PEOFESSIC'7AL ASSIST:.2:_E FOR COUNTY <br />Tlpyc <br />Whenever the approval or satisfaction of the Officer may be <br />required in this Chapter for a design, monitoring, testing or <br />other technical submittal by an applicant or permittee, the <br />Officer may, in its discretion, require such applicant or per- <br />mittee, at such applicant's or permittee's sole cost and ex- <br />pense, to retain a suitably qualified independent engineer, or <br />chemist, or other appropriate professional consultant, accept- <br />able to the Officer, for the purpose of evaluating and rendering <br />a professional opinion respecting the adequacy of such submittal <br />to achieve the purposes of this Chapter. The Officer shall be <br />entitled to rely on such evaluation and/or opinion of such <br />engineer, chemist or professional consultant in making the rele- <br />vant determinations provided for in this Chapter. <br />ARTICLE 2. MATERIALS REGULATED <br />SECTION 4-13.201. MATERIALS REGULATED <br />The materials regulated by this Chapter shall consist of <br />the following: <br />(a) Any material listed as a hazardous and/or extremely hazard- <br />ous material or hazardous and/or extremely hazardous waste <br />in Sections 66680 and 66685 of Title 22 of the California <br />Administrative Code, as amended, whether such material is <br />stored or handled in waste or nonwaste form; or <br />(b) Any material which is listed on the list of Environmental <br />Protection Agency (EPA) pollutants, 40 Code of Federal <br />Regulations, Section 401.15, as amended; or <br />(c) Any material which is classified by the national Fire <br />Protection Association (NFPA) as either a flammable liquid, <br />a Class II combustible liquid or a Class IIIA combustible <br />liquid; or <br />(d) Any material which is listed by the Director of the Depart- <br />ment of Industrial Relations in Title 8, California Admini- <br />strative Code §339, as amended, excluding all footnotes <br />thereto and subject to the exclusions specified in this <br />subsection. Such exclusions shall apply only to materials <br />which are not otherwise regulated pursuant to this Section. <br />These exclusions shall be as follows: <br />-4a- <br />
