Chairman Ann Duwe called the meeting to order at 7:00 PM B. Members/Associates present: Alisa Bredo, Weegie Caughlan, Nick Dunckel, Ann Duwe, Eileen Gibbons, Vic Hesterman, Bridget Morgan, Sue Welch, Denise Williams Members/Associates absent: Rachelle Mirkin (Member); Bob Stutz (Associate) Council Liaison present: John Radford Members of public present: Jeff Peterson (Stirling Top Elegant Investment, LLC subdivision) Susan Cretekos (PWC Applicant) Kjell Karlsson (LAH Finance Committee) Two others (did not sign in) C. Approval of Agenda. Agenda was approved after amending at Council Liaison’s request to include comments prior to new business. EG moved, SW seconded and the vote was unanimously in favor (AB, WC, ND, AD, EG, VH, BM, SW, DW). D. Approval of Minutes. The minutes from the PWC meetings of October 24, 2016 were approved with one minor amendment. EG moved, WC seconded, and the vote was 8 in favor (AB, WC, ND, AD, EG, VH, BM, SW); one abstaining (DW, not present at that meeting). E. Ex Parte Communications. None reported. 2. COUNCIL LIAISON’S COMMENTS Council Liaison John Radford thanked EG for her eight years of service on the PWC and also thanked WC, ND, and AD for their service on the committee in case they are not reappointed to additional terms. 3. NEW BUSINESS A. Properties for Review. The following properties were reviewed for pathway recommendations: i. 27333 Ursula Lane (Lands of Azad; APN 182-19-065). The reason for another PWC review is developers’ request to remove the path. The parcel has frontage on Ursula and Edgerton and the address changed from 27555 Edgerton to 27300 Ursula to 27333 Ursula. Developer was not present. PWC first reviewed this property in 2008, with a recommendation to dedicate an off-road pathway easement and construct a native path connecting Ursula to Edgerton in a location at the discretion of the developer. The path through this parcel is on the approved 2005 Master Path Plan map and will provide an important connection between Westwind Barn, Byrne Preserve and the scenic Stegner path, which starts just across Edgerton from this parcel. There are no roadside paths along most of Edgerton, so pedestrians and equestrians must walk in the road to access the Stegner path. There is an existing native path along the S and E borders of the property used by equestrians prior to the start of construction. There is also a 30’ pathway easement along the E side of Ursula Lane that would connect this path to paths on Black Mountain. The easiest route (shown on the approved 2005 MPP map) through the parcel is along the S and E border, where there is an existing native path (in use prior to start of construction) and where the terrain is much less steep than the along NW border. Developers are placing the house close to the S border, so a path in this location would pass relatively close behind the house. The developers chose an alternative route along the NW border, which is much steeper and has a deep incised drainage swale; they dedicated a pathway easement near the NW border in 2014 (CR 63-14; 07/10/14; Attachment A). Both the Planning Commission and Council reviewed the project in 2009 and confirmed that a native path is to be built as a condition of development and noted that PWC and Town Staff should determine location of the path. Developers requested another PWC review on 6/27/16 because they do not want to construct a path through the parcel (PWC minute excerpt Attachment B). At that meeting, PWC re-confirmed the recommendation for a native path and recommended the lower part be adjusted to follow the contour lines of the hill through the open space easement on the lower part of the parcel and enter Edgerton FINAL_PWC_Minutes16-1128.docx 2 Road across from the entrance to the Stegner path. The developers have requested another PWC review tonight to ask for removal of the path. PWC discussed the relative difficulties and costs of constructing a native path in the steep location chosen by the developer (near NW border) compared to in the location of the existing native path (S and E border). A path on the S and E sides would be close to the back of the house, but would be significantly cheaper to build and follows much easier terrain. The developer chose the steeper, more difficult location. After lengthy discussion, AD moved PWC reject the developers’ request to remove the pathway from 27333 Ursula Lane and reaffirm the previous PWC recommendation of June 27, 2016 to retain the off-road native path through the parcel and to move the lower section of the easement and build a native path following the contour lines of the hill through the conservation easement and to enter Edgerton Road near the border between 27333 Ursula and 27525 Edgerton Road. The purpose of this path is to connect Ursula to Edgerton Road and the Stegner Path. If steps are used, they must be horse-friendly (i.e., wide and shallow). Upon further discussion the PWC strongly favors locating the pathway in its original location along the southern and western borders of the property as shown on the 2005 Master Path Plan map. DW seconded and the vote was 8 in favor (AB, WC, ND, AD, EG, VH, BM, DW) with 1 recusing for proximity (SW). ii. 12815 Deer Creek Lane (Lands of Chan; APN 175-43-047). The reason for PWC review is a 2-lot subdivision. AD reported that staff informed her that an in-lieu fee was paid for the lot at the time of earlier subdivision. Thus, per the Pathways Element and Municipal Code, no additional pathway in- lieu fee is required. The PWC noted that an in-lieu fee has been paid for this property. A roadside path has already been built on the property across the street, but may be damaged and need to be restored after construction on this property is finished. WC moved that the PWC recommend the Town require the developer of 12815 Deer Creek Lane to restore the path across the street after construction is completed if it is damaged due to construction on this parcel. BM seconded and the vote was unanimously in favor (AB, WC, ND, AD, EG, VH, BM, SW, DW). B. No parking on pathways. Parking on pathways continues to be a problem and the Sheriff can only issue tickets where “No Parking” signs are posted. AD spoke to City Manager, Carl Cahill who suggested PWC draft an addition to Municipal code 4.3.1004 (No parking areas---Designation). AD distributed a draft, assembled from Saratoga, Portola Valley, and Woodside ordinances (Attachment C). PWC suggested adding to the list of prohibited obstructions, ”7. Boulders, rocks, and tree stumps” and moving the language currently under section 7 to a new section 8. The goal of this document would be to educate homeowners and others not to park on paths and to avoid posting “No Parking” signs up all over town. EG moved the PWC forward the document with proposed additions to Town Staff. AB seconded, and the motion passed unanimously (AB, WC, ND, AD, EG, VH, BM, SW, DW). C. Maintenance and enforcement issues. PWC discussed a recent request from a resident to improve the roadside path on La Barranca to increase safety for equestrians (path is currently paved with asphalt and in poor repair). This is an important connection across 280 and is frequently used by equestrians. It was suggested to add an upgrade of the full length of the La Barranca path to CIP list. ND will discuss issue with Town Staff. D. Staff response to PWC decision forms. Staff is now providing information to PWC Chair about final outcomes (e.g., Conditions of Approval) of PWC recommendations for properties under development. After some discussion it was decided that PWC would look into filing these feedback forms from staff as supplements to the original PWC minutes that noted the PWC recommendation. 4. OLD BUSINESS A. Report from Master Path Plan Map (MPP) Update Subcommittee. There will be a joint meeting with Planning Commission and City Council in January to review the MPP map. B. CIP projects and budget update. The town has contracted to remove some trees along the Bob Stutz path. C. Stirling (Top Elegant Investment, LLC) Subdivision. PWC Chair made a few clarifications with regard to developers’ presentation at the October PWC meeting. • Suggestion that Planning Commission wanted PWC to revote was inaccurate. The property was added to the PWC agenda at developer’s request. FINAL_PWC_Minutes16-1128.docx 3 • Developers’ statement that all neighbors were against having the pathway on the eastern border is not correct. Chair AD spoke with two of the four impacted property owners, who said they are supportive of the 30’ buffer zone and pathway. • Developers’ statement that the Town allows a maximum 10% slope for native off-road paths is not accurate. Although in the past the goal was not to exceed 15%, grades of up to 20% are allowable, and some segments of the Taaffe path were as high as 25%. Allowing higher slope would allow for fewer switchbacks. Developers’ Project Engineer, Jeff Peterson, was in attendance and provided a staff letter stating, “The maximum sustained trail slope should generally less than 10% and should not exceed 15% slope for more than 50 feet long.” (Attachment D). Peterson said the developers would be happy with fewer switchbacks and provided a revised map with slope at 15%, and reiterated that the developers would be willing to let the PWC review the staked path prior to build. PWC will get clarification from Town Staff regarding the slope requirements for pathways. • Developers provided an updated map and described the 15’ zone along the eastern property line as a new open space easement. However, open space easements do not allow fencing and the developer suggested that future homeowners would be allowed to fence in the zone. D. Pathways Q&A and Dispatches from the Chair on the Town Website. PWC discussed adding information for residents about the pathways system to the Town web site. PWC discussed whether or not residents would use this site. EG moved that PWC consult Deborah Padovan about adding links to the Pathways Element and FAQs to the “Helpful Documents” on the Pathway Committee web page. AD seconded. The vote was 6 in favor (AB, ND, AD, EG, VH, SW) and 3 opposed (WC, BM, DW). 4. REPORTS FROM OTHER MEETINGS. A. City Council Meeting. At the Oct 20, 2016 City Council meeting, Council denied by a 4:0 vote the request to remove the off-road path on the Waller property (connecting Elena and Robleda). There were also 15 applicants for upcoming vacancies on the PWC. Council will appoint members in December. The suggestion that anyone in the audience who wanted to be a VTA member should volunteer through the Town did not take into account the requirement that the VTA liaison also be on the PWC. Ann will send a note to the mayor re: solicitation of volunteers for VTA, noting that this is the responsibility of the PWC per charter, and request delay of appointments until after the next PWC meeting. 5. PRESENTATIONS FROM THE FLOOR. A. PWC December Hiatus. Chair AD suggested that, given no pressing business, PWC not meet in December and hold the next meeting in January. SW moved the PWC not meet in December. DW seconded and the vote was unanimously in favor (AB, WC, ND, AD, EG, VH, BM, SW, DW), 6. NEXT SCHEDULED MEETINGS. SW recused herself for proximity, left the table, and did not participate in discussion or vote. The parcel has frontage on both Ursula and Edgerton and the address changed from 27555 Edgerton to 27300 Ursula to 27333 Ursula. The owner was not present. PWC reviewed this property in Aug 2008, Mar 2009, and April 2009. AD read excerpts from minutes (below). Because the developers wanted to site the house at the top of the parcel close to the south border, the location proposed in the 2005 MPP along south and east borders would be very close to the house. Instead of requiring this, PWC recommended in 2009 a path connecting Ursula to Edgerton in a location at the discretion of the developer. This path will provide an important connection for equestrians and hikers from Byrne Preserve and the Westwind Barn via Ursula to Edgerton Road and the Stegner scenic off-road path. The developers opted to locate the path near the steeper west and north borders, rather near than the less steep south and east borders. Dedication of a pathway easement was required as a condition of development (CR 63-14; 07/10/14; Attachment A). The developers requested PWC re-review tonight because they do not want to construct a path. PWC discussed the earlier recommendations and the proposed route. PWC reiterated the need for the owner to dedicate a pathway easement and build a native path connecting Ursula Lane with Edgerton. The diagram supplied by the owner shows the path running along the boundary between 27300 Ursula and 27333. The PWC re-affirmed the 2009 recommendation that the path should follow the contour lines of the conservation easement near the bottom of the property. The path should cross the property so as to connect with Edgerton directly across from the Wallace Stegner (Matadero Creek) Path. If the path runs along the contour lines on the lower part of the property within the easement, rather than straight down to Edgerton, it will be less steep, easier to build and maintain and will exit onto Edgerton across from the entrance to the Stegner path. If steps are needed on steep sections, the stairs should be broad, shallow, and horse-friendly. ND moved that the PWC recommend that the Town require the developers of 327333 Ursula Lane to move the lower section of the easement and build a native path following the contour lines of the hill through the conservation easement and to enter Edgerton Road near the border between 27333 Ursula and 27525 Edgerton Road. The purpose of this path is to connect Ursula to Edgerton Road and the Stegner Path. If steps are used, they must be horse-friendly (i.e., wide and shallow). DW seconded and the vote was in 6 favor (AB, JB, AD, ND, EG, DW); 2 opposed (WC, BM); and 1 abstaining (SW for proximity). These are often modified based on site conditions, nonetheless it should provide some useful information. lncluded in the document are some references that would be of use. lt has been my experience that most trail construction crew require oversight by somebody with experience in trail design. Though trail seem simple inexperienced contractors often avoid or mihimize drain dips which leads to poor trail drainage and in time trail degradation.
