10-2.809 Water Efficient Landscaping. <br /> (a) Application. <br /> The provisions of the Water Efficient Landscape Ordinance (WELO) shall apply to the <br /> following: <br /> (1) All new development projects requiring a Site Development Permit; and <br /> (2) Rehabilitated landscape projects with an aggregated irrigated landscape area equal to <br /> or greater than 2,500 square feet requiring a building or site development permit; and <br /> (3) Existing landscapes limited to subsections (s) and (t). <br /> Any project with an aggregate landscape area of 2,500 square feet or less may comply with <br /> the performance requirements of this ordinance or conform to the prescriptive measures <br /> contained in the Prescriptive Compliance Option located within the Town's Landscape <br /> Design Guidelines and Plan Submittal Requirements (herein after referred to as Landscape <br /> Guidelines). <br /> For projects using treated or untreated graywater or rainwater captured on-site, any lot or <br /> parcel within the project that has less than 2,500 square feet of landscaping and meets the <br /> lot or parcel's landscape water requirement (Estimated Total Water Use) entirely with <br /> treated or untreated graywater or through stored rainwater captured on-site shall only be <br /> subject to the irrigation requirements located within the Town's Landscape Guidelines. <br /> This ordinance shall not apply to: <br /> (1) Registered local, State or Federal historical sites where landscaping establishes an <br /> historical landscape style, as determined by any applicable public board or <br /> commission responsible for architectural review or historic preservation; <br /> (2) Ecological restoration or mined-land reclamation projects that do not require a <br /> permanent irrigation system; or <br /> (3) Community gardens or plant collections, as part of botanical gardens and arboretums <br /> open to the public. <br /> (b) Defmitions. <br /> The following definitions are established for the purpose of this article. A complete list of <br /> WELO definitions is included in the Town's Landscape Guidelines. The meaning and <br /> construction of words and phrases is as follows: <br /> Applied water means the water supplied by the irrigation system to the landscape. <br /> Certified professional means a certified irrigation designer, certified landscape irrigation <br /> auditor, licensed landscape architect, licensed landscape contractor, licensed professional <br /> Ordinance 560 Page 2 <br />
