HomeMy WebLinkAbout339 t J ORDINANCE NO. 339 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS AMENDING TITLE 10 (ZONING AND SITE DEVELOPMENT) TO ELIMINATE THE REQUIREMENT THAT PROPERTY OWNERS PROVIDE ADDRESSES OF ADJACENT PROPERTY OWNERS AND TO ADD THE APPEAL OF CERTAIN DECISIONS BY A PLANNING COMMISSIONER OR A COUNCILMEMBER WITHOUT A FEE WHEREAS, the Town has concluded that it is more expeditious for City staff .to obtain the names and addresses of property owners adjacent to property which is the subject of a development application; and WHEREAS, the Town wishes to allow certain decisions- to be appealed by a member of the Planning Commission or the City Council without payment of a fee; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows: SECTION 1. . AMENDMENT OF CODE. Article 11 (Appeals, Variances, Conditional Use Permits, Conditional Development Permits, and Amendments) of Chapter 1 (Zoning) of Title 10 (Zoning and Site Development) of the Los Altos Hills Municipal Code is hereby amended by repealing Section 10-1. 1101(d) . SECTION 2. AMENDMENT OF CODE. Article 11 (Appeals, Variances, Conditional Use Permits, Conditional Development Permits and Amendments) of Chapter 1 (Zoning) of Title 10 (Zoning and Site Development) of the Los Altos Hills Municipal Code is hereby amended by amending Section 10-1. 1102 to read as follows: Section 10-1. 1102 Appeals from decisions of administrative officials. Any party aggrieved by- the decision of an administrative official in the administration or enforcement of the provisions of this Chapter relative to variances and other matters may appeal such decision to the Planning Commission. Any member of the Council or any two members of the Planning Commission.may file such an appeal without the payment of a fee. All appeals shall be in accordance with the provisions of Section 10-1. 1101 and subject to public hearing by the appropriate body pursuant to the provisions of Section 10-1. 1105 of this article: All actions by the Planning Commission shall be in accordance with the provisions of Section 10-1. 1106 of this article. 1 SECTION 3. AMENDMENT OF CODE. Article 11 (Appeals, Variances, . Conditional Use Permits, Conditional Development Permits, and Amendments) of Chapter 1 (Zoning) of Title 10 (Zoning and Site Development) of the Los Altos Hills Municipal Code is hereby amended by amending Section 10-1. 1109 to read as follows: Section 10-1. 1109 Appeals from decisions of the planning commission and staff committee. Any party aggrieved by a decision of the Planning Commission may appeal such decision to the Council within ten (10) days of the decision by filing a written appeal. Any member of the Council may file such an appeal without the payment of a fee. Any party aggrieved by a decision of the Staff Committee with regard to variances may appeal such decision to the Planning Commission within ten (10) days of the decision by filing a written appeal. Any. member of the Council or any two members of the Planning Commission may file such an appeal without the payment of a fee. All appeals shall be in accordance with the provisions of Section 10-.1. 1101 of this article. The Council or Planning Commission shall hold a public hearing pursuant to notification as required by the provisions of Section 10-1. 1105 of this article. SECTION 4. AMENDMENT OF CODE. Article 13 (Administration and Enforcement) of Chapter 2 (Site Development) of Title 10 (Zoning and Site Development) of the Los Altos Hills Municipal Code is hereby amended by amending Section 10-2. 1313 to read as follows: Section 10-2 . 1313 Appeals. Any person aggrieved by a determination of the Zoning Administrator or Site Development Committee may appeal such determination to the Planning Commission by filing a written notice of appeal with the Zoning Administrator within ten (10) days of the Zoning Administrator or Site Development Committee's decision. Any member of the Council or any two members of the Planning Commission may file such an appeal without the payment of a fee. Any person aggrieved by a determination of the Planning Commission may appeal such determination to the City Council by filing a written notice of appeal with the City Manager within ten (10) days of the Planning Commissions's decision. Any member of the Council may file such an appeal without payment of a fee. A nonrefundable filing fee and a deposit for services as adopted by resolution of the City Council shall accompany each notice of appeal, except as noted above. The City Manager shall put the matter on the agenda for a hearing at the next regularly .scheduled City Council meeting. 2 IIS J _ 00 SECTION S. SEVERABILITY. If any part of this ordinance is held to be invalid or in- applicable to any situation by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or the applicability of this ordinance to other situations. SECTION 6. EFFECTIVE DATE; POSTING. This ordinance shall become effective thirty (30) days from the date of its passage, and shall be posted within the Town of Los Altos Hills in three (3) public places.
