Variances: <br />Congregation Beth Am,(V-25-58) - Request for Use Permit for Church. <br />The Mayor opened the discussion by asking for comments. <br />Councilman Bledsoe stated that he had made a reseach of several <br />district court of appeals rulings which upheld the right of a city <br />to exclude churches, and which allowed a city to require a church <br />to waive its tax exemption, conditional to establishment. He <br />suggested that the Council might consider requesting Churches to <br />waive tax exemption. Councilman Clayton concurred with Councilman <br />Bledsoe. <br />Comments from the floor were offered by Thr. Gardner Bullis, Mr. <br />John stutherford, Mr. Omar Spain, Mr. George Pfeiffer III, and <br />Mr. Roy Burkhart. <br />In answer to the question of whether or not the Congregation Beth <br />Am would consider waiving its tax exemption, Mr. Gerald D. Marcus <br />stated that more time would be needed to consider such a proposal. <br />Relative to opposition to the establishment -of churches in Los Altos <br />Hills, Mr. William Geer stated that the opinion of the Los Lltos <br />Hills Association is about evenly split. <br />Members of the Council agreed that a policy relative to the estab- <br />lishment of churches in the Town should be set prior to action on <br />this variance, <br />I <br />ection was tabled until the next meeting, June 30t, 1958. <br />3. Fremont Hills Development Company - Setting of Dates for Beginning <br />and Tompletion of Off -tract Road and Drainage Improvements. . <br />The Mayor turned the gavel over to Deputy Mayor Bledsoe, and did <br />not take part in the ;aeeting. <br />Letter, dated Jane 23rd from the Fremont Hills Development Company <br />and signed by Mr. Harry Fitzpatrick, was received and studied by <br />the Council. The letter stated the status of improvements in <br />Units Nos. 1, 2, 3, and 4, including perimeter roads, and made <br />specific proposals regarding improvements about.which there is some <br />question. - <br />Mr. Fitzpatrick and Mr. John Riley were presented. <br />Mr. McCandless, City Engineer, stated that he would not accept the <br />proposal made in the letter as a whole, but stated that he would <br />agree to some of the specific proposals mentioned in the letter. <br />The suggestion was made to Mr. Fitzpatrick that he confer with Mr. <br />D. L. Berger relative to getting permission to open the drainage <br />ditch on his property to carry additional storm waters draining <br />from the Fremont Hills Subdivisions onto the Berger property. <br />
