Unanimous approval. APPROVAL OF MINUTES 1. Feb. 9, 2004 Meeting with 2 corrections: Councilmen Warshawsky and O’Malley were not present for the entire meeting (were there for a good portion); Item 3b: clarified the definition of road-side paths to include constructed or native paths parallel or adjacent to roads, either public or private, and on-road easements with no IIB path; there was no intention to exclude road-side native paths. Unanimous approval. 2. March 15, 2004 Meeting not available for review. CV asked NG to resend them. 3. March 22, 2004 Meeting with 1 correction: re-title as ‘Minutes’ instead of ‘Agenda.’ Unanimous approval. 4. April 12, 2004 Meeting with 1 correction: Quadrant C2, item 1 Approved (4-2-1). Unanimous approval. COMMUNICATIONS: • PRESENTATIONS from the floor on any subject related to pathways. Malek A… of Altamont Rd: started with a remodel about 3 years ago; at final inspection found that a 5 ft path 5 ft from the road was required on Altamont; he would like the requirement removed; the paths along Altamont were on the Byrne Preserve side. Discussion: Altamont is a 2-sided path street (NE), because of high traffic volume and safety needs (NE, CV). There is a long term vision of paths in the town, decided by Town Council (CV); over time the gaps in path sections will be completed (NE). Decision: that the path be constructed as required. • PROCESS of Public Hearings and timeline for completion of Master Pathway Plan. Council requested the PW Committee accelerate completion of the Pathway Master Plan Update. We will discuss a plan to increase the number of meetings, set a schedule for the public hearings, and set a plan for completing the process before October. Discussion: in order to have the 1st phase of the MPP finished before summer holidays, more and/or longer meetings will be needed. CV met with Eric Clow and Carl Cahill; would like to set 3 back-to-back dates the week of June 21, 2004 for Public hearings. The Town was divided into 3 sections using El Monte Rd. and 280. Section 1: east of 280, above El Monte; Section 2: western portion; Section 3: southern portion. One section would be done per night. Dave Ross will have the map online; there will be copies available at Town Hall. Maps will be sent to residents of ‘Zones’ where changes/additions have been made. Action: There are 2 extra special MPP meetings scheduled for both May and June. The regular Pathway meetings emphasis will be on the MPP; non-essential items to be eliminated. CV will arrange for dinner and send email reminders a week before. Updated maps should be available Thursday following our updates. • MEETING SCHEDULE for May and June, locations to be finalized: Monday, May 3 at 6:00 pm – Special MPP meeting Monday, May 10 at 6:00 pm – Special MPP meeting Saturday, May 22 at 8:30 am – pathway inspection walk Monday, May 24 at 6:00 pm – regular pathway meeting Monday, June 7 at 6:00 pm – Special MPP meeting Monday, June 14 at 6:00 pm – Special MPP meeting Week of June 21, 3 night meetings with Planning Commission (? Tues., Wed., Thurs.) Saturday, June 26 at 8:30 am – pathway inspection walk Monday, June 28 at 6:00 pm – regular MPP meeting REPORTS FROM COMMITTEES AND COUNCILMEMBERS. 1. Master Pathway Map Ad-hoc Committee update. They are trying to error on the side of omission; they welcome new information from outsiders, but will need to see documentation before changes occur (Carol G.) 2. Council Meeting and Planning Commission Meeting reports. Not done. 3. County S1 Trail update (Cassam, not present). Not done. NEW BUSINESS: • Recommendation on properties: 1. 27230 Elena Road (Lands of Bradford, secondary unit addition). Motion: collect in lieu fee. Approved (6-0-1). 2. 26800 Fremont Road (Pinewood School, permit modification) – (see below) • Review of easement request, Pinewood school. The Committee will review its previous recommendation to request an easement at Pinewood school, as part of the development process. Discussion: Pinewood School is hoping to resurface its playing field(s) with an artificial surface. They are up against a construction deadline; if they cannot get the project started, they will have to sod the field and this easement issue will no longer exist. Scott Riches, President of Pinewood School, and past LAH town resident, is caught between what LAH is requiring (a path easement over the PUE) and the PAUSD, the property owner, which refuses to grant it. Pinewood has had 2 legal documents drawn up: a ‘Conditional Use Permit’ and a ‘License’ authorizing path use. They have a sure 9-year lease with PAUSD with a possible 10-year extension. CV has talked with Carl Cahill about a Proscriptive Easement being gone after. NG thought that action might legally be required to be pursued by individuals, not the Town, and requiring private funding. Carol G: School District decisions may be through Sacramento and not be under the jurisdiction of Palo Alto. Concern: if go for the Proscriptive Easement and fail, may then lose use of the path. Motion: the Pathway Committee approves of a ‘License’ authorizing path use, or a ‘Conditional Use Permit’ for pathway use in lieu of a pathway easement, provided such an agreement is legally acceptable to our Town Attorney. Approved (6-1). Motion: In addition, we ask the Town Attorney to investigate the requirements of attaining a Proscriptive Easement. Unanimous approval. • Capital Projects. Not done. Update the Committee on the status of capital improvement projects. UNFINISHED BUSINESS. • Impact fee. Discussion of adjustment to impact fee rates. CIP balance: (9 Feb 04 balance: $506,767); Construction balance: (9 Feb 04 balance: $317,739) COMMUNITY EVENT SUPPORT: Earth day at Westwind Barn April 24th. Not discussed. Approved (6-0-1) 3 roads in ‘Y’ shape above Moody Ct. on southwestern side of Byrne Preserve Motion: add 3 private roads to light green. Unanimous approval.
