ORDINANCE NO. 343 AN ORDINANCE OF THE TOWN OF LOS ALTOS HILLS AMENDING TITLE 9 OF THE LOS ALTOS HILLS MUNICIPAL CODE BY ADDING A SECTION REGARDING MODIFICATION OF FINAL MAPS WHEREAS, Government Code Section 66472 . 1 authorizes a City to allow modification of a final map or a parcel map by a certificate of correction or an amending map, if local ordinance so authorizes, under certain circumstances; and WHEREAS, the City Council of the Town of Los Altos Hills wishes to adopt an enabling ordinance in order to allow the Council to consider a requested modification of a final map or parcel map; NOW, THEREFORE, the �City Council of the Town of Los Altos Hills does ORDAIN as follows: SECTION 1. AMENDMENT OF CODE. Article 12 (Final Map including Parcel Map) of Chapter 1 (Subdivisions) of Title 9 (Subdivisions and Plan Lines). of the Los Altos Hills Municipal Code is hereby amended by adding Section 9-1. 1210 to read as follows: Section 9-1. 1210 Amendment of Final Maty. In addition to the corrective amendments authorized by Government Code Section 66469, after a final map or parcel map is approved by the City Council, such a final map may be modified by a certificate of correction or an amending map, if the City Council finds that there are changes in circumstances which make any or all of the conditions of such a map no longer appropriate or necessary and that the modifications do not impose any additional burden on the present fee owner of the property, and if the modifications do not alter any right, title, or interest in the real property reflected on the recorded map and if the City Council finds that the map, as modified, conforms to the provisions of Government Code Section 66474. Any such proposed modification shall be set for public hearing before the Planning Commission and the City Council in accordance with the procedures set out for approval of tentative maps. The Planning Commission and the City Council shall confine their hearings to consideration of an action on the proposed modification. SECTION 2. EFFECTIVE DATE; POSTING. This ordinance shall become effective thirty (30) days from the date of its passage, and shall be posted within the Town of Los Altos Hills in three (3) public places.
