HomeMy WebLinkAbout77A-16 RESOLUTION 77A-16 RESOLUTION DECLARING THE INTENTION TO UPDATE THE NON- RESIDENTIAL SEWER ALLOCATION FEE SCHEDULE, SETTING A PUBLIC HEARING AND DIRECTING STAFF TO MAIL NOTICES TO NON-RESIDENTIAL SEWER USERS WHEREAS, the Town of Los Altos Hills ("Town") provides sanitary sewer services to approximately 14 non-residential users, including Town facilities; and WHEREAS,the Town of Los Altos Hills Municipal Code Sections 6-4.445 and 6-4.445(1) states that all sewer users shall pay a sewer service charge and the charge will be determined based on "service unit" compared to a typical single-family residence; and WHEREAS, the Town currently uses the 2003 Sewer Allocation Fee Schedule which assigns units of service consistent with the equivalent units of services used by the City of Los Altos at that time; and WHEREAS, the actual basis for how the City of Los Altos derived those units of service is unknown; and WHEREAS, an evaluation of non-residential wastewater discharge study was prepared to establishment a defensible methodology to support the equivalent units of service allocated to non- residential users; and WHEREAS,the City Council intends to consider the proposed Non-residential Sewer Allocation Fee Schedule, attached as Appendix A, by following procedures required under Article XIIID, section 6 of the California Constitution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills that: 1. The City Council hereby fixes the 20th day of January, 2017 at 7:00 p.m., in the Council Chambers, 26379 Fremont Road, Los Altos Hills, California as the time and place for a public hearing (Public Hearing) on the proposed Non-residential Sewer Allocation Fee Schedule. 2. At the time of the Public Hearing the City Council will hear and consider protests and objections from the non-residential sewer users to the proposed Non-residential Sewer Allocation Fee Schedule, and any the non-residential sewer users shall be permitted to present written or oral testimony. Although oral comments at the Public Hearing will not qualify as a formal protest,the City Council welcomes community input during the Public Hearing. Resolution 77A-16 Page I 3. Staff is hereby directed to provide notice of the Public Hearing and the proposed sewer service charge increases in conformity with section 6 of Article XIII D of the California Constitution. 4. At the conclusion of the Public Hearing, all valid written protests submitted will be tabulated in conformity with the City's tabulation guidelines.No electronic submittals will be accepted. All written protests must be delivered to the Town Clerk(either in person or by mail) before the close of the public hearing. 5. A majority protest for the Non-residential Sewer Allocation Fee Schedule exists if protests are submitted in opposition to that adjustment by a majority (50% plus 1) of those nonresidential sewer users. 6. If there is a majority protest against the imposition of the Non-residential Sewer Allocation Fee Schedule, the City Council shall not adopt that adjustment.
