`, V r N radius of five hundred (500) feet therefrom, to operate equipment or perform any outside construction or repair work on any building, structure, project, or to use any pneumatic hammer, steam or elec- tric hoist, backhoe, bulldozer or dump truck or other construction type device, between the hours of 6:00 p.m. of one day and 8:00 a.m. of the next succeeding day on any Monday through Friday, or be- tween the hours of 6:00 p.m. on any Friday and 9:00 a.m. on any Saturday, or at any time on any Sunday, and at any time on any pub- lic holiday, unless beforehand a permit therefor has been obtained in accordance with the provisions of this Chapter. No permit shall be required to perform emergency work in the event of an emergency which imperils the public safety. This Section shall not apply to the use of domestic power tools as specified in Section 5-7.03. Section 5-7.03. DOMESTIC POWER TOOLS. A homeowner who individ- ually undertakes, to maintain or improve his property and or residence may operate or permit the operation of domestic power tools, such as, any mechanically powered saw, sander, drill, grinder, lawn or garden tool, or similar tool between the hours of 8:00 a.m. and sunset on any Monday through Friday or between 9:00 a.m. and sunset on any Sat- urday and Sunday. Provided that any such operation is limited to the improvements or maintenance undertaken by the homeowner himself. Section 5-7.04. PERMIT; PROCEDURE. A permit may be issued authorizing work prohibited by Section 5-7.02 whenever it is found that the public interest will be served thereby. An application for a permit shall be in writing, shall be accompanied by an application fee in an amount to be set by Resolution of the City Council, and shall set forth in detail the facts showing that the public interest -2-
