r _ <br /> All <br /> RESOLUTION NO. 697 <br /> A RESOLUTION OF THE CITY COUNCILT E <br /> F <br /> 0 H TOWN OF LOS ALTOS HILLS <br /> REQUESTING LAFCO'S RECONSIDERATION OF LOS ALTOS HILLS SPHERES <br /> OF INFLUENCE. <br /> WHEREAS, on February 9, 1972, the County Board of Supervisors of Santa Clara County <br /> adopted by Resolution; "A Plan for Regional Parks for Santa Clara County", including the <br /> lower portion of Adobe Creek contained in University 72-1 , and <br /> WHEREAS, at the LAFCO public hearing held October 4, 1972, no mention was made of <br /> the County Supervisors' resolution in favor of a park in this area, and <br /> WHEREAS, the Government Code of the State of California, as quoted by LAFCO in <br /> "Procedures for City Annexation", states that all interested parties shall be heard at <br /> the October 4, 1972 public hearing on annexation, the Town of Los Altos Hills was <br /> represented but was not given the opportunity to express its interest in the matter, and <br /> WHEREAS, the City of Los Altos has contradicted the spirit and intent of the <br /> "Gentlemen's Agreement" Memorandum of Agreement between Los Altos and Los Altos Hills of <br /> March 14, 1963 by ignoring mutual consent and expressing sentiment favoring an application <br /> for R-1H cluster planned unit development instead of the 1963 agreed upon 1/2 acre buffer <br /> zoning in the annexed portion, and <br /> WHEREAS, there is indication, according to counsel , in the State Code that Edwin <br /> Johnsen, builder, who signed the August 30, 1972 application for annexation as "proponent", <br /> may in fact be ineligible to be "proponent" since°ttthe State Code apparently does not <br /> include individuals as proponents, and <br /> WHEREAS, LAFCO assigned jurisdiction to Los Altos although unaware that Los Altos <br /> was delinquent in several respects regarding land use policies and procedures, including <br /> failure to file "proposed staged development plans", such plans having been referred to <br /> in a LAFCO letter to cities as "basis for subsequent LAFCO decisions"; Los Altos failed <br /> to pre-zone the parcel in question while in sphere of influence and unincorporated as <br /> outlined in items l .b and 2.a, pages 6 and 7 of "Urban Development Policies for Santa <br /> Clara County" under Section II thereof as adopted by LAFCO on December 1 , 1971 . <br /> NOW, THEREFORE, BE IT RESOLVED that the Town of Los Altos Hills requests LAFCO to <br /> reconsider the annexation to Los Altos of the area in question, University 72-1 , and <br />
