POOL AND CABANA;LANDS OF GARCES;26101 ELENA ROAD.

RECOMMENDATION That the Planning Commission:
Approve the requested Site Development Permit as submitted,subject to the
attached conditions of approval.
BACKGROUND
The subject property is located on the east side of Elena Road,two lots north of
Robleda Road. The rear of the property is next to Interstate 280. Adjacent
properties to the south are perpendicular to the site,and are accessed from
Robleda Road. Previous illegal grading on the Garces property has affected one
or more of the properties abutting the site on the south side. The grading will be
corrected with the construction of the proposed improvements,as shown on the
civil engineering (site) plan.
There are three nonconforming situations existing on the site: the northwest
corner of the house and the southeast corner of the garage extend into the side
setbacks,and a corner of the brick patio at the rear is in the side setback.

The applicant is requestin approval of a site development permit to add 1,772
squarefeet to an existing r sidence and 70 square feet to an accessory structure,
and to build is pool and ca ana. Some interior remodeling of the residence will
be done as well. The addi ions to the first floor total 1,185 square feet. The lower
level will be increased by 87 square feet. A 70 squa e foot pool equipment..
enclosure will be part of a abana structure to be built next to the new swimming
pool. The cabana will hav- two 12 foot high walls and an open beam trellis roof.
The two open sides will h.ve stucco covered support posts. Because the
structure is open on two si•es and does not have a solid roof it is not considered
floor area (e)kept for the p••1 equipment enclosure). The two solid glass walls
will serve as a wind break and sound wall. A built-i barbecue and sink will be
part of the pool area. The •roposed improvements will all conform to setback
and other dimensional req 'rements.
• The maximum height of t e existing house is 22 feet 8 inches as measured from
the existing grade. The he ght will not increase with the additions. Exterior
materials will consist of s cco siding, chimney and support posts and tile
roofing. No skylights are I,lanned..
The Environmental Desi: &Protection Committee recommends the use of less
reflective exterior colors d e to the visibility of the house from immediate
neighbors arid:the freewa ,and that the carriage style light fixtures be replaced
with"down"lighting. Pro ective tree fencing should be placed around existing
trees during construction, :nd the path at the lower edge of the property needs
protection from drainagef om the site.
The Engineering Departm:nt has reviewed the plans and has recommended
conditions of approval as •pecified in Attachment 1. Grading includes 871 cubic
yards of cut and 728 cubic ards of fill. The excess dirt from the excavation will
be removed from the site.
Santa Clara County Envir•nmental Health has given preliminary approval of the
septic system. Portions of a existing leach field wil be abandoned and a new
expansion field will be ins galled beyond the pool area,as shown on the site plan.
The final approval of the s'ptic system will be required to be done and approved
plans submitted to the To n,prior to acceptance of plans for building plan
check.
The Pathways Committee isited the site and recommends that the existing
pathway in the Elena Roa• right-of-way be upgraded to Type IIB standards. The
path should be kept open •uring construction,and new plantings.or irrigation
should be kept at least five feet from the path. In addition, the driveway will be
required to be roughened here it crosses the path.

The proposed project will leave 851 square feet of development area and 652
square feet of floor area for future additions or improvements,and staff
recommends approval,subject to the conditions in Attachment:.1. Staff is
available to answer any questions that the Commission or the public may have.

A. PLANNING DEP• TMENT:
1. Any chap:es or modifications to the approved plans shall: be
approved •y the Planning Director or the Planning.Commission,
depending pon the scope of the changes.
2. Subsequent to framing, a landscape planting plan shall be reviewed
by the Site IDevelopment Committee. Particular attention shall be-
given to pl.ntings which will be adequate to break up the view of
the new re•idence from surrounding properties. All landscaping
required f•r screening purposes or for erosion control must be
installed p for to final inspection. Outdoor lighting shall be
reviewed a d approved with the landscape plan.
3. A landscap maintenance deposit,equal to the cost of materials and
installation for all landscaping requied for screening purposes or
for erosion control, shall be posted Iprior to final inspection. An
inspection li f the landscape to ensure adequate establishment and
maintenan•e shall be made one year after the installation. Fifty
percent (50°0) of the bond shall be returned following the date of
the inspecti•n, if maintenance is adequate. The remainder will be
released tw• years after installation if the plantings remain viable.
4. No trees ar= shown to be removed. If any tree six inches in
diameter or larger is removed to accommodate construction or if a
tree is dam.ged or destroyed during construction,it will be
required to •e replaced. The replacement tree(s)shall be equal in
size to the r moved or damaged tree(s),as determined by the
Planning D'' ector. Removal of any trees requires prior approval
by the Tow ,and replacement trees may be required, depending on
the size and condition of the removed tree(s).
5. Prior to beg 'ng any grading operation or construction,the
significant • ees in the area of construction shall be fenced at the
dripline. e fencing shall be of a material and structure to clearly
delineate th• dripline. Town staff must inspect the fencing and the
trees to be fnced prior to issuance of any building permits. The fence
must remai throughout the course of construction. No storage of

equipment,vehicles or debris shall be allowed within the driplines
of these trees.
• 6. Skylights, if utilized, shall be designed and:constructed to reduce
emitted light. No lighting may be placed within the skylight wells.
7. Paint colors shall be chosen by the applicant and approved by staff
in conformance with the Town's adopted color board, and shall
exhibit a light reflectivity value of 50 or less. The roof, ifchanged,
shall have a light reflectivity value of 40 or less. White trim area
shall be minimized, particularly on large surfaces such as doors,
columns,railings and trellises. Color samples shall be submitted to
the Planning Department for approval prior to painting the exterior
of-the residence. All structures shall be painted in conformance
with the approved color(s) prior to final inspection.
8. Fire retardant roofing is requiredfor the additions.
9. At the time of foundation inspection for the additions and cabana,
and prior to final inspection for the pool and hardscape
improvements,the location of the additions,cabana,pool,stairs
and decking shall be certified in writing by a registered civil
engineer or licensed land surveyor as being in the approved
locations shown on the approved site development plan.
10. Any outdoor lighting requires approval by the Planning
Department prior to installation. -_Lighting specifications shall be
submitted for Planning Department approval prior to acceptance of
plans for building plan check,if such plans will indicate electrical
installation to support new lighting. Lighting shall be down
shielded,low wattage,and shall not encroach or reflect on adjacent
properties. The source of the lighting shall not be visible from off
the site. No lighting may be placed within setbacks except for two
driveway or entry lights. Consideration shall be given to replacing
the existing carriage style lights with"down light" fixtures.
B. ENGINEERING DEPARTMENT:
11. • Two copies of a grading and construction operation plan shall be
submitted by the property owner for review and approval by the
City Engineer and Planning Director prior to acceptance of plans for
building plan check. The grading/construction operation plan shall
address truck traffic issues regarding dust,noise,and vehicular and
pedestrian traffic safety on Elena Road and surrounding roadways;
storage of construction materials; placement of sanitary facilities;

parking fo construction vehicles; and parking for construction
personnel. No vehicles may be parked on the path along Elena
Road at an time. A debris box(trash dumpster) shall be placed on
• site for coll ction of construction debris. Arrangements must be
made with the Los Altos Garbage Company for the debris box,
since they ave a franchise with the Town and no other hauler is
allowed wi I ' the Town limits.
12. . The site dr.inage associated with the proposed development must
be design.d as surface flow .wherever possible to avoid
concentrati o n of runoff. The proposed drainage shall be designed
to maintain the existing flow patterns. The grading and drainage
shall be re i sed to show 4-inch to.12-inch jagged rip rap rocks in
place of the 3-inch cobblestones. for the dissipater. Final drainage
and gradin; shall be inspected by the lEngineering Department and
any deficie cies corrected to the satisfaction of the Engineering
Departmen'prior to final inspection.
13. Any, and a , changes to the approved grading and drainage plan
shall first b approved by the Town Engineering Department. No
grading sh.11 take place during the grading moratorium between
November and April 1.except with prior approval from the City
Engineer. I o grading shall take place within ten feet of any
property li e except to return the propertyto the natural grades
that were pi esent prior to the gradiiig on the site that was done
without a .ermit. All fill that was placed on the site without a
permit shal be removed and the grades returned to the natural
grades prio to final inspection.
14. An erosion .nd sediment controlplan shall be submitted for review
and approv:1 by the Engineering Department prior to acceptance of
plans for buil,ing plan check. The contractor and the property owner
shall comp y with all appropriate.requirements of the Town's
NPDES per it relative to grading and erosion/sediment control.
All areas o the site that have the Illative soil disturbed shall be
protected f sr erosion control during the rainy season and shall be
replanted p for to final inspection. .

16. The existing pathway along Elena Road shall be rehabilitated as
necessary to meet current Town standards for a type IIB pathway
prior to final approval of the project. The driveways shall be
roughened where the pathway intersects, to the satisfaction of the
City Engineer, prior to filial inspection. No plantings or irrigation
may be placed within fivefeet of the path.
17. The property owner shall inform the, Town of any damage and
shall repair any damage caused by the construction of the project to
pathways,private driveways, public and private roadways prior to
final inspection and release of occupancy permits and shall provide
the Town with photographs of the existing conditions of the
roadways and pathways prior to acceptance of plans for building plan
check.
18 Final approval of the septic system shall be obtained from the Santa
Clara County Health Department, and two stamped, signed plans
shall be submitted to the Town, prior to acceptance of plans for
building plan check.
19. Upon completion of the construction, a-final inspection shall be
required to be set with the Planning and Engineering Departments
two weeks prior to final building inspection approval.
CONDITION NUMBERS 10, 11, 14, 16, 17 AND 18 SHALL BE COMPLETED
AND SIGNED OFF BY THE- PLANNING DIRECTOR AND THE CITY
ENGINEER PRIOR TO ACCEPTANCE OF CONSTRUCTION PLANS FOR
PLAN CHECK BY THE BUILDING DEPARTMENT.
PROTECTIVE TREE FENCING' SHALL BE INSPECTED AND.APPROVED
BY THE PLANNING DEPARTMENT PRIOR TO ISSUANCE OF BUILDING
PERMITS.
Properties residingwithin the Los Altos School District boundaries must pay
School District fees.before receiving their building permit from Los Altos
Hills. The applicant must take a copy of Worksheet#2 to both the elementary
and high school district offices,pay the appropriate fees and provide the Town
with a copy of their receipts.
NOTE: The Site Development permit is valid for one year from the approval
date (until July 12, 1996). All required building permits must be obtained within
that year and work on items not requiring a building permit shall be commenced
within one year and completed within two years. .
