HomeMy WebLinkAbout21-06 RESOLUTION NO. 21-_0.6 RESOLUTION OF THE TOWN OF LOS ALTOS HILLS APPROVING AND AUTHORIZING EXECUTION OF AMENDMENT NO. 1 TO THE SANITARY SEWER REIMBURSEMENT AGREEMENT BETWEEN THE TOWN OF LOS ALTOS HILLS AND JAYARAM BHAT AND VANI BHAT WHEREAS, the City Council of the Town of Los Altos Hills has read and considered that certain Amendment No. 1 to the Sanitary Sewer Reimbursement Agreement ("Amendment") between the Town and Jayaram Bhat and Vani Bhat; NOW, THEREFORE, the City Council of the Town does RESOLVE as follows: 1. Public interest and convenience require the Town of Los Altos Hills to enter into the Amendment described above; and 2. The Town of Los Altos Hills hereby approves the Amendment and the Mayor is hereby authorized on behalf of the Town to execute the Amendment between the Town of Los Altos Hills and Jayaram Bhat and Vani Bhat. By: or ATTE' : ' City Clerk • AMENDMENT NO. 1 TO SANITARY SEWER REIMBURSEMENT AGREEMENT THIS AMENDMENT NO. 1 is made and entered into effective March 23, 2006 as an amendment to the Sanitary Sewer Reimbursement Agreement dated October 6, 2005 ("Agreement"), by and between the Town of Los Altos Hills ("Town") and Jayaram Bhat and Vani Bhat ("Property Owner"). RECITALS A. The Town and Property Owner entered into the Agreement to set forth the terms and conditions by which the Property Owner may be reimbursed by future users of a sanitary sewer extension commonly known as the Sewer Main Extension at Altamont Road near Taaffe Road ("Sanitary Sewer Extension") for some of the costs associated with the Sanitary Sewer Extension. B. The lands which may be served by the Sanitary Sewer Extension at a future date ("Future Users") are specifically set forth in Exhibit B as set forth in the Agreement. C. The Town and Property Owner now desire to amend the Agreement with Exhibit B-1 in order to remove two Future Users from the list, add two Future Users to the list and revise the usage fee. AGREEMENT NOW, THEREFORE, in consideration of their mutual covenants, Town and Property Owner do hereby agree as follows: Exhibit B to the Agreement is hereby deleted and replaced with Exhibit B-1 attached hereto.
