ORDINANCE NO. 425 <br /> ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS <br /> AMENDING SECTION 10-1.208 (BASEMENT) OF ARTICLE 2 (DEFINITIONS) OF <br /> CHAPTER 1 (ZONING) OF TITLE 10 (ZONING AND SITE DEVELOPMENT) OF THE <br /> LOS ALTOS HILLS MUNICIPAL CODE <br /> WHEREAS, the Town wishes to clarify the ordinance with regard to the <br /> basement definition. <br /> NOW, THEREFORE, the City Council of the Town of Los Altos Hills does <br /> ORDAIN as follows: <br /> 1. AMENDMENT OF CODE. Section 10-1.208 (Basement) of Article 2 <br /> (Definitions) of Chapter 1 (Zoning) of Title 10 (Zoning and Site Development) of the Los <br /> Altos Hills Municipal Code is hereby amended to read as follows: <br /> Section 10-1.208 <br /> "Basement" shall mean a floor level, or portions thereof, which is <br /> (1) directly under a building; and <br /> (2) with its entire height (vertical distance measured from bottom of the <br /> basement slab to the ceiling above) below the adjoining natural or <br /> finished grade, whichever is lower; and <br /> (3) with at least 3 sides, or at least 75% of its perimeter length wholly <br /> underground. <br /> That side of the basement not wholly underground shall not be located on <br /> any side of a lot abutting one side of a road. Basements, including cellars <br /> and bunkers, which are not located within the footprint of the building <br /> above, may be permitted by the Planning Commission when it finds that <br /> such structures do not encroach in setbacks, are a minimum of 18 inches <br /> below natural grade, are wholly underground except for required exiting, <br /> lighting and ventilation and are counted as development area except when <br /> placed under a surface already counted as development area. <br /> 2. ENVIRONMENTAL REVIEW. This project is categorically exempt from the <br /> California Environmental Quality Act (CEQA) pursuant to Section 15307, Actions by <br /> Regulatory Agencies for Protection of Natural Resources. <br /> 3. EFFECTIVE DATE; POSTING. This ordinance shall become effective <br /> thirty (30) days from the date of its passage, and shall be posted within the Town of Los <br /> Altos Hills in three (3) public places. <br /> 1 <br />
