Iwo 40 <br /> RESOLUTION NO. 853 <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br /> LEASE OF REAL PROPERTY BETWEEN THE TOWN OF LOS <br /> ALTOS HILLS AND THE NATURE CONSERVANCY <br /> RESOLVED, by the City Council of the Town of Los Altos Hills, <br /> County of Santa Clara, State of California, that <br /> WHEREAS, the City Council of the Town of Los Altos Hills entered <br /> into an Agreement of Sale dated January 29, 1968 with THE NATURE <br /> CONSERVANCY, wherein the Town of Los Altos Hills purchased two parcels <br /> of land and was given the right to lease the remaining eight parcels <br /> comprising the Byrne Preserve, together with the option to purchase <br /> such additional parcels on an annual basis; and <br /> WHEREAS, heretofore the Town of Los Altos Hills has entered <br /> into an Addendum to the above described Agreement extending the <br /> date on which the option to purchase parcel No. 7 described in the <br /> Agreement of Sale may be exercised from December 1, 1974 to and <br /> including March 31, 1975; and <br /> WHEREAS, public interest and convenience require the entering <br /> into of a further Lease of the remaining two parcels, namely <br /> Parcels Seven and Eight comprising the Byrne Preserve for an <br /> additional term of three (3) calendar months commencing January 1, <br /> 1975 at a rental of Two Dollars because although the Town of Los <br /> Altos Hills has applied for and received approval of the use of <br /> State Park Bond Funds to purchase parcel no. 7 , the Town has not <br /> yet executed an Agreement with the State of California relating to <br /> payment of such funds, and the exercise of the option to purchase <br /> parcel no. 7 prior to execution of such an agreement would make <br />
