FROM: Suzanne Davis,Planner SD APPROVED BY: Curtis S.Williams,Panning Dire RECOMMENDATION That the Planning Commission: Approve the Site Development Permit for the landscape and lighting plan, subject to recommended conditions. BACKGROUND On December 14, 1994,the Planning Commission approved a Site Development Permit for a new residence and pool on the subject property. A condition of approval included the requirement that the landscape plan be reviewed by the Planning Commission instead of the Site;Development Committee. The condition states that replacement.trees shall be included for the trees removed during construction,and that drought tolerant and native plantings are recommended, as is standard for any project. There were not many trees on the property before the project began. A.Live Oak has been saved, and there are existing street trees on Finn Lane which provide some screening of the house from that side of the property. CODE REQUIREMENTS . Article 8 of the Site Development Ordinance establishes standards for landscape plans. The ordinance encourages the use of native plantings, and specifies that the amount of required planting is that which is needed to mitigate visual impacts, and to restore disturbed areas and control erosion. In regards to outdoor lighting,Article 10 specifies that the minimum wattage lights which will safely illuminate the area should be used. Left Devel. 13,588 13,067 12,590 +477 +521 Floor 5,772 5,769 5,769 -0- +3 General Elements The landscape plan shows ees, shrubs,vines and ground covers to be planted in all of the undeveloped ar as of the property. Ground covers (and some shrubs) are proposed in the right-of-way and to fill areas between planting groups. The perimeter tree include Redwoods,Liquidambar,Myoporum and Cedar; Plant sizes have not been specified. 'The required trees should be at least 15-gallon size The Enviro ental Design Committee commented that Myoporum a e not very ha dy and that Liquidambarrequire a lot of water;the applicant may want to substitute other species of tree . It is recommended that at least four of the Liquids bars be replaced by Live Oaks or other native evergreen trees (two along the Prospect Road frontage and on La Loma Drive). Depending upon other pla tings,Oaks may not be compatible since they do not require as much water as o er species. Environmental Design also commented that the grove of Redwoods proposed near the corner!of Prospect and Finn Lane is too crowde ;the trees she uld either be spaced further apart or fewer trees should be plated. Some a•ditional shrubs should be planted around the pool equipment enclosure so tha it is screened. U lity easements should be kept free and clear so that utility lines m y be accesse• for repair or maintenance. The plan shows 19 trees within the 10 foot public uti 'ty easement which runs along the three roadway frontages. These trees shou,d-be relocated and/or removed from the plan. It is acceptable to plant shrubs within the utility easement and the right-of-way,and Planning Commission July 26, 1995 Lands of Drumm Page 3 the ground covers are also allowed. Although no irrigation may be placed within the right-of-way,temporary drip would be allowed for the first year so that the plants can get established. The Pathway Committee recommends that no shrubs,trees or irrigation be placed within five feet of the path. The plan adheres to this requirement. Trees and shrubs are to be planted away from the path so that branches do not grow over the path and cause obstructions. Low growing ground covers,may be acceptable along side the path provided that they are maintained so that they don't grow into the path. There is a large lawn area proposed near.the pool. If some of the trees shown within the utility easement along La Loma Drive are relocated,the lawn configuration will need to be changed to provide enough space for the trees. Hardscape &Fencing A wood trellis will be constructed near the pool,and six pillars are proposed (two at the driveway,two at the end of the parking bay and two near the front entry of the house. In addition, a four and one-half foot high wrought iron fence is shown around the perimeter of the lot! The gates across the driveway (shown to be six feet high) may not exceed five and one-half feet since they will be only 10 feet back from the property line. Thereare also a number of paths, and some flagstone patio areas. Staff recommends that the flagstone area with decomposed granite in the middle (near the east property line)be relocated so that it does not encroach into the side setback. Collectively the flagstone "path"with a decomposed granite center form a developed patio-like area. This type of development should be at least 25 feet from the property line. Condition#1 requires that the patio be relocated out of the setback,or that the portion closer than 25 feet to the property line be eliminated. There is also a flagstone path within the front setback which is noted to be four feet wide, although it is shown on the plan to be eight to ten feet wide. The Code allows walkways and paths within setbacks. Lighting It appears that light fixtures are proposed on four of the.pillars. Three of the pillars will be within setback areas,but only two lights are allowed in setbacks. Condition number 1 requires conformance with this standard. Most of the proposed lighting is for paths and steps,,although some of the locations appear to be solely for the purpose of highlighting specific plantings. Generally uplighting is discouraged,unless it will be unobtrusive to neighbors and from the roads. Cut sheets have been provided showing.the proposed fixtures (Attachment 3). 'r-. _ • . .i �� .i+ -i• - In approving the landscape plan,the Commission should specify which trees and shrubs are required for ero-ion control and screeningJ The required landscaping will need a cash deposit to •nsure that it is planted and maintained. Other plantings ma},be done at applicant's•discretion. Staff recommends requiring perimeter treeas and shrubs,some trees close to the house,and since the entire lot has been graded,the group• covers in areas where trees or shrubs are not being planted. A coidition of approval is included specifying the required plantings. The Commission may change the list as determined to be appropriate. The landscape deposit amount will be determined by the estimated cost to purchase and plant the required tree ,shrubs and ground covers. Half of the deposit would be refunded one yea after the required landscaping is planted,provided that it established and is eing properly maintained The remainder of the deposit will b returned on year later if the required plantings remain viable. PLANNING DEPARTMENT: 1. The landscape plan shall be revised to conform with the following: a. -. The flagstone patio,must be a minimum of.25 feet from the side property line. b. All walkways or paths within setbacks must be four feet in width or less,and should be drawn to scale. c. Other than two Live;Oaks,no other trees may be planted within the rights-of-way. d. .The trees shown within the utility easement shall be relocated and/or deleted from the plan. ., e. Only two lights maybe placed within setbacks. f. The entry gates shall be a minimum of 15 feet from the front property line,or the height shall be reduce to five and one- half feet. Two copies of the revised plan shall be submitted to the Planning Department for approval,prior to acceptance of plans for building plan check. 2. The glass in the light fixtures on the entry pillars shall not be dear, and the light source may not be visible from off the site. Only two lights are allowed within setbacks. Any additional outdoor lighting,including lighting on the house,is required to be approved by the Planning Department,prior to installation. 3. The following trees and shrubs are required plantings and are to be planted in the locations shown on the approved landscape plan, dated 6/18/95: -- a. Four Redwoods near corner of Prospect Avenue&Finn Lane b. All Deodar Cedars c. A landscape maintenance deposit,equal to the cost of materials and installation r all landscaping required for screening purposes or for erosion control, shall be posted prior to final inspection. The required lanscaping shall be planted prior to final inspection. An inspection o the landscape to ensure adequate establishment and maintenanc shall be made one year,after the installation. Fifty percent (50°/) of the bond shall be returned following the date of the inspectio , if maintenance is adequate. The remainder will be released two years after installation if-the plantings remain viable. B. ENGINEERING DEPARTMENT: 5. Any, and all, changes to the existing grading and drainage shall first be approved by the Town Engineering Department. No grading shal_ take place during the grading moratorium between November 1 and April 1 except with prior approval from the City Engineer. No grading shall take place within ten feet of any property line. 6. Any, and all areas on the project sitle that have had the native material dist rbed shall be protected for erosion control during the rainy season nd shall be replanted prior to final project inspection 7. Any, and all damage to the pathway; along La Loma Drive and Prospect Ave ue shall be repaired prior to final inspection. 8. Trees. are not permitted to,be planted in the 10 foot wide public utility easements. r 12. The existing drainage swales located on this property shall be' maintained as shown on the approved grading and drainage plan. Any, and all, changes to the approved grading and drainage plan shall first be approved by the Town. 13. Upon completion of the construction,a final inspectionshall be required to be set with the Town Planner and the City Engineer two weeks prior to final building inspection approval. - CONDITION NUMBERS 1 AND 2 SHALL BE COMPLETED AND SIGNED OFF BY THE. PLANNING DEPARTMENT PRIOR TO ACCEPTANCE OF CONSTRUCTION PLANS FOR PLAN CHECK BY THE BUILDING DEPARTMENT. NOTE: The Site Development permit is valid for one year from the approval date (until July 26, 1996). All required building permits must be obtained within that year and work on items not requiring a building permit shall be commenced within one year and completed within two years. Commissioner Gottlieb aske• if the pool equipment p9d was factored into the MFA. Ms. Nil noted that it was not and should be shown on development area. Lot Unit Factors under one .cre and aerial surveys were discussed. Chairman Schreiner asked who would .e putting in the street trees since it was a condition of the subdivision. Mr. Pete son thought there were already street trees planted. Commissioner McMahon q estioned the maximum height of the residence as listed on page ?,paragraph of the staff report,the.statement in the third paragraph regarding the ad itional (parking) space outweighing the impact of allowing a small amount of avement within the setback,and the third paragraph on page three reg rding the pathway being required to be shown on the final gradi g and draina e plan. OPENED PUBLIC TESTIM NY Gary Kohlsaat,501 N. Santa ruz Avenue,Los Gatos,architect, complimented Bob Owen for aking this 1 t buildable and for carrying out the rough grading operations. . Kohlsaat no ed a few significant changes made,primarily raising the finished floor of the hou e 18 inches and on one end,brought up three feet. This significantly reduced th- amount of grading,the amount of cut and fits better with the contours. He noted that they would need approximately 20 square feet for the pool equi p ment which will be part off the MDA,not the MFA. The extra parking space is v._ry important to the applicant as the street is very . narrow and if they do not pr.vide two parking spaces someone will park on the street which w uld create a .roblem. They have split the entrance of the driveway betw en the entry :nd the garage. The location of the garage was a predetermined site because •f the constraints of the lot. Planning Commission Minutes Approved 1/11/95 December 14, 1994 Page 8 Commissioner Gottlieb asked if the parking space could be moved a little closer to the house to bring it out of the setbacks perhaps by rotating it., Mr. Kohlsaat noted that they have about 15 feet between the parking space and the house which they intend to landscape. Mr. Kohlsaat noted that the parking space was arranged for ease and safety from a vehicular standpoint. He discussed their initial proposal,siting the house with a finished floor elevation(the main part of the house) at 560.0 and the entrance was 118 inches below that with the garage at 561,in the same location. They are limited by the contour line. They have raised the house up,leaving the ridge where it is,lowering the pitch of the roof in order__ to reduce grading. The west end has been raised another three steps which takes them to 563,working with the contours. The roof pitch is 61/2:12. Pam Swartz,24941 Prospect,neighbor to the north,commented that the drainage concerns have been addressed. The junction box at the corner of Prospect and Finn Lane does not show on the site plan indicating drainage flows down onto their property. She would like this shown correctly. She liked the house, however she had two concerns: the roof lope (35 feet above the level of the road) which will block any visual quality she has from her lot and the need for street trees to be planted to soften the look. Jean McCandless,neighbor at the intersection of Prospect Avenue,La Lorna Drive and Edgecliff Place, also felt the roof would be prominent compared to the other portion of the house which is almost equal in height.to the house itself. She concurred with Mrs. Swartz in that there is a need for planting of tall trees. CLOSED PUBLIC TESTIMONY Commissioner McMahon proposed a lesser pitch than 61/2 :12 perhaps 6:12 or 5 1/2:12 would be even better. She felt the roof materials were fine. Because of the overall size of the house on this highly exposed corner,she would like some way to reduce the roof slope,lowering the wall height and lowering the pad. She was happy with the reduction in grading,hoping that they have not gone too far, in the other direction. Commissioner Stutz agreed with the request to reduce the roof pitch,although she would not want them to reduce their nine foot walls inside the house. She did not have any problem with the plan,however she wouldogree with lowering the pad even though it would increase the export. Commissioner McMahon suggested using some of the export on site for some low berming of a foot to give the appearance of a much lower house. Commissioner Gottlieb agreed with the lowering of the pad. She liked the design as shown and requested a condition noting no formal stairs leading down to the street as this is a highly visible house. RE-OPENS PUBLIC US I ONY Gary Kohlstaat noted som- confusion as the Commission previously requested less grading. He felt chap;,' g the roof pitch from 6 1/2 to 6 was acceptable. He agreed with the darker col•r roof, and having the landscape plan return to the Commission for approval. He noted that they can lower the roof pitch and if they grade ore, they hav- to redo the entire grading plan. Commissioner Stutz suggested a.Model of the •roject,however Mr. Kohlsaat felt this was not in his budget. The Commission •iscussed ways of lowering the front of the house noting that almost any ho se that is put on this lot would be very visible. Mr. Kohlstaat indicated that a at roof would not be desirable and they could bring the two elem nts in the fr• t down. Chairman Sc einer asked the Commission if they wanted to give the applicant direction so a can work ith staff or do they want the project to return. Ms. Niles noted for clarificatio ,that the Commission would like the applicant to reduce the height from the 21 feet to something less than 21 feet in height. She also noted that if they look-d at the project from the corner of Prospect and Finn Lane, the finished floor of he house is at 560. If the louse is only 21 feet then you see the knoll rising be 'nd the house because it is at 575. Mr. Kohlstaat noted that if they lower th pad,they will have more grading,asking if this is what the Commission is re uesting. The Commission would like a little reduction in roof slope an pad,not damaging the integrity of the design but getting away from the bul on the highly exposed corner of the property. Commissioner Gottlieb w Id like the roof line down half a foot to afoot. Mr. Kohlstaat would be very h ppy to work with Ms. Niles to accomplish these goals. Commissioner Stut noted that the applicant has come back twice at their direction, doing what they have asked him to do. The Commissioners liked the driveway deign. Jean Struthers, 13690 Robl da Road, discussed shadowing, suggesting bringing the eaves don on the stru ture which would give a little more shade on the walls, giving an impressio of a lower home. The Commission appreciated this suggestion. .
