DISCUSSION The applicants have requested a lot line adjustment between the two subject properties for the stated purpose of including within the lot on West Sunset Drive 1.01 acre of land which relates topographically more to that lot than to the Robleda Road property. The relevant ldt sizes and allowable development area for each lot,before and after adjustment, are listed below: Parcel A Parcel B (W. Sunset) (Robleda Road) Lot Area Before Adjustment 3.28 acres 13.04 acres Lot Area After Adjustment 4.29 acies 12.03 acres LUF Before Adjustment 2.38 8.76 LUF After Adjustment 3.26 7.98 MDA Before Adjustment 24,280 sf 81,140 sf MDA After Adjustment 35,210 sf 72,720 sf Planning Commission: October 25, 1995 LLA: Nicholson/Bieber Page 2 Code Requirements Review authority for lot line adjustments is outlined in Section 66412(d) of the State's Subdivision Map Act, which states that: "A local agency shall limit its review and approval to a determination of whether or not the parcels resulting from the lot line adjusment will conform to local zoning and building ordinances. A local agency shall not impose conditions or exactions on its approval of a lot line adjustment except to conform to local zoning and building ordinances..." The Town's Codes do not address lot line adjustments, but the standard Town process includes a public hearing before the Planning Commission, and Council consideration as a New Business item. After approval, the lot line adjustment is effectuated by the recordation of the grant deed and a certificate of compliance. Analysis Parcel A currently includes two single-story residences, a small studio, and a workshop on the site. Floor area figures were not provided, but staff calculations indicate that existing floor area is well below the current allowable (MFA), and notes that the lot is being increased in size. No non-conforming setbacks would be created by the lot line adjustment, and in fact the existing non- conforming workshop (5 feet from property line) would now be located over 100 feet from the neighboring lot. Parcel B is currently comprised of a modest 1-story residence and a pool, with a long driveway from Robleda Road. Given its size, even after the adjustment, the existing floor area readily complies with the allowable (MFA). No existing setbacks on this parcel would be affected by the lot line adjustment. All existing easements on both parcels will remain intact. CONCLUSION The proposed loth line adjustment will result in lots which remain consistent with the Town's Zoning Code, and other zoning, site development and building requirements would be applied to any future development. Upon approval, the applicant must submit to the Town a copy of the signed and notarized grant deed, with a plat as prepared by a registered civil engineer or licensed surveyor, and the Town will prepare certificates of compliance for recordation.
