i00 W <br />SECTION 2. URGENCY AND EFFECTIVE DATE. This ordinance <br />is an urgency ordinance and is for the immediate preservation <br />of public peace, health and welfare. The facts constituting <br />the urgency are these: <br />When a city planning commission is created, the organiza- <br />tion thereof, the number of members thereof, their terms of <br />office and the method of their appointment and removal, shall <br />be as provided by local ordinance pursuant to the requirements <br />of Section 65150 of the Government Code of California which is <br />binding upon a general law city such as the City of the Town of <br />Los Altos Hills. When Section 2-2.102 of the Los Altos Hills <br />Municipal Code was adopted effective April 6, 1974, it provided <br />only for the number of members of the planning commission and <br />failed to provide for their terms of office and the method of <br />their appointment and removal as mandated by state law. On <br />July 1, 1977 the terms of five (5) members of the Planning <br />Commission will expire. In order to comply with state law and <br />to permit the Planning Commission to continue to function and <br />to act upon pending matters of importance to the Town and to <br />allow the City Council to make appointments thereto, the City <br />Council has determined that it is necessary to adopt an ordi- <br />nance specifying the terms of office and the method of their <br />appointment and removal prior to making any appointments to <br />the Planning Commission. Unless this ordinance is made effec- <br />tive immediately, undue hardship will result to the citizens <br />of the City of the Town of Los Altos Hills having business <br />-2- <br />
