1. ROLL CALL AND PLEDGE OF ALLEGIANCE
The Planning Commission meeting was called to order at 7:08 p.m. in the Council
Chambers at Town Hall.

2. PRESENTATIONS FROM THE FLOOR
Kati Stella,27975 Via Ventana,Pathways Committee, discussed a
recommendation from the Pathways Committee for in-lieu fees with suggested
wording"the Town may require construction of roadside and off-road paths in
conjunction with major development or redevelopment of the property but will
require in-lieu fees in cases where no path is needed for that property or if a
needed off-road path would be incomplete." The recommendation has not been
presented before the City Council. Files would need to be researched to prevent
double charging of in-lieu fees.
Chairman Schreiner requested consideration to add an emergency item for a
discussion of the proposed time line for the Lands of Vidovich. This will be
discussed under New Business.

Commissioner Doran, seconded by Commissioner McMahon and passed by •
consensus to add Vidovich time-line discussion under New Business.

4. PUBLIC HEARINGS

4.1 LANDS OF HONG,26370 Ginny Lane (211-94-ZP--SD); A request
for a Site Development Permit for a new residence and secondary
Unit (continued from February 8 and 22, 1995).
Discussion ensued regarding noise attenuation noting that the building
department would check interior noise standards with a letter to follow from the
noise consultant verifying conformance. Commissioner Stutz would like to see
the conformance letters in the future. Other issues noted were the two sheds, the
garage and the gravel driveway to be removed from the property and what was
the normal driveway width and turnaround area. It was noted that only certain
outdoor living areas need to meet a certain decibel level. The Commission will
look at what portion of the outdoor living areas need noise mitigation.
OPENED PUBLIC HEARING •
Dick Fang,21726 Noonan Court,Cupertino, architect, discussed the changes
made from the previous meeting; the only building to remain is the cottage; all
other structures will be removed; the back portion of the cottage will be removed
to conform with the 1,000 square foot maximum for a secondary unit;theexisting
driveway next to the property line will also be removed,keeping only the new
driveway; the outdoor living area will be between the cottage and the new house;
the color of the cottage will match the new residence; they will plant an
additional three trees along the back property line to help with noise mitigation;
and there is only potential future plans for a tennis court or a pool.
Commissioner)I Gottlieb noted there were no doors leading from the house to the
outdoor area v rith Mr. Fang commenting they would go out through the family
room to the outdoor area.

Chairman Schreiner felt the applicant has made a number of changes as
requested,hoever noise mitigation for outdoor living areas was still a concern.
Commissioned Gottlieb felt that the area by the kitchen needed additional
mitigation alofig with the back of the lot suggesting rows of shrubbery along the
setback line starting at the 205 contour line with triple rows of trees.
Commissioners Stutz agreed with Commissioner Gottlieb suggesting adding two
additional trees to the three trees proposed with a 10-12 foot strip from the back
trees to be heavily planted with small and tall shrubs. She did not want to
choose their otitdoor living area nor does she want to indicate mitigation
measures on'areas where there are no plans for development currently. Four
trees behind the cottage are shown on the plan. She suggested requiring a 5-6
foot semi-circular wooden or glass fence on the back side for additional

protection from the 280 freeway. She suggested deleting#9 as a deed restriction
for noise mitigation has never been required previously. She also requested a
change to#5,requiring both houses painted the same color; and#18, clarifying
the lot number.
Commissioner Doran asked, at the completion of this project,if someone would
be measuring the decibel level from their outdoor recreation area? Mr. Porto
responded no. Commissioner Finn noted that the applicants have changed the
driveway,removing the driveway to the cottage, creating more shading on the
house, and more landscaping along 280 which will benefit them in years to come.
Since the Hongs bought this lot, apparently not offended by freeway noise,he
did not want to suggest additional landscaping as previously mentioned.
Commissioner.Cheng noted that the staff report indicated that noise mitigation
was a State requirement. Mr. Porto noted that the information was conveyed "
incorrectly according to the City Attorney as far as State requirements. The
applicants should be complying with the Town's General Plan relating to levels
of noise. The project has been designed in such a manner to mitigate the outdoor
area which will significantly reduce the sound in the outdoor living areas as
shown on the plan. Commissioner Cheng asked if testing would be required
after construction is completed? Mr. Porto responded that it has not been
determined that it would be necessary.
Commissioner McMahon commented that the applicants can use the outdoor
space if they utilize the recommendations of an acoustical engineer. She did not
feel they should hold them to a certain decibel number. They should require a
consultation with an acoustician to maximize the benefit of their property and
perhaps a statement in-lieu of condition#9,not a deed restriction but a deed
notification,regarding noise mitigation and areas of concern. Commissioner
Chengdid not feel this was needed. Mr. Porto suggested replacing#9 with a
condition stating"at the time of submittal of the landscaping plan for review and
approval,the applicant shall submit an acoustics report relative to the exterior
living areas."
In this way they will know that the plan being designed will be
mitigated to an acceptable level. Commissioner Gottlieb felt the outdoor living
area should be accessible to the main house. This could be accomplished by
changing the window in the den to a door. She did not feel an outdoor
recreation area on the side of the house without any access doors would be used.
Commissioner Finn did not feel they should dictate the Hong's personal living
styles. They should mitigate only the particular area as shown at this time .
Commissioner Stutz suggested the noise mitigation in the outdoor living area as
previously noted (additional trees,wood or glass fence) be put off until the
landscape plan is submitted for review and approval. At that time they will be
able to see how much the structures have mitigated the noise.

There had been a previous request to step in the second story to add more
dimension to the house. Commissioner McMahon noted that 70%of the second
floor is directly in line with the first floor creating two story walls.
Commissioner Finn commented that there was a request made to minimize the
. box-like feeling,g, however not everyone agreed that the request was necessary
because the vertical parts of the house are on the 280 freeway side. It was difficult
to see the back of the house from 280. He did not feel this requirement was
necessary as no one would see it from the freeway. Mr. Fang noted that the
eaves have been extended to two feet as shown on page A4 in a "cloud" area.
This request will also be added to the conditions of approval.
The conditions of approval were discussed adding to#5 that both house and
cottage shall be painted the same color;#2 to remain unchanged. It was noted
that an acoustical engineer could suggest noise mitigation measures for the
outdoor living areas as proposed but not for the back area next to 280 as the
Commission does not want high walls as previously requested. Decibel numbers
will not be set, only indicating a need for sound mitigation. This would prevent
an acoustical report requiring a wall.
MOTION SECONDED AND PASSED BY CONSENSUS: Motion by
Commissioner McMahon, seconded by Commissioner Cheng and passed by

consensus to delete condition#9.
MOTION SECONDED AND PASSED: Motion by Commissioner Finn and
seconded by Commissioner Doran to approved the site development permit for a
new residence and a secondary unit with the following changes to the conditions
of approval: #2,within the 20 foot setback along the 280 corridor, shrubs and
trees shall be densely planted for noise mitigation;#5, the house and cottage
shall be painted the same color; replacement for#9, "At the time of the submittal
of the landscape plan for site development review, an acoustical engineer shall
review the one proposed exterior outdoor area and"certify that exterior noise is
mitigated to alicceptable levels.";#18, clarify lot number; add standard tree
protection condition; add a condition, "all eaves shall be two feet in length"; and
#10,the existing 445 foot square shed shall be removed and the 60 foot shed shall
be moved.

4.2 LANDS OF JABBOUR, 12800 Clausen Court (3-95-2;P-SD-GD); A
request for a Site Development Permit for a new residence,pool
and landscape plan.
Chairman Schreiner suggested eliminating the discussion on the landscape plan
as this is usually reviewed by the Site Development Committee after the house is
framed.
Mr. Porto noted that this property does back up to the 280 corridor and the El
Monte off ramp. The Clausen subdivision was conditioned relative to noise.
This was one lot within that subdivision that was determined not to need any
mitigation measures. Commissioner Doran was at the property site during the
rain storm noticing the amount of water on Clausen Court and running down
Voorhees. Ms. Kolf explained the water coming down Clausen Court was going
to a box which eventually leads down to El Monte. There is also drainage from
the freeway that goes down into the swale on the side of the property. One of the
Town requirements is to try to keep the drainage in the same pattern that exists
naturally. Commissioner Gottlieb did not feel the drainage was designed to
protect the lower lot. She also suggested heritage protection for the 36 inch oak
tree. Staff will work with the applicant's engineer regarding drainage.
OPENED PUBLIC HEARING
Mark Robinson, 1068 Alderbrook Lane,San Jose, architect, discussed the design
and the oak trees on the property which helped with screening of the second
story. They plan to preserve all heritage trees on the property. Commissioner
Finn asked if he would discuss some of the compromises made with staff
regarding the design. Mr. Robinson noted there were not many compromises
except for ruling out any driveway access off Voorhees Drive although it was
considered their frontage. The placement of the garage determined the
circulation on the site. It was not pointed out that the garage would directly face
the opposite neighbor. Ms. Kolf noted a requirement of the subdivision was to
access off of Clausen Court which is a normal requirement of the town,keeping
access off of the most heavily traveled road.
Larry Hwong, 12813 Clausen Court,was concerned with the four car garage
facing his property, and requested lowering the first floor level an additional
four feet,minimizing the blockage of the views from their living room and
dining room. He thought the applicant's finished floor level was at 300
elevation; theirs at 305 or 306.
Mr. Robinson clarified the floor level differences noting that the Hwong's
finished floor level was 11 feet above their finished floor level. This information
was based on the Hwong's plans submitted and on file. The roof height is at 326.

He also noted that the 26 foot ridge line is behind the oak trees;not something
that is blocking their view is presently. The highest point of the roof behind the
oak trees. There will be 325 c.y. of cut and 170 c.y. of fill. Commissioner Gottlieb
asked if they had any drainage concerns with the pool being so low. Mr.
Robinson felt the civil engineer would address drainage issues.

Discussion ensued regarding the drainage,house siting, the placement of the
garage and the protection of the oak trees. Commissioner Finn requested the
standard tree protection condition be added to the conditions of approval and
investigate designating some of the trees as heritage oaks. He complimented the
architect for'a great job with the design of the house but he felt the garage doors
should face Voorhees and the driveway access should be off of Voorhees. He
asked staff to i1econsider their recommendation. He did not feel it was necessary
to lower the house as it is a foot shorter than other houses in the neighborhood
and lower than the house across the street. Jean Struthers commented that the
Environmental Design committee suggested rotating the house slightly away
from the oak tree for protection;more on the contour of the lot. Commissioner
Doran asked if rotating the house would create more cut and fill. She asked for
clarification of the subdivision conditions as to driveway access which Ms. Kolf
will review. Commissioner Doran agreed with changing the orientation of the
entry to the garage keeping the garage doors away from Clausen Court. She
suggested lea ling the drainage up to the engineers. She complimented the
architect on the design of the house. Commissioner Cheng would like to see the
garage doors face Voorhees with access from Voorhees also. Commissioner Stutz
felt the architect had done a very good job with the design of the house. She did
not feel the applicant has to access off of Clausen Court according to the
subdivision conditions of approval. She also commented on three dead street
trees along Voorhees which need to be replaced. She would prefer the tree
placement 10 feet inside the pathway instead of out between the pathway and
Voorhees. Commissioner Gottlieb was concerned with the drainage to the lower
lot, suggesting a conservation easement over the swale. She asked if the house
could be lowei{�ed to accommodate the neighbor. Commissioner McMahon
clarified her suggestion to rotate the house 10-15 minutes,not degrees; the staff
following direction regarding ingress/egress; and complimenting the architect
on the design of the project. Chairman Schreiner was concerned with the size of
the swale;placing an easement over the swale. There was a desire for a redesign
of the garage so it will not impact the uphill neighbor. She was not concerned
with where the driveway comes in, as it could come in from Clausen Court,
swinging around,with the garage facing Voorhees. She also felt it would be
helpful if they(could lower the house.

Ms. Kolf discussed the possible request fora conservation easement over the
drainage swale noting a conservation easement is generally required when there
is a drainage swale running through a property that carries flow from other
properties or from the road. It would not be appropriate to ask for a
conservation easement over the swale. Engineering can work with the applicant
and project engineer to design a swale to best benefit the lower lot,providing a
revised drainage plan for review.
Elayne Dauber,27930 Roble Alto, discussed the advantages of eaves. They carry
water away from the house,reduces the need for painting, and the occupants can
still open their windows on a rainy day.
Mr. Porto noted that rotating the garage so the garage doors face Voorhees may
require the turnaround placement in the setback. Normally, the town prefers
garage doors not facing the more heavily traveled major street. Commissioner
Finn would like the garage doors facing Voorhees. Commissioner Stutz noted
that Voorhees.is not a major road;it is a local road.
Commissioners Finn and Doran were satisfied that the staff and the project
engineer could handle the drainage. It was understood that the Commission was
looking for the garage doors to be turned to face Voorhees Drive and they were
very concerned with visibility from Voorhees Drive allowing the architect the
option of designing the driveway off of Clausen Court. This would allow him
room for landscaping for screening with the garage angled so it will not be facing
the neighbor directly.. Dr. Hwong commented that he would prefer the garage
doors and driveway facing Voorhees Drive. Mrs. Jabbour noted that she was
also concerned with drainage and they will be working closely with the
engineers.
MOTION SECONDED AND PASSED BY CONSENSUS: Motion by
Commissioner Cheng and secondedbyCommissioner McMahon and passed by
consensus to continue the application to-April 12 at 6:30 p.m. for a redesign as
discussed.
4.3 LANDS OF WEN,24032 Oak Knoll Circle (8-95-ZP-SD-GD-VAR);
A request for a Site Development Permit for a new residence,pool
and tennis court, and a variance to allow the tennis court to
encroach into the side setback.
Discussion ensued regarding the new residence and pool. Corrected figures for
MDA/MFA-were,provided to the Commission. The staff report indicated both
the proposed pool and tennis court were located on the southerly property line,
with five feet of the decking for the tennis court encroaching into this setback.
This is incorrect. The tennis court does encroach into the northern setback. The

applicant requests a variance for the tennis court to encroach 25 feet into the legal
setback line, as measured from the edge of the fire access. The Code dictates that
the setback be measured from the access easement rather than from the property
line. The 20 foot emergency access road is also a pathway. The plan should be
corrected. Commissioner Doran commented that when the numbers are so close
to the maximums, a general statement should be made that the property is -
maxed out. Chairman Schreiner asked if all development area was counted, and
if the grass area inside the fence for the tennis court was counted toward the
development area. She asked if they had any policy that when a fenced grass
area gives the appearance of development area,is area also counted. Ms. Kolf
responded that this subject was discussed at a City Council meeting-as an item
they would,like the Planning Commission to review. It was noted that the pool
equipment does not appear to be included in the development area figures.
OPENED PUBLIC HEARING
Buzz Bryan,248 Delphi Circle,Los Altos, architect,noted due to the site
limitations,the tennis court was substandard,however there is a five foot run-
back area. The pool equipment is not shown and will be added by making an
adjustment in paved area. Commissioner Gottlieb felt this was a flat lot on top of
a hill with a three story step down house. Mr. Bryan disagreed as there is a 20
foot difference in elevation. It was his understanding that there had been some
dialogue regarding the setback from the property line rather than from being the
edge of emergency access easement. He noted that Mr. Lohr had met with staff
and felt the.project would be approved as presented this evening which included
the variance request. -
CLOSED PUBLIC TESTIMONY
Commissioner Doran was in favor of the design of the residence and the pool
which fits into the lay of the land, however she was opposed to a tennis court on
this lot. Commissioner Finn also liked the house although he did not feel this
was a ridge top house. He also felt the tennis court does not work on this lot.
Commissioner Cheng agreed with both Commissioners. She did not have a
problem with the encroachment as the staff report noted that the City Council
discussed the issues and decided that a variance could be considered in this case,
due to the infrequent use of the fire access road. Commissioner Gottlieb noted
that there was a slope easement going down to the emergency access road. They
are building a retaining wall for the driveway right along this slope, asking
engineering i would be creating an unstable condition. Ms. Kolf explained the
use of a slope easement noting that the retaining wall would not create an
unstable con ition. Commissioner Gottlieb was in favor of lowering the height
of the house. Commissioner Stutz commented on William Cotton's report and
the use of geoweb. She would like to see this used on the wall along the

driveway to conceal the wall. She felt the owners had already investigated the
possibility of a tennis court by going to the City Council,using the property line
rather than the emergency access line. Commissioner McMahon liked the house
design,the natural and finished grade,however she was not in favor of the
tennis court. Chairman Schreiner was concerned with this very visible house.
She did not care for the tennis court or the grass around the tennis court enclosed
by the 10 foot wall noting the development on this lot. Mr. Bryan indicated that
the owner would not be interested in anything less than a tennis court.
Variance findings were discussed.
MOTION SECONDED,AMENDED AND PASSED: Motion by Commissioner
Doran, amended and seconded by.Commissioner Finn to deny the variance to
allow the tennis court to encroach into the side setback.

submitted for staff approval;#15, add "The pathway easement over the fire road
shall be shown on the site plan. The pathway should be kept free and clear
during construction. Planting and/or sprinklers should be at least five feet from
the pathway."; and#17, deleting "tennis court."

4.4 LANDS OF WESTWIND BARN,27210 Altamont Road (11-95-
CUP); A request for a Conditional Use Permit for Arena
Refurbishment.
Mrs. Pollart noted that the request was actually for an"amendment" to the
existing conditional use permit for arena refurbishment. Staff had nothing
further to add.

Mike Stortz,President of Friends of Westwind,discussed the existing area
located at the bottom of a small valley. In the rainy season the run-off passes
right through the arena rendering it unusable from November to May. This is
the problem they are trying to overcome. The new rock base arena helps direct
therainfall off the area making it more readily usable. The swales will direct
run-off around the arena rather than through it. Other features include fencing
of the arena,j dges booth,registration stand, adding a water tank to facilitate the
sprinkler sys em and the dirt track that surrounds the existing arena,will be
relocated. One of the major issues will be access to the arena as the trail leading
from the barn to the arena area is very steep in places (an existing feature of the
topography). Their proposal does not include modifying the access trail other
than where it ties into the track surrounding the arena. He asked the
Commission to consider the existing trail in a grandfather status as it has existed
for many years and has been acceptable by the folks at Westwind. He noted that
a flyer had been sent to all of their neighbors to review and discuss any of their
concerns. At that time,the Montgomery's discussed their concerns which were
the visual impact and dust. As a result of the discussion,Westwind proposes to
plant redwood burls in the gaps of the Montgomery's landscaping that would
mitigate their visual impact to the Westwind property. Mr. Montgomery was
present at the meeting earlier to speak in favor of the project, however he had to
leave. There will not be any changes to the conditional use permit as far as the
number of horses boarded. The uses will remain the same. The conditions of
approval wer acceptable.
Chairman Sc einer was concerned with access road for emergency vehicles and
the slope of'2 %. Even though this is an interior road, it is being used in a
commercial anner. Mrs. Pollart noted that because this was an interior road,
there was not a code that specifically addresses this subject. She had spoken to
Stu Farwell, lire Marshall,who indicated that they have never recognized this
road as an emergency access route. If there was an emergency situation,in the
winter they Wiould walk down and in the summer they would drive down
without a problem.
CommissioneL McMahon noted ADA compliance was not addressed (wheel
chair accessiblity, handicap parking) and the location of the judges booth faces
into the sun. Commissioner Stutz discussed the material used for the ring (base
rock and three inches of sand on top) and the possibility of switch backs down
another road pff across Byrne Park, swinging down and around. Beyond the .
sand ring there is a road going off to the right with a gate belonging to Mr.
Holland. She asked if Mr. Holland would allow them to access a part of this road
with a few s titch backs to reach the bottom of the property. Mr. Stortz felt if
they employe the use of switch backs they would lose several of the paddocks

• in the pasture area that are used for the horses. He further discussed the seeding
of the spoils area which will address the dust concerns of Mr. Montgomery.
Les Earnest,member of emergency access sub committee,noted that he had
received from Stu Farwell specifications of what constitutes an emergency access
road. The Westwind Barn road.does not meet these specifications and is eroding
rapidly because it is so steep. For pathways,the design standard is a 10%slope;
not exceeding 15%. This road is also a public pathway and should meet pathway
standards. He felt there was room on the property to swing a switch back over
toward Byrne Preserve by displacing the paddocks into what is now the road
area,making a route that is a safe public access which will not require as much
maintenance as the current route,using a gravel surface. He noted that the
natural pathway going over Central Drive is not shown on the plan. The repair
of the pathway that comes into the valley should be a part of this project.
Hill Reiser,27640 Red Rock Road, questioned the water storage tank as he was
concerned with the dimensions, the location on a ridge and the necessity of the
tank. He thought it was an odd place for a water storage tank. He certainly
would not object to the placement of the tank on the opposite side of the ring.
Kelly Douglas, 1170 Ruby Street,Redwood City,Westwind Barn manager,
addressed items discussed. The water storage tank will not be sitting on the
ridge;the tank will be built into the side of the hill with landscaping and
screening;the path mentioned by Mr. Earnest is a part of the Byrne Preserve
property;switch backs would require much movement of paddocks and expense;
the existing path has been in existence since the 1940's; seasonally they place 40
tons of rock onto the road; the construction trucks will also make improvements
to the road; and in the last eight years there has not been one tractor accident.
Until just recently,there was nothing ever said about pathway improvements.
Ms. Douglas could hopefully work with the pathway committee in putting in a
small section of the path (native)between the sign and feeding pasture which
would take out a portion of steepness and make it an easier access to the ring.
Nancy Couparas, 13680 Page Mill Road,Westwind Barn associate,noted there
was a handicap riding program twice a week whichis accessible to everyone.
She was an ADA committee member, attending several meetings. She has
looked through the barn for the ADA requirements,providing the checklist to
Linda Niles. She discussed the history of the property and past emergency
accessibility to the property. Mrs. Couparas presented the Commission with a
letter in support from Steven Haze, President of the Horseman's Association.

Discussion ensued regarding ADA requirements and possible hardship variance
for Westwind Barn. It was clarified that this was not new construction but an
amendment to the conditional use permit for arena refurbishment.
Commissioner McMahon discussed ADA requirements noting that the State may
not ask for road improvements,however they would require handicap seating.
Mrs. Pollart will discuss ADA requirements with the City Attorney and the items
needing compliance. The Commission requested a site plan of the project and
the location or the pathway which connects to Central Drive;investigate other
locations for the pump,the size and color and/or indicate the placement with
story poles (with yellow ribbons);investigate cost of upgrading the project;
provide a mater plan the spectator area; a deeper sand footing; compaction of
the road;possibility of making the pathway more gradual; and improving
accessibility over a period of time (phasing the project).
Commissioner Finn felt there was no problem with the road (grandfathered).
Chairman Schreiner felt the only time the Town can ask for improvement is
when an application comes in. It would not be reasonable to bring it up to Town
standards,however she would like to have a study done to see if it would be
possible to eliminate some of the problem areas. She asked if they could work
with staff on improving the accessibility and the pathway ( slope). Mr. Stortz
noted that there would be some improvement to the road by the construction
company to enable access for their trucks. The cost of relocating the
road/pathway or providing a switch back road was beyond their budget.
Concerns needing to be addressed were: trenching the 120 foot pipe, spectator
area; drawings incomplete;pathways not shown; ADA requirements not
addressed; track access; and pathway access not in compliance with Town
ordinances. Commissioner McMahon suggested the involvement of an
engineer/architect.
Commissioner Finn asked for input from staff since they did recommend
approval of this project. Mr. Porto noted that originally the project was thought
to be very minor; an amendment to the existing conditional use permit.
Commissioner Stutz discussed the findings noting#1 indicates easy access off of
Altamont Road. She requested deletion as there is not easy access. #3,last
sentence, does not address the arena.
MOTION SECONDED AND PASSED: Motion by Commissioner Gottlieb and
seconded by Commissioner Cheng to continue the application to April 26 at 6:30
p.m. addressing items discussed as concerns and providing a site plan of the
project.
