• .• RESOLUTION NO. 557 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DECLARING A SURPLUS IN IMPROVEMENT FUND AND DIRECTING A REFUND IN SEWER ASSESSMENT DISTRICT NO. 3 . RESOLVED by the City Council of the Town of Los Altos Hills that WHEREAS , pursuant to Resolution of Intention No. 399 passed and adopted by this Council on June 19, 1967 , certain assessment proceedings were taken and completed, and WHEREAS, all improvements in connection with said proceedings have been completed and accepted, and all necessary things relating thereto have been completed, and WHEREAS, the City Treasurer has certified to the Council that there exists , due to the receipt of unexpectedly favorable bids for the construction of said improvements , a surplus in the improvement for said Sewer Assessment District No. 3 , in the total sum of $75 ,636.40 , and WHEREAS, said surplus is an excess amount realized from the assessment, and is over and above the amount needed for the improvement and bond redemption fund, NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills , acting pursuant to the provisions of the Municipal Improvement Act of 1913, and acting pursuant to the provisions contained in said Resolution of Intention No. 399 , that the City Clerk be, and he is hereby directed and authorized to make a refund in the sum of $166. 60 for each unit of benefit previously assessed, such refund having been paid directly to those persons who paid such assessments in cash, and to be credited against the next unpaid installments of all other assessments within the District (being those on the 1970-71 tax rull) , the time of such credit being more than two years after the bond proceeds were received.
