F <br />-2- <br />Traffic Cont'd. <br />The City Road Commissioner was instructed to have the signs installe( <br />4. Faul lus , Floyd_ (V-35-58) - approval of a Building Site. <br />Letter, dated October 17t, 1958, was read from Mr. Dawson, owner of <br />the property stating that at the time the property is subdivided, <br />he expects to comply with ordinances governing subdivisions. <br />Councilman Clayton, reporting for the Committee appointed by the <br />Mayor to study this situation, recommended that the Town issue a <br />building permit, subject to an agreement between the Town and Mr. <br />Dawson, relative thein and off -tract improvements (entrance onto <br />Page Mill Road and re -alignment of the right-of-way of Page Mill). <br />Mr. Paullus stated that °'r. Dawson is having a new road constructed <br />on the Schroll property, and asked what steps would. have to be taken <br />to have the road accepted by the Town. <br />The Mayor answered that the road must meet the Town's Road Standard <br />specifications, be inspected by the Town, and application be made fo; <br />acceptance. <br />Three questions were asked the City Attorney by the Mayor. (1) If <br />Mr. Dawson dedicated sixty (60) foot right-of-way, it is possible <br />for him to take it back? The Attorney answered that the Town would <br />retain control of the property. (2) Does the Town have to accept <br />the dedication? The Attorney answered that the Town does not have <br />to accept the dedication. (3) Can the Town prevent the actual <br />tie-in with Page Mill Road? Under the existing ordinance, the <br />Attorney said the tie-in can be prevented. <br />ACTION: <br />That the variance of Floyd Paullus (V-35-58) be approved, sub- <br />ject to execution of a contract mutually agreeable between <br />Mr. Dawson and the City, pertaining to the on-site improve- <br />ments, specifically Page Mill Road. <br />MOTION: Clayton; SECOND: Sherlock; <br />The suggestion was made by the City Attorney that the Town should <br />work out an agreement regarding the re-alig;t:Akt of Fage Pill <br />Road, but leave any specific improvements until the time cne <br />road is to be constructed. <br />Councilman Clayton stated that there is no bond involved, and <br />that it is better to have a signed agreement. <br />VOTE: Passed unanimously <br />ANEW BUSINESS: None. <br />DIVISIONS OF LAND: <br />1.
