Niles,Planning Director Ap' O • RECOMMENDATION That the Planning Commission: Approve the Site Development Permit for the pool pursuant to the recommended conditions of approval. DISCUSSION The project for the pool and addition was reviewed by the Planning Commission at their meeting of September 28, 1994. The addition was approved with conditions, however, the pool was continued to allow the applicant to submit a geology report for the Town Geologist's review since the pool was proposed to be located in the Human Habitation Setback Area (HHSB). Additionally, the Commission requested that the applicant redesign the pool to show at least a 2' deck around some ofthe pool, to return with a cross section of the pool in its proposed location, and submit a corrected worksheet#2. The applicant submitted the geology report which has been reviewed by the Town Geologist (November 28, 1994 letter attached). The geologist recommends approval of the project with conditions as set forth in the letter. The pool is proposed with a 2' decking on the north, south and east sides of the pool (see plans submitted by Anthony Pools), and the 1' coping on the west side of the pool. The plans show that there will be only minimal grading done to accomplish the pool with no cut, and 3 cu. yds. of fill proposed at the north east corner of the pool. A corrected worksheet#2 still needs to be submitted, however, the proposed square footage of development area appears to be just slightly below the allowed MDA of 14,256 sq. ft. PLANNING DEPARTMENT: 1. All conditions recommended by William Cotton in their report dated November 29, 1994 shall be conditions of this permit. The results of the plan review by the applicant's geologist of the pool construction plans shall be reviewed and approved by the Town prior to issuance of building permits. 2. Any changes or modifications to the approved plans shall be approved by the Planning Director or the Planning Commission, depending upon the scope of the changes. 3. The property owner shall inform the Town of any damage and shall repair any damagecaused by the construction of the project to pathways, private driveways, public and private roadways prior to final inspection and release of occupancy permits and shall provide the Town with photographs of the existing conditions of the roadways and pathways prior to acceptance of plans for building plan check. 4. The location of the pool is to be certified in writing by a registered Civil Engineer or licensed Land Surveyor after the foundation has been poured as being in the approved location and elevation established by this permit. 5. Standard swimming pool conditions: a. Lights shall be designed so that the source is not visible from off- site. Outdoor lighting must be low wattage and shall not reflect or encroach on adjacent properties. b. Drainage outfall structures shall be constructed and located to the satisfaction of the City Engineer. c. If applicable, fencing or other barrier shall be required for safety in conformance with the State and local standards and the Uniform Building Code. d. Equipment shall be fenced on all four sides for noise mitigation. • Planning Commission January 11, 1995 Lands of Nguyen Page 4 B. ENGINEERING DEPARTMENT: 6. The pathway along the project frontage on Dawson Drive shall be upgraded to a Type IIB standard and if needed the landscaping shall be trimmed to the satisfaction of the Engineering Department. 7. Any, and all changes to the proposed grading shall first be approved by the Town Engineering Department. No grading shall take place during the grading moratorium between November 1 and April 1 without prior approval from the Town Engineering Department. No grading is permitted within 10' of the property line. 8. Any areas on the site that have had the native soil disturbed shall be protected for erosion control during the rainy season and shall be replanted prior to final approval. \ 1 9. Any, and all changes to the existing drainage system shall first be approved by the Town Engineering Department. Final drainage shall be inspected by the Engineering Department and any deficiencies corrected �`Yk to the satisfaction of the Engineering Department prior to final approval. j ' � p/J 10. A corrected worksheet#2 shall be submitted for the file prior to issuance /VT of building permits. 11. All conditions of the September 28, 1994 Planning Commission approval shall be a part of this approval. 12. Upon completion of the construction, a final inspection shall be required to be set with the Planning Director and the City Engineer two weeks prior to final building inspection approval. CONDITION NUMBER 3 SHALL BE COMPLETED AND SIGNED OFF BY THE PLANNING DIRECTOR AND THE CITY ENGINEER PRIOR TO ACCEPTANCE OF CONSTRUCTION PLANS FOR PLAN CHECK BY THE BUILDING DEPARTMENT. Properties residing within the Los Altos School District boundaries must pay School District fees before receiving their building permit from Los Altos Hills. The applicant must take a copy of Worksheet #2 to both the elementary and high school district offices, pay the appropriate fees and provide the Town with a copy of their receipts. Niles Town Planner N O V 29 1994 TOWN OF LOS ALTOS HILLS 26379 Fremont Road Los Altos Hills, California 94022 IOWN OF LOS ALTOS HILLS SUBJECT: Geotechnical Review RE: Nguyen Swimming Pool File # 82-94-ZP-SD-GD 11632 Rebecca Lane At your request,we have completed a geotechnical review of permit applications for proposed pool construction using: •, Soil and Foundation Investigation (report) prepared by American Soil Testing, dated October 18, 1994; and • Swimming Pool Plans (2 sheets) prepared by Anthony Pools and R.J. Kolodziej,undated. . In addition,.we have reviewed pertinent documents from our office files and performed a limited inspection of the construction site from the perimeter of the subject property. DISCUSSION Our review of the referenced plans indicates that the applicant proposes to construct a swimming pool approximately 30 feet south of the existing residence. We were not able to perform a detailedinspection of the actual pool site because the property was fully gated and locked. However, from the perimeter of the property, we were able to inspect local soil conditions and obtain an adequate view of local slopes in order to form an opinion regarding project feasibility. SITE CONDITIONS . The subject property is generally characterized by gentle (6 to 15 percent inclination) northeast facing hillslopes. From the perimeter of the property, it appears that the pool site is located on gently inclined natural slopes or possibly in an area where previous minor grading (cutting) has occurred. Drainage is characterized by sheetflow to the northeast. The property is underlain,,at depth,by bedrock of the Monterey Formation. The boring log from the referenced foundation investigation indicates that the bedrock is overlain by a thick layer of silty'to'sandy clay (soil and colluvium). Laboratory testing of this clay and our observations of local desiccation cracking, indicate that the soil has ENGINEERING GEOLOGY • ENVIRONMENTAL EARTH SCIENCES • FOUNDATION ENGINEERING • Linda S. Niles November 28, 1994 Paget L3244 a high expansion potential. The potentially active Berrocal fault is mapped approximately 1,500 feet southwest of the property. CONCLUSIONS AND RECOMMENDED ACTION The applicant's geotechnical consultant has concluded that site surface soil exhibits a high swell/shrink potential. The consultant should review proposed pool construction plans and verify that they reflect recommended geotechnical design criteria to mitigate expansive soil conditions. Consequently, we recommend approval of the permit application for proposed pool construction with the following conditions: 1. Geotechnical Plan Review - The applicant's geotechnical consultant shall review and approve all geotechnical aspects of the pool construction plans (i.e., site preparation and grading, site drainage improvements and design parameters for the pool shell) to ensure that his recommendations have been properly incorporated. The results of the plan review should be summarized by the geotechnical consultant in a letter and submitted to the Town Engineer for review and approval prior to issuance of building permits. 2. Geotechnical Field Inspection - The geotechnical consultant shall inspect, test (as needed), and approve all geotechnical aspects of the project construction. The inspections should include, but not necessarily be limited to: site preparation and grading, site surface and subsurface drainage improvements, and excavations for the pool shell prior to the placement of steel and gunnite. The results of these inspections and the as-built conditions of the project shall be described by the geotechnical consultant in a letter and submitted to the Town Engineer for review prior to final(as-built)project approval.
