HomeMy WebLinkAbout336 ORDINANCE NO. 336 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS AMENDING CHAPTER 3 OF TITLE 6 OF THE LOS ALTOS HILLS MUNICIPAL CODE BY ADDING PROVISIONS REGARDING UNIVERSAL GARBAGE SERVICE, UNLESS EXEMPTED BY THE CITY MANAGER, AND UNIVERSAL RECYCLING SERVICE WHEREAS, the Town is under the strict mandate of AB 989 to reduce its entire waste stream 25% by 1995 and 50% by 2000; and WHEREAS, the Town, along with all Bay Area municipalities, needs to do its part to conserve landfill space, avoid groundwater contamination, and avoid non-point discharge containing contamination that may originate in creeks; and WHEREAS, universal garbage service and universal recycling service benefit every individual by benefiting the entire community; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows: SECTION 1. AMENDMENT OF CODE. Chapter 3, "Garbage, Refuse, Swill, and Waste Matter, " of Title 6, entitled "Sanitation and Health, " of the Los Altos Hills Municipal Code is hereby amended by changing the title to "Garbage, Refuse, Swill, Waste Matter, and Recyclables. " SECTION 2. AMENDMENT OF CODE. Section 6-3 . 01 entitled "Definitions" of Chapter 3, "Garbage, Refuse, Swill, Waste Matter, and Recyclables" of Title 6 entitled "Sanitation and Health" of the Los Altos Hills Municipal Code is hereby amended by adding Section (f) as follows: (f) "Recyclables" shall mean and include all materials which are rejected, abandoned, or discarded by the owner or producer thereof which are capable of being recycled by the authorized scavenger. Recyc- lables shall include, but not be limited to, paper, bottles, cans, plastic and cardboard. SECTION 3. AMENDMENT OF CODE. Section 6-3 .02 "Receptacles" of Chapter 3, "Garbage, Refuse, Swill, Water Matter, and 1 Recyclables" of Title 6 entitled "Sanitation and Health" of the Los Altos Hills Municipal Code is hereby amended as follows: Except as otherwise set forth in Section 6-3. 03 of this Chapter, all garbage, refuse, swill, and waste matter shall, by the person upon whose premises the same shall have been produced or accumulated, be placed in a watertight, galvanized metal or plastic container of not less than ten (10) nor more than thirty (30) gallons net capacity, of a design approved by the Health Officer or other person designated by the Council, which container shall be kept clean and continuously closed by a tight-fitting, galvanized metal or plastic cover, except when garbage, refuse, swill or waste matter is being dumped within or removed therefrom, and which shall be proofed against the access of flies and rodents. The contents of such containers shall be delivered not less than once a week to the scavenger authorized by the Town to collect such contents in accordance with the provisions of this Chapter; provided, however, that a household or other occupancy may be exempted from mandatory garbage collection by the City Manager if the occupant demon- strates in writing how garbage and other wastes are disposed of in ways that are equal to or better than the authorized scavenger collection. All recyclables shall, by the person upon whose premises the recyclables shall have been produced or accumulated, be placed in a box or other container. The contents of such containers shall be delivered not less than every other week, on the same day as the delivery of the garbage container, to the scavenger authorized by the Town to collect such recyclables in accordance with the provisions of this Chapter. SECTION 4. AMENDMENT OF CODE. Section 6-3 . 04 "Collection: Time, Manner, Vehicles" of Chapter 3, "Garbage, Refuse, Swill, Water Matter, and Recyclables" of Title 6 entitled "Sanitation and Health" of the Los Altos Hills Municipal Code is hereby amended as follows: Collection of garbage, refuse, swill, and waste matter shall be made at every household or other occu- pancy at least once a week; provided, however, that a household or other occupancy may be exempted from mandatory garbage collection by the City Manager if the occupant demonstrates in writing how garbage and other wastes are disposed of in ways that are equal to or better than the authorized scavenger collection. Collection of recyclables shall be made at every household or other occupancy at least bi-weekly, on the same day as the collection of garbage. The contents of all containers shall be transferred by the scavenger 2 into a vehicle provided by the scavenger and approved by the Health Officer or other designated official, as being a satisfactory vehicle for such purpose. The scavenger shall avoid spilling any of the .contents of the containers on stairs, yards, streets, and alley- ways. SECTION 5. SEVERABILITY. If any part of this ordinance is held to be invalid or inapplicable to any situation by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or the applicability of this ordinance to other situations. • 1 SECTION 6. EFFECTIVE DATE; POSTING. This ordinance shall become effective thirty (30) days from the date of its passage, and shall be posted within the Town of Los Altos Hills in three (3) public places.
