Staff Report to the Planning Commission
RE: SITE DEVELOPMENT PERMIT FOR A MINOR
ADDITION/REMODEL AND DRIVEWAY MODIFICATION; LANDS
OF LANE, 10695Magdalena Avenue (215-94-ZP-SD)

RECOMMENDATION That the Planning Commission:
Approve the Site Development Permit for the minor addition/remodel
and driveway modification pursuant to the recommended conditions of
approval.
DISCUSSION
The applicant is proposing a minor addition/remodel of 410 sq. ft. and a
driveway modification to eliminate an unsafe entry onto Magdalena and allow
for adequate maneuvering into the remodeled garage. This project would
normally be an Administrative Review due to its small size,but because the
applicant was proposing to add additional development area in the setback, staff
is forwarding the project to the Commission for a determination. As you are
aware, the issue of development area in setbacks is currently a concern of the
Town, and in fact a Zoning Ordinance amendment will be reviewed by the
Council sub-committe on development standards in the very near future. Since
the property owner is requesting to add additional development area in the
setback staff felt that the Commission should review this particular application.
It is staff's recommendation that the Planning Commission approve the driveway
modification because the area where the development area is to be added is not
highly visible; the project is proposing to move the entry to the garage to the side
of the lot instead of facing the street; the existing steep and unsafe driveway
entrance on the south corner of the lot is being removed; and the backup area is
needed for adequate maneuvering into the new garage.

project as submitted with the recommended conditions of approval.

RECOMMENDED CONDITIONS OF APPROVAL
FOR A SITE DEVELOPMENT PERMIT
FOR A MINOR ADDITION/REMODEL
AND DRIVEWAY MODIFICATION
LANDS OF LANE, 10695 Magdalena Avenue

A. PLANNING DEPARTMENT:
1. Any changes or modifications to the approved plans shall be reviewed
and approved by the Planning Director.
2. The property owner shall inform the Town of any damage and shall repair
any damage caused by the construction of the project to pathways,private
driveways,public and private roadways prior to final inspection and
release of occupancy permits and shall provide the Town with
photographs of the existing conditions of the roadways and pathways
prior to acceptance of plans for building plan check.`
3. The location of the addition,eaves and retaining walls is to be certified in
writing by a registered Civil Engineer or licensed Land Surveyor after the
foundation has been poured as being in the approved location and
elevation established by this permit.
B. ENGINEERING DEPARTMENT:
4. Any,and all changes to the proposed grading shall first be approved by
the Town Engineering Department. No grading shall take place during
the grading moratorium between November 1 and April 1 without prior
approval from the Town Engineering Department. No grading is
permitted within 10' of the property line.
5. Any areas on the site that have had the native soil disturbed shall be
protected for erosion control during the rainy season and shall be
replanted prior to final approval.
6. Any, and all changes to the existing drainage system shall first be
approved by the Town Engineering Department. Final drainage shall be
inspected by the Engineering Department and any deficiencies corrected
to the satisfaction of the Engineering Department prior to final approval.

7. A completed worksheet#2 showing the correct development and floor
area square footages as approved by the Planning Commission shall be
submitted for the filg prior to issua ce of uildi g permits.

DEPARTMENT.
Properties residing within the Los Altos School District boundaries must pay School
District fees before receiving their building permit from Los Altos Hills. The
applicant must take a copy of Worksheet#2 to both the elementary and high school
district offices, pay the appropriate fees and provide the Town with a copy of their
receipts.
NOTE: The Site Development permit is valid for one year from the approval date (until
February 8, 1996). All required building permits must be obtained within that year and
work on items not requiring a building permit shall be commenced within one year and
completed within two years.

Dear Suzanne,
With regard to the three items contained in the memo from Sheryl Koff dated..
December 19, we will show the treatment of the drain line where it daylights:
We feel, however, that we may need to meet and discuss the other two items.
Our entire concept is predicated on being able to place the new driveway apron -
within the setbacks. We believe the Planning Commissioners may have raised
their concern after our initial discussions with staff. In the interim, however, we
have proceeded with construction drawings which are now virtually complete.
We feel that, if such a new interpretation of driveways is to become adopted, it
should be clearly stated in the Zoning Ordinance and applied to future projects,
but not to.a design already underway.
With regard to retaining walls, we would respectfully suggest that the
construction activitiy necessary to construct a wall not be construed as "grading"
if the original contours of the land between the wall and property line are
distrubed only moderately during construction and restored when the wall is
complete. That is our intent with the Lane property, and we would include a
note to that effect on our construction drawings. Of the 130' of wall, only 35' is
cut into the setbacks.
We will be happy to meet with Staff, and with members of the Planning
Commission or.Council if you feel itis appropriate, to;discuss these matters.

Dear Chairperson and Commissioners:
On behalf of Bill and Kathy Lane, I am requesting approval of the requested addition of the related
grading due to the following benefits to the Lanes and the Town:
• Correct existing drainage that now directs water into garage.
•
• Remove existing and unsafe second access to Magdalena.
• Proposed garage orients doors away from front property line in accordance with Town
policy for hiding garage doors.
• Existing overhead electrical service will be placed underground.
• Proposed addition is unobtrusive and low profile,one-story. Most of the living space is
under existing roof area.
• Two existing substandard non-conforming structures are to be removed.
• Existing landscape screen at Magdalena to remain. Landscaping obscures the proposed
addition from Magdalena viewing.
• Proposed retaining walls vary in height from 0'to max 48". Walls will be modular
"keystone°type which allow for landscaping to grow over and ultimately conceal. Final
result Is a natural,planted slope.
For these and other benefits we respectfully request your approval of this addition as proposed.
