ORDINANCE NO. 347
AN URGENCY INTERIM ORDINANCE OF
THE CITY COUNCIL OF
THE TOWN OF LOS ALTOS HILLS
AMENDING CHAPTER 2 (SITE DEVELOPMENT) OF
TITLE 10 (ZONING AND SITE DEVELOPMENT)
WITH REGARD TO SITE DEVELOPMENT REVIEW OF RESIDENCES
WHEREAS, Government Code Section 65858 allows a city,
without following the procedures otherwise required prior to the
adoption of a zoning ordinance, to adopt, as an urgency measure,
an interim ordinance prohibiting any uses which may be in
conflict with a zoning proposal which the legislative body is
considering; and
WHEREAS, Los Altos Hills Municipal Code Section
10-2 .301(b) (1) requires a site development permit for the
construction of a principal or secondary residence; and
WHEREAS, the City Council interprets this section broadly to
mean that any primary or secondary dwelling use requires a site
development permit; and
WHEREAS, the City Council has adopted an ordinance to amend
the Municipal Code to clarify that a site development permit is
needed for the construction of a principal or secondary residence
or the commencement of a principal or secondary dwelling use in
an existing structure; and
WHEREAS, before such ordinance take effect, the City
Council, in order to prevent uses in conflict with such ordinance
and in order to protect the public health, safety, and welfare,
adopts this urgency ordinance so that no dwelling uses may be
commenced without a site development permit;
NOW, THEREFORE, the City Council of the Town of Los Altos
hills does ORDAIN as follows:
Section 1. Interim Ordinance. Section 10-2.301(b) (1) of
Chapter 2 (Site Development) of Title 10 (Zoning and Site
Development) of the Los Altos Hills Municipal Code is hereby
amended, during the term of this interim urgency ordinance, to
read as follows:
11 (1) The construction of a principal or secondary
residence or the commencement of a principal or
secondary dwelling use in an existing structure. "
Section 2 . Findipgs. The City Council finds that there is
a current and immediate threat to public health, safety and
welfare if primary or secondary dwelling uses are allowed to be
commenced in existing structures, without site development
permits. The site development procedure in Los Altos Hills

Municipal Code, Title 10, Chapter 2 sets out standards to
preserve the natural scenic character of the Town, protecting the
natural amenities and providing for the safety, benefit and
welfare of its citizens by establishing minimum standards and
requirements relating to, among other things, drainage and•.
erosion control, planting of landscaping, installation of
driveways, implementation and maintenance of the Master Path
Plan, outdoor lighting and color and materials. The City Council
finds that it is essential that these standards be applied not
only to new structures but also to the commencement of dwelling
uses in existing structures in order that all dwellings within
the Town are given the same scrutiny, so their impacts on
adjoining properties are minimal and so that they are compatible
with the natural scenic character of the Town.
Section 3 . Term. This ordinance shall be effective
immediately and shall apply to all structures that have not yet
received building permits and all uses that have not yet
commenced. This ordinance shall remain in effect for only forty-
five (45) days from the date of its adoption, unless extended
pursuant to Government Code Section 65858.
Section 4. Report. At least ten days prior to expiration
of this interim ordinance, the City Council shall issue a written
report pursuant to Government Code Section 65858 (d) describing
the measures it has taken to alleviate the conditions which have
lead to the adoption of this ordinance.
This ordinance was passed and adopted at a regula meeting
of the City Council of the Town of Los Altos Hills on ItM2�
1991 on a four-fifths vote of the Council as follows:
