SIlk <br /> 41, <br /> RESOLUTION NO. 761 <br /> RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF <br /> LOS ALTOS HILLS URGING DEFEAT OF ASSEMBLY CON- <br /> STITUTIONAL AMENDMENT NO. 40 PROPOSING THE REPEAL <br /> OF ARTICLE XXXIV RELATING TO PUBLIC HOUSING <br /> WHEREAS, Article XXXIV of the California Constitution entitled <br /> "Public Housing Project Law" and adopted November 7, 1950 by an <br /> initiative measure, provides that no low rent housing project shall <br /> be developed, constructed or acquired in any manner by any State <br /> public body until a majority of the qualified electors of the City, <br /> Town or County in which it isproposed to develop, construct or <br /> acquire the project, approve such project by voting in favor thereof <br /> by an election held for that purpose; <br /> WHEREAS, Assembly Constitutional Amendment No. 40 would propose <br /> to the people of the State of California an amendment to the <br /> Constitution by repealing in its entirety Article XXXIV, and <br /> WHEREAS, the approval of Assembly Constitutional Amendment No. <br /> 40 by the voters of the State would result in the elimination of <br /> the right of the qualified electors in a city or county to determine <br /> whether in fact they desire to have developed, constructed, or <br /> acquired a low rent housing project and would vest that decision <br /> in persons who are not responsible or accountable of the City or <br /> Town, and <br /> WHEREAS, the repeal of Article XXXIV would intrude upon the <br /> local home rule to be exercised by a city and its electors in an <br /> area of activity which could affect only and solely the electors <br />
