AN ORDINANCE OF
THE TOWN OF LOS ALTOS HILLS
AMENDING CHAPTER 1 (ZONING) OF
TITLE 10 (ZONING AND SITE DEVELOPMENT) TO
CLARIFY ARTICLE 4 (Nonconforming
Uses and Structures)
WHEREAS, the Town of Los Altos Hills currently allows
nonconforming uses and structures to remain under certain
circumstances; and
WHEREAS, the Town wishes to clarify that a nonconforming
structure or use may be maintained or rebuilt only if the
structure was legal when built or when the use was first
commenced;
NOW, THEREFORE, the City Council of the Town of Los Altos
Hills does ORDAIN as follows:
SECTION 1. AMENDMENT OF CODE. Section 10-1.401
(Nonconforming Structures) of the Los Altos Hills Municipal Code
is hereby amended to read as follows:
10-1.401. Nonconforming Structures. The
provisions of this Chapter shall not prevent the
reconstruction, repairing or rebuilding of any
legal nonconforming structure, so long as the
reconstruction, repair or rebuilding does not
result in an increase in the non-conformity or
change of use that existed prior to the damage or
reconstruction.
SECTION 2. AMENDMENT OF CODE. Section 10-1.405
(Nonconforming Uses: Repair to Damages) of the Los Altos Hills
Municipal Code is hereby amended to read as follows:
10-1.405. Nonconforming Uses: Continuation. The
provisions of this chapter shall not prevent the
reconstruction, repairing, rebuilding, and
continued use of any structure occupied by a legal
nonconforming use when damaged by fire, collapse,
explosion or Act of God occurring on or after
December 4, 1961, wherein the expense of such work
does not exceed fifty percent (50%) of the
appraised value, for tax purposes, of the
structure at the time such damage occurred.

SECTION 3 . AMENDMENT OF CODE. Section 10-1.406
(Nonconforming Uses: Maintenance) of the Los Altos Hills
Municipal Code is hereby amended to read as follows:
10-1.406. Nonconforming Uses: Maintenance. Such
repairs and maintenance as are required to keep it
in sound condition may be made to a structure
occupied by a legal nonconforming use; provided,
however, no structural alterations nor change of
use shall be made except as required by law or
ordinance or authorized by the Planning Commission
by a conditional use permit.
The total structural repairs and alterations
which may be made to a structure pursuant to the
provisions of this section shall not, during its
life subsequent to the date of its use becoming
nonconforming, exceed fifty percent (50%) of its
then appraised value, for tax purposes, unless
such use is changed to a conforming status.
SECTION 4. ENVIRONMENTAL REVIEW. • The City Council of the
Town of Los Altos Hills finds that this ordinance is not a
project under the California Environmental Quality Act.
SECTION 5. EFFECTIVE DATE: POSTING. This ordinance shall
become effective thirty (30) days from the date of its passage,
and shall be posted within the Town' of Los Altos Hills in three
(3) public places.
