HomeMy WebLinkAbout56-20RESOLUTION 56-20 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS MAKING DETERMINATIONS AND APPROVING THE ANNEXATION OF TERRITORY DESIGNATED AS "RAVENSBURY AVENUE ISLAND" CONSISTING OF EIGHT PARCELS (24.3 ACRES) LOCATED AT THE END OF RAVENSBURY AVENUE IN LOS ALTOS HILLS WHEREAS, California Government Code section 56375.3 permits municipalities to annex unincorporated "urban islands" through a streamlined process that does not require protest proceedings or elections, provided the island meets special criteria under section 56375.3 and is 150 acres or less in size; and WHEREAS, in Santa Clara County, unincorporated land that is located within a municipality's urban service area is considered an "urban island"; and WHEREAS, to serve the goals of orderly growth and development, policies of the Local Agency Formation Commission of Santa Clara County (LAFCO) encourages municipalities to annex unincorporated urban islands existing within their current Urban Service Areas (USA) where services and facilities are being provided; and WHEREAS, Government Code sections 56375.3 and 56700 et seq., and LAFCO policies set forth the streamlined island annexation process, which includes the requirement that a municipality conduct a public hearing to initiate island annexation proceedings and a subsequent public hearing to approve said annexation; and WHEREAS, as provided in Government Code Sections 56375.3 and 56757, the City Council of the Town of Los Altos Hills is the conducting authority for a reorganization including an annexation to the Town; and WHEREAS, the City Council of the Town of Los Altos Hills ("Town") desires to annex properties within an unincorporated "urban island" commonly known as the Ravensbury Avenue Island ("Island"), the area boundaries of which are described more particularly in Exhibit "A" and shown on Exhibit `B" to this resolution, attached hereto and incorporated herein; and WHEREAS, the Island includes eight properties, identified by Assessor Parcel Numbers (APN) 351-08-005, 351-08-018, 351-08-019, 351-08-026, 351-08-028, 351-08-030, 351-08-031, and 351-08-032, and road rights-of-way totaling 24.3 acres in size and located on the southern side of Los Altos Hills, all as described in Exhibit "A" and shown on Exhibit `B", and is contiguous to the Town's incorporated areas and is within the Town's USA; and WHEREAS, the annexation would provide for the properties within the Island to use Town services; and WHEREAS, seven of the properties within the Island, identified by APNs 351-08-005, 351-08- 018, 351-08-019, 351-08-028, 351-08-030, 351-08-031, and 351-08-032, will be designated as Resolution 56-20 Page 1 "Residential" land uses on the Town's General Plan Land Use Diagram and zoned R -A (Residential Agriculture) on the Town's Zoning Map; and WHEREAS, the eighth property within the Island, identified by APN 351-08-026, is owned by the Midpeninsula Regional Open Space District (MROSD), an independent special district organized under California Public Resources Code Section 5500 et seq., and consists of dedicated open space land that is part of and contiguous to MROSD's existing `Rancho San Antonio Open Space Preserve' property; this eighth property will be designated as an "Open Space Preserve" land use on the Town's General Plan Land Use Diagram and zoned O -S -R (Open Space Reserve) on the Town's Zoning Map; and WHEREAS, portions of three parcels (APNs 351-08-030, 351-08-005, and 351-08-019) within the Island include existing and long-standing public trail uses, recognized in an easement appurtenant to land owned by MROSD and reserved in that certain Deed recorded October 19, 1959 in Book 4577, page 735 of the Official Records of Santa Clara County; and WHEREAS, the Town of Los Altos Hills acknowledges the public trail uses on the parcels within the island annexation area and the value of public trail uses on and appurtenant to MROSD lands which provide valuable open space access for the public; and WHEREAS, consistent with the requirements of the LAFCO island annexation process, the Town held a public hearing on June 18, 2020, pursuant to a notice of public hearing published at least 21 days prior to the hearing, to initiate island annexation by resolution; and WHEREAS, the date of the second public hearing to make findings and approve annexation of the Ravensbury Avenue Island was scheduled for July 16, 2020; and WHEREAS, on June 18, 2020, the City Council held a public hearing and adopted Resolution No. 29-20 initiating proceedings for annexation of the unincorporated county island designated as the "Ravensbury Avenue Island" ("Island); and WHEREAS, the Town of Los Altos Hills has conducted a public hearing on the reorganization in accordance with Section 57050 of the California Government Code; and WHEREAS, in accordance with Government Code Section 56153, 56156 and Section 56157, the City Cleric of the Town of Los Altos Hills have provided mailed notices of the public hearing on the annexation to all property owners within the Island and all property owners within 500 feet of the Island; and WHEREAS, the Town of Los Altos Hills, as Lead Agency for environmental review for the reorganization, has determined the proposed island annexation is categorically exempt from the provision of the California Environmental Quality Act per CEQA Guidelines Section 15319(a) because it involves the annexation of an area containing existing private structures that are developed to the density allowed by the Town's General Plan (14 Cal. Code. Regs. § 15319). Resolution 56-20 Page 2 NOW, THEREFORE, BE IT RESOLVED, as follows: A. That the City Council of the Town of Los Altos Hills finds that the Island meets the criteria for a streamlined annexation process pursuant to Government Code Section 56375.3 as follows: I. The Island does not exceed 150 acres in area, and is substantially surrounded by the Town of Los Altos Hills and is located within the urban service of the Town; 2. The Island is not a gated community, is substantially developed in that public utility services are available and physical improvements are located on the properties within the Island; 3. The Island is not considered prime agricultural land; 4. The annexation does not create islands or areas in which it would be difficult to provide municipal services; 5. The Island will benefit from the annexation or is receiving benefits from the Town; 6. The annexation is consistent with the Town of Los Altos Hills General Plan; 7. The Island is contiguous to existing Town limits; and 8. The Town has complied with all conditions imposed by the LAFCO for inclusion of the Island in the urban service area of the city. B. That the City Council of the Town of Los Altos Hills hereby approves the annexation of the territory designated as the "Ravensbury Avenue Island" described more particularly in Exhibit "A" and shown on Exhibit `B" to this resolution, attached hereto and incorporated herein, into the Town of Los Altos Hills and that upon completion of the annexation proceedings, the area will be taxed on the regular county assessment roll.
