ORDINANCE NO. 425 ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS AMENDING SECTION 10-1.208 (BASEMENT) OF ARTICLE 2 (DEFINITIONS) OF CHAPTER 1 (ZONING) OF TITLE 10 (ZONING AND SITE DEVELOPMENT) OF THE LOS ALTOS HILLS MUNICIPAL CODE WHEREAS, the Town wishes to clarify the ordinance with regard to the basement definition. NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows: 1. AMENDMENT OF CODE. Section 10-1.208 (Basement) of Article 2 (Definitions) of Chapter 1 (Zoning) of Title 10 (Zoning and Site Development) of the Los Altos Hills Municipal Code is hereby amended to read as follows: Section 10-1.208 "Basement" shall mean a floor level, or portions thereof, which is (1) directly under a building; and (2) with its entire height (vertical distance measured from bottom of the basement slab to the ceiling above) below the adjoining natural or finished grade, whichever is lower; and (3) with at least 3 sides, or at least 75% of its perimeter length wholly underground. That side of the basement not wholly underground shall not be located on any side of a lot abutting one side of a road. Basements, including cellars and bunkers, which are not located within the footprint of the building above, may be permitted by the Planning Commission when it finds that such structures do not encroach in setbacks, are a minimum of 18 inches below natural grade, are wholly underground except for required exiting, lighting and ventilation and are counted as development area except when placed under a surface already counted as development area. 2. ENVIRONMENTAL REVIEW. This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15307, Actions by Regulatory Agencies for Protection of Natural Resources. 3. EFFECTIVE DATE; POSTING. This ordinance shall become effective thirty (30) days from the date of its passage, and shall be posted within the Town of Los Altos Hills in three (3) public places. 1
