous to the Town of Los Altos Hills; NOW, THEREFORE, the City Council for the Town of Los Altos Hills, does hereby RESOLVE as follows: 1. The City Council hereby finds and determines that the above recitals are true and correct. 2. The City Council hereby authorizes the Mayor to execute the Purchase and Sale Agreement between the Proposed Buyers and the Town of Los Altos Hill, in substantially the form on file with the City Clerk, with such changes therein as shall be approved by the City Attorney. 3. The City Council hereby authorizes the Mayor and the City Clerk, upon receipt of the Purchase Price, to sign, acknowledge and deliver a grant deed for the Property to the Proposed Buyers and to take such other and further related actions as are reasonably necessary to consummate the sale of the Property to the Proposed Buyers. 4. The City Council hereby directs that upon receipt of the Purchase Price, the full amount shall be deposited in the Town of Los Altos Hills Open Space/Public Recreation Preservation Fund to be used for open space/public recreation uses as approved by the City Council.
