`, V r N <br />radius of five hundred (500) feet therefrom, to operate equipment <br />or perform any outside construction or repair work on any building, <br />structure, project, or to use any pneumatic hammer, steam or elec- <br />tric hoist, backhoe, bulldozer or dump truck or other construction <br />type device, between the hours of 6:00 p.m. of one day and 8:00 a.m. <br />of the next succeeding day on any Monday through Friday, or be- <br />tween the hours of 6:00 p.m. on any Friday and 9:00 a.m. on any <br />Saturday, or at any time on any Sunday, and at any time on any pub- <br />lic holiday, unless beforehand a permit therefor has been obtained <br />in accordance with the provisions of this Chapter. No permit shall <br />be required to perform emergency work in the event of an emergency <br />which imperils the public safety. This Section shall not apply to <br />the use of domestic power tools as specified in Section 5-7.03. <br />Section 5-7.03. DOMESTIC POWER TOOLS. A homeowner who individ- <br />ually undertakes, to maintain or improve his property and or residence <br />may operate or permit the operation of domestic power tools, such as, <br />any mechanically powered saw, sander, drill, grinder, lawn or garden <br />tool, or similar tool between the hours of 8:00 a.m. and sunset on <br />any Monday through Friday or between 9:00 a.m. and sunset on any Sat- <br />urday and Sunday. Provided that any such operation is limited to the <br />improvements or maintenance undertaken by the homeowner himself. <br />Section 5-7.04. PERMIT; PROCEDURE. A permit may be issued <br />authorizing work prohibited by Section 5-7.02 whenever it is found <br />that the public interest will be served thereby. An application for <br />a permit shall be in writing, shall be accompanied by an application <br />fee in an amount to be set by Resolution of the City Council, and <br />shall set forth in detail the facts showing that the public interest <br />-2- <br />
