Minutes for the Special Meeting August 31, 2016 – Stirling Property

In attendance: Wai Lee Wong, Nancy Couperus, Rajiv Patel, Ed Smith, John Harpoothian,
Council Liaison & guest Ann Duwe, Pathways
The meeting was called to order at 3:45 p.m.
The Committee reviewed the Wilsey Ham answers to the comments that the Environmental
Design & Protection Committee had made on the Mitigated Negative Declaration and
agreed that the Committee should respond to the Wilsey Ham’s Comments on each of their
comments as follows:
Original ED&PC Comment # 1: Recommend preservation of the oaks on lot #1 through
inclusion of an open space easement.
Rebuttal to Wilsey Ham Comments
Even though the Heritage Oaks are protected by the Town, this is a significant grove at the
entrance to the subdivision and needs further protection. It will set the tone of the
subdivision and will serve as a warning to a future owner on limited development of the lot.
Open Spaces easement have been place over groves in other subdivisions.
Original ED&P Comment #2: A previous road alignment shown on the preliminary map is
preferred as it would save more trees.
Rebuttal to Wilsey Ham Comments
Shifting the road toward lots 7 & 8 would limit the number of Oaks that would have to be
removed and would increase the size of lots 2, 3, & 4 to accommodate the 30 foot Open
Space Easement requested to run along back sides of Lots 1, 2, 3, & 4. The Open Space
Easement would served as a buffer between the subdivision and its neighbors It would also
serve as the Wildlife corridors keeping the wildlife off the paved road and let them migrate
out toward Natoma where they can cross safely. It would fulfill the request of the Pathway
Committee for a pathway along the back of Lots 1, 2, 3, & 4. Also if it should become a
private road as rumored, then a pathway easement would be needed for the either length of
Charles Avenue. Also a maintenance agreement for the road should be part of the
conditions.
Comment #3: Fencing along the eastern boundary of lots 1 through 4 will divert wildlife
and there should be a wildlife corridor in this area.
Rebuttal to Wilsey Ham Comments
For reason mentioned in Comment # 2, fencing would restrict the flow of wildlife, because
if the Wildlife it diverted to a Charles Avenue crossing it is dangerous for both wildlife and
for the cars. This is a matter of common knowledge. The tenancy, today, is to fence the
entire property boundaries; therefore restricting the movement of wildlife through the area
to other area.
Noted that Simon Lane residence have requested view corridors through the site.
Rebuttal to Wilsey Ham Comment
The 30 foot setback on the sidelines may create a 60 foot structure setback but not address
the landscaping. Trees and shrubs can obliterate views within a year of two. Keeping a 10
foot view corridor (there is already 10 foot grading restriction) would help solve this
problem or each lot conditioned to provide a partial view corridor.
Comment #5: Changes should be made for lot 7 to preserve oaks #82, # 83, & 85, all which
are in good conditions.
Rebuttal to Wilsey Ham Comments
After much discussion the committee recommends that lots 6 & 7 be combined due to the
geotactic hazards and placement of bioretention area which requires a retaining wall and
thus. would allow for the oaks trees to be saved.
The meeting was adjourned at 5:00 p.m.
