HomeMy WebLinkAbout337 ORDINANCE NO. 337 AN -URGENCY ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS EXPANDING THE CRITERIA FOR WHEN CONDITIONAL DEVELOPMENT PERMITS ARE NECESSARY WHEREAS, due to the difficulty of accommodating development on substandard lots which have a Lot Unit Factor of .50 or less, a conditional development permit is required; and WHEREAS, development is also difficult to accommodate on lots with a human habitation setback; and WHEREAS, these additional restraints also merit special consideration through the conditional development permit process; and WHEREAS, the City intends to consider the appropriateness of the conditional development permit process for lots with these additional restraints; and WHEREAS, until this consideration is completed and the zoning ordinance amended, processing of lots so constrained without a conditional development permit would conflict with the City's contemplated amendment to the Zoning Code; and WHEREAS, the City Council has determined for these reasons that the development of such lots without a conditional development permit represents a current and immediate threat to the public health, safety and welfare; and WHEREAS, this ordinance is adopted pursuant to Government Code Section 65858 (a) allowing the adoption of such urgency ordinances by a four-fifths vote of its legislative .body; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows: SECTION 1. AMENDMENT OF CODE. Section 10-1.1107 (3) entitled "Conditional Development Permits: Approval; Condition" of Chapter 1, "Zoning" of Title 10, "Zoning and Site Development" of the Los Altos Hills Municipal Code is hereby amended by amending subsection (a) to read as follows: (a) Due to the difficulty of accommodating development on substandard lots which meet the objectives and standards of the Town, any lot which has a Lot Unit Factor of .50 or less shall require a conditional development permit from the Planning Commission or other Council-designated authority. In addition, at the discretion of the Zoning Administrator, any lot significantly constrained by a human habitation setback or non-human habitation zone shall require a conditional development permit from the Planning Commission or other Council-designated authority. SECTION 2. EFFECTIVE DATE. This ordinance shall be effective immediately upon passage and shall be of no further force and effect after forty-five (45) days of the date of its adoption, unless extended by the City Council for ten (10) months and fifteen (15) days pursuant to Government Code Section 65858 (a) , unless sooner repealed by the City Council. SECTION 3. REPORT. At least ten (10) days prior to the expiration of this interim ordinance, the City Council shall issue a written report pursuant to Government Code § 65858 (d) describing the measures it has taken to alleviate the conditions which led to the adoption of this ordinance.
