HomeMy WebLinkAbout396 -A tr ORDINANCE NO. 396 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS ADDING ARTICLE 3 (TERM LIMITS) TO CHAPTER 1 (CITY COUNCIL) TO TITLE 2 (ADMINISTRATION) OF THE LOS ALTOS HILLS MUNICIPAL CODE- REGARDING CITY COUNCIL TERM LIMITS WHEREAS, the City Council recognizes that some of the Town' s citizens have expressed an interest in placing limits on the number of consecutive terms that a City Councilmember may serve; and WHEREAS, any proposal to limit the number of terms a member of the City Council may serve on the City Council, shall apply prospectively only and shall not become operative unless it is submitted to the electors of the city at a regularly scheduled election and a majority of the votes cast on the question favor .the adoption of the proposal. NOW THEREFORE, the, people of the Town of Los Altos Hills do ORDAIN as follows : 1. Addition to Code. Article 3 (Term Limits) is hereby added to Chapter 1 (City Council) of Title 2 (Administration) of the Los Altos Hills Municipal Code to read as follows: CHAPTER 1. CITY COUNCIL Article 3 . Term Limits Sec. 2-1.301. Purpose. The purpose of this Chapter is to set term limits on the number of consecutive terms a City Councilmember may serve. Sec. 2-1.302 . Term Limits. No person shall be allowed to serve more than two (2) consecutive terms on the Los Altos Hills City Council . Notwithstanding the above, at any municipal election after the expiration of two years following the two (2) consecutive terms, such person may again seek election or appointment to the City Council . Sec. 2-1.303 . Partial Term For the purposes of .applying this Article, a person who serves over half of a City Council term, whether elected or appointed, shall be deemed to have served that entire term. 1 3\1ah\ord\e1ec.ord Sec. 2-1.304. Effective Date. In accordance with Election Code Section 9217, the Ordinance codified in this Chapter became effective on December 12 , 1998, which was ten (10) days after the City Council declared the result of the election at which the majority of the ..voters favored the adoption of the ordinance. 2 . Severability. If any part of this ordinance, is held to be invalid or inapplicable to any situation by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance or the applicability of this Ordinance to other situations .
