BACKGROUND &CODE REQUIREMENTS The subject property is located on the northwesterly corner of Clausen Court and Voorhees Drive. The property was created as part of a six lot subdivision that was approved by the Town in 1989. A site development permit for a new residence and pool was approved by the Planning Commission,on April 12,1995. The residence is presently under construction. Section 10-2.301 of the Site Development Ordinance specifies that structures which will cover more than 3000 square feet of development area but not more than 20,000 square feet shall be reviewed by the Site Development Committee. Sport courts are typically reviewed by the Site Development Committee,but are sometimes referred to the Commission if there are unusual circumstances such as large quantities of grading, excessive retaining walls,etc. This application was originally advertised for the October 31, 1995,Site Development Committee meeting. However,two Planning Commissioners expressed concern about the project, and the application was readvertised for this Planning Commission agenda. Left Devel. 16,574 16,130 9,102 +7,028 +444 Floor 6,850 -0- 6,255 -0- +595 Planning Commission November 8, 1995 Lands of Jabbour Page 2 DISCUSSION Architecture &Site The applicants are requesting approval of a Site Development Permit for a 5,399 square foot tennis court. The decking around the previously approved swimming pool has been scaled down so that there will be some development area remaining for future improvements on the property. The pool is shown as proposed development area on worksheet#2 since the area it will cover is being reduced and construction has not been started. All other hardscape shown on the plans, including the driveway and patios, was approved with the new residence. Trees Two 10-inch Eucalyptus trees will be removed for the project. There are also three heritage oaks on the property. The tennis court has been placed at an angle so that it is as far from the driplines of the trees as possible. Planting to provide mitigation screening of the tennis court will be considered when the landscape plan for the new residence is submitted for review. Grading& Drainage The Engineering Department has reviewed the plan and has recommended conditions of approval, as specified in Attachment 1. Grading quantities include 245 cubic yards of cut and 260 cubic yards of fill. A final drainage plan will be required to be submitted to the Engineering Department prior to acceptance of plans for building permit plan check. The drainage from the front deck will be connected directly to the existing storm drain catch basin in Clausen Court. This will help protect the existing pathway. Final grading and drainage will be reviewed by the Engineering Department, and any deficiencies will be required to be corrected,prior to final inspection. Other Comments No written comments were received from the Environmental Design & Protection Committee. The Pathways Committee request at the time the residence was approved was that the existing Type JIB path along Voorhees Drive and Clausen Court be rehabilitated as necessary. This requirement was already included with the conditions of approval for the new residence, but has also been included with this application so that the tennis court permit may be finalled independently of the residence. PLANNING DEPARTMENT: 1. Any changes or modifications to the approved plans shall be approved by the Planning Director or the Planning Commission, depending on the scope of the changes. 2. Tennis court fencing shall not exceed ten feet in height, and shall be black,brown or green. 3. The color of the tennis court shall be reviewed and approved by the Planning Department to make sure that it is appropriate for the site. 4. Protective tree l fencing shall be maintained around the three heritage oaks during grading and construction of the tennis court. B. ENGINEERING DEPARTMENT: 5. The site drainage associated with the proposed development must be, designed aas surface flow wherever possible to avoid concentration of the runoff. Any new proposed drainage shall be designed to maintain the existing flow patterns. A drainage plan for the proposed tennis court shall be submitted for review by the Engineering Department prior to submittal of plans for building plan check. The drainage plan shall also show the drainage for the front deck to connect directly to the existing storm drain catch basin located in Clausen Court in order to protect the existing pathway. The final grading and drainage shall be inspected by the Engineering Department and any necessary corrections shall be made prior to final project inspection. 6. Any, and all, ch I nges to the approved grading and drainage shall first be approved by the Town Engineering Department. No grading shall take place during the grading moratorium between November 1 and April 1 except with prior approval from the City Engineer. No grading shall take place within ten feet of any property line. Planning Commission November 8, 1995 Lands of Jabbour Page 5 7. Any, and all, areas on the project site that have the native material disturbed shall be protected for erosion control during the rainy season and shall be replanted prior to final inspection. 8. The existing type IIB pathway along Clausen Court and Voorhees Drive shall be rehabilitated as necessary. Any required work shall be done to the satisfaction of the Engineering Department prior to final inspection. Upon completion of construction,a final inspection shall be set with the Planning Department and Engineering Department at least two weeks prior to final inspection. CONDITION NUMBER 5 SHALL BE COMPLETED AND SIGNED OFF BY THE PLANNING DIRECTOR AND THE CITY ENGINEER PRIOR TO ACCEPTANCE OF CONSTRUCTION PLANS FOR PLAN CHECK BY THE BUILDING DEPARTMENT. ALL OTHER CONDITIONS MUST BE SATISFIED PRIOR TO FINAL INSPECTION. NOTE: The Site Development permit is valid for one year from the approval date (until November 8, 1996). All required building permits must be obtained within that year and work on items not requiring a building permit shall be commenced within one year and completed within two years.
