(b) "City" shall mean the City of the Town of Los Altos Hills. <br />(c) "False Alarm" shall mean an alarm signal activated intentionally or through <br />inadvertence to which personnel of the law enforcement agency of the City respond. Alarm <br />owners who make contact with the law enforcement agency of the City before responding <br />units arrive at the location of the alarm shall not be charged with a false alarm. <br />Mechanical malfunctions will be considered false alarms. <br />(d) "Law Enforcement Agency" shall mean the Sheriff of the County of Santa Clara <br />with whom the City currently contracts for public safety services or the Chief of Police <br />of the City or one of his deputies. <br />Section 4-7.02 False Alarm Rating Period. Each alarm system shall be granted a <br />false alarm period of twelve (12) months which will begin on the date of the first alarm <br />occuring within said system. Succeeding alarm periods shall begin on the anniversary of <br />the first false alarm. A service charge of $25.00 shall be imposed by the City upon the <br />third and each ensuing false alarm during each alarm period. <br />Section 4-7.03 Appeal. The determination of any false alarm may be appealed by <br />the alarm owner in writing to the City Council of the City which shall, within fourteen <br />(14) days after receiving such request, set a hearing and give notice thereof by first <br />class United States mail of such hearing date. The owner may appear at such hearing and <br />testify if she or he desires. The decision of the City Council as to the appeal shall be <br />final. The alarm owner shall be notified by first class United States mail of its decision. <br />Each notice required to be given in this Section shall be mailed to the address of the <br />Owner contained in his or her written appeal. <br />Section 4-7.04 Citation; Issuance. In the event a false alarm is activated by any <br />alarm system within the City, a citation shall be issued by the Law Enforcement Agency. <br />The citation shall set forth the time and nature of the false alarm and that a service <br />charge, if applicable under Section 4-7.02, is due and payable within fifteen (15) days <br />after service of the citation. The citation will be mailed to the alarm owner by regular <br />first class United States mail, postage prepaid, to the address at which the alarm is <br />-2- <br />
