AGENDA REVIEW The City Council directed that Agenda Item 6.E be moved to a future City Council meeting. City Attorney Steve Mattas stated that there was no reportable action from the closed session. 2 City Clerk Regular City Council Meeting February 15, 2018 Mayor Radford reported that a special goal setting City Council meeting is scheduled for Friday, February 23, 2018 from 9:00 a.m. to 4:00 p.m. and all are welcome to attend. 2. PRESENTATIONS AND APPOINTMENTS A. Presentation by Seth Miller, Regional Public Affairs Manager with the Peninsula Division of the League of CA Cities – this item was not considered and will be continued to a future City Council meeting. B. Appointment to the Los Altos Hills Community Relations Committee City Clerk Deborah Padovan presented the application of Dennis Duffy. Dennis Duffy, Los Altos Hills introduced himself to the City Council and expressed his interest on serving on the Community Relations Committee. MOTION MADE AND SECONDED: Councilmember Corrigan, moved to appoint Dennis Duffy to the Los Altos Hills Community Relations Committee for a four-year term. The motion was seconded by Councilmember Waldeck. Appointment to the Los Altos Hills Open Space Committee City Clerk Deborah Padovan presented the application of Virginia Weiss. Virginia Weiss, Los Altos Hills introduced herself to the City Council. Council discussion ensued. The Council requested that all individuals who would like to be appointed to a committee, first attend a committee meeting. This item was continued to a future date after Ms. Weiss attends an Open Space Committee meeting. D. Appointment to the Los Altos Hills Environmental Design and Protection Committee 3 City Clerk Regular City Council Meeting February 15, 2018 City Clerk Padovan presented the application of Brigitta Indaco. Brigitta Indaco, Los Altos Hills introduced herself to the City Council. MOTION MADE AND SECONDED: Mayor Radford moved to appoint Brigitta Indaco to the Environmental Design and Protection Committee for a four-year term. The motion was seconded by Councilmember Wu. Reappointment to the Los Altos Hills Finance and Investment Committee City Clerk Padovan presented the application of Bill Silver. MOTION MADE AND SECONDED: Councilmember Corrigan moved to reappoint Bill Silver to the Finance and Investment Committee for a third, four-year term. The motion was seconded by Councilmember Waldeck. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subject not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a Resolution previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. 4 City Clerk Regular City Council Meeting February 15, 2018 Eileen Gibbons, Los Altos Hills, reiterated that we have an outstanding pathway map update that has been delayed for two years. She asked the Council, "please don't forget about it and please move it forward." Roy Woolsey, Los Altos Hills, spoke about construction issues in town. Cheryl Matthews, Los Altos Hills, asked to stop the project next door to her on Hilltop Drive due to what she described as toxic materials. Staff responded to Ms. Matthews’ concerns. Council discussion ensued. The Council requested that staff communicate to the fire department about the issues with the house. It was requested that staff report back to the Council to confirm protocols are being followed, safety measures are taken and notification is appropriately given in cases of demolition with hazardous materials. 4. CONSENT CALENDAR MOTION MADE AND SECONDED: Councilmember Corrigan moved to approve the CONSENT CALENDAR with the exception of item #4.E. The motion was seconded by Mayor Pro Tem Spreen. Avila) Mayor Radford announced that the City Attorney recommended the Council entertain public comment on this item. Mayor Radford opened the Public Hearing. Seeing no wishing to speak, he then closed the Public Hearing. MOTION MADE AND SECONDED: Councilmember Corrigan moved to approve the requested time extension of the site development permit for a detached garage and variance for a reduced side yard setback (new expiration date: January 5, 2019). The motion was seconded by Councilmember Waldeck. MOTION MADE AND SECONDED: Councilmember Waldeck moved to appoint Councilmember Wu to the VTA Northwest Cities (Group 2) as an VTA alternate board member. The motion was seconded by Mayor Radford. Proposed Traffic Calming Measure to Reduce Cut-Through Traffic (Staff: A. Chen) Director Chen presented the report. Council discussion ensued. K.W. Tsai, Los Altos Hills, said that speed is a big problem on Purissima Road during the rush hour. Further Council discussion occurred. The Council directed that the new, proposed regulations be placed on Nextdoor to warn residents, as well as sending a townwide postcard informing residents of the new traffic calming measures. Santa Clara County Sheriff Captain Rich Urena responded to questions from the City Council regarding enforcement. The Council further directed that staff have a very formal method for residents to provide feedback. MOTION MADE AND SECONDED: Mayor Radford moved that we use the Purissima to Robleda to Elena cut through traffic model as portrayed in the diagram (see note below); with a two week warning period with an officer at that location during the majority of the time and with some method to officially and formally gather feedback from residents; staff needs to select the most appropriate means of communication to inform the residents about why, the timing and any grace period and if one has a problem what do one should do; the motion included an amendment to include El Monte and Summerhill no right turn on red sign. Note: The diagram posted included the following: • No right turn from south-bound Purissima Road to Robleda Road, Monday to Friday, 4 pm to 8:00 pm • No left turn from west-bound Robleda Road to Elena Road, Monday to Friday, 4 pm to 8:00 pm • No right turn from south-bound Elena Road to Elena Road at the Elena/Robleda intersection, Monday to Friday, 4 pm to 8:00 pm The motion was seconded by Mayor Pro Tem Spreen. 9 City Clerk Regular City Council Meeting February 15, 2018 Motion Carried 5 to 0: AYES: Councilmember Corrigan, Councilmember Waldeck, Councilmember Wu, Mayor Pro Tem Spreen, Mayor Radford NOES: None ABSENT: None ABSTAIN: None 5. PUBLIC HEARINGS A. LANDS OF EVERSHINE LLC, 12815 Deer Creek Lane (APN 175-43-047) (File #332-16-TM). A request to subdivide a 4.32-acre property into two lots. CEQA review: Categorically Exempt pursuant to Section 15315, Minor Land Divisions. (Staff: M. Moseley) Senior Planner Marni Moseley presented the staff report. Mayor Radford opened the Public Hearing. David Chan, applicant, introduced himself to the Council and offered to answer any questions. Lisa Souza, Los Altos Hills, expressed concerns about parcel A and the open space easement. Councilmember Spreen explained open space easements. Mayor Radford closed the Public Hearing. MOTION MADE AND SECONDED: Councilmember Waldeck moved to approve the requested tentative parcel map based on the findings in Attachment 1 and the conditions of approval in Attachment 2. The motion was seconded by Councilmember Corrigan. LANDS OF WILKERSON; 12400 Stonebrook Drive; Appeal of a Decision to Record a Notice of Code Violation Against the Property for the Construction of a Fence Within the Public Right-Of-Way. File #8-18-MISC (Staff: S. Avila) Ex Parte Communications: Councilmember Corrigan disclosed that she spoke with Glenn Wilkerson; Mayor Pro Tem Spreen had not met with anyone, but knows Ms. Wilkerson from the Pathways Committee; Mayor Radford said he had no contact; Councilmember Wu had not met with anyone; Councilmember Waldeck received a call, but did not respond. Planning Director Suzanne Avila presented the staff report. Sonja Wilkerson, Los Altos Hills, addressed the Council and provided a background of the fence on her property. Council asked questions of staff and received their responses. Glenn Wilkerson, Los Altos Hills, said this situation is silly as we are talking about something that doesn't produce, doesn't breath air, and we are not that far off. Mayor Radford opened the Public Hearing. Bill Gibbons, Los Altos Hills, said he filed the complaint and said the fence encroaches on the public land. He said that public land should not be abandoned. Glenn Wilkerson, said that he has lived in the location for 10 years and there is no problem with parking at that location. The City Council asked the City Manager about the parking issue. City Manager Cahill explained that it is not a safe place to park and it coincided with the opening of the path, so staff placed large boulders to discourage parking. Mayor Radford closed the Public Hearing. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Corrigan moved to approve an administrative decision to, as long as it falls within the City Manager's spending authority, split the cost of moving this fence to be on the property line. The motion was seconded by Mayor Radford. Extension of Interim Ordinance Moratorium to Prohibit the Cultivation of Marijuana Including Personal Outdoor Cultivation and Prohibit the Establishment of all Commercial Recreational Marijuana Operations within the Town Limits (Staff: S. Mattas) City Attorney Mattas presented the staff report. Mayor Radford opened the Public Hearing. Seeing no one wishing to speak, he closed the Public Hearing. MOTION MADE AND SECONDED: Councilmember Corrigan moved to waive reading, introduce and adopt urgency Ordinance 574 extending the moratorium prohibiting the cultivation of marijuana including personal outdoor cultivation & prohibiting the establishment of all commercial recreational marijuana operations within the Town. The motion was seconded by Mayor Pro Tem Spreen. Motion Carried 5 to 0: AYES: Councilmember Corrigan, Councilmember Waldeck, Councilmember Wu, Mayor Pro Tem Spreen, Mayor Radford NOES: None ABSENT: None ABSTAIN: None The Council now returned to Ongoing Business. 6. ONGOING BUSINESS D. Receive Mid-Year Financial Report as of December 31, 2017 and adopt a Resolution Approving the Mid-Year Budget Amendment (Staff: P. Lin) 12 City Clerk Regular City Council Meeting February 15, 2018 Administrative Services Director Pak Lin presented the staff report. Council discussion ensued. MOTION MADE AND SECONDED: Mayor Pro Tem Spreen moved to receive the Mid-Year Financial Report and adopt Resolution 14-18 approving the mid-year budget amendment. The motion was seconded by Councilmember Corrigan. Consideration of a Resolution Approving Amendment No. 9 to the Agreement for City Attorney Services between Meyers Nave and the Town of Los Altos Hills (Staff: C. Cahill) City Manager Cahill presented the staff report. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Waldeck moved to adopt Resolution 15-18 Approving Amendment No. 9 to the Agreement for City Attorney Services between Meyers Nave and the Town of Los Altos Hills. The motion was seconded by Mayor Pro Tem Spreen. REPORTS FROM COMMITTEES, SUB-COMMITTEES, AND COUNCILMEMBERS ON OUTSIDE AGENCIES A. Request by the Open Space Committee to Disseminate Information Utilizing the Town's Social Media to Educate Residents Regarding use of Rodenticides George Clifford, Member of the Los Altos Hills Open Space Committee, presented the request by the Open Space Committee regarding rodenticides. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Waldeck moved to approve the request by the Open Space Committee to Disseminate Information Utilizing the Town's Social Media to Educate Residents Regarding use of Rodenticides. The motion was seconded by Mayor Pro Tem Spreen. Administrative Services Director - None. 14 City Clerk Regular City Council Meeting February 15, 2018 F. Public Works Director - 1. Report on the VTA I-280 Corridor Study Public Works Director Chen presented the VTA I-280 corridor study. DIRECTION: The Mayor shall send a letter to the California Traffic Commission that the Town is enthusiastic about the additional lane and that the project should be met with extreme urgency. Councilmembers Corrigan and Waldeck shall work on drafting the letter. 10. COUNCIL INITIATED ITEMS A. Discussion and Possible Direction on a Code of Conduct for Elected Officials (Mayor Waldeck) – continued from the November 16, 2017 and January 18, 2018 City Council meetings Councilmember Waldeck presented the item. He proposed moving forward with a code of conduct for the Council and Planning Commission. Council discussion ensued. DIRECTION: Councilmembers Waldeck and Corrigan will form a subcommittee to work together to craft a code of conduct for City Council and Planning Commission. B. Discussion and Possible Action Regarding the Future of the Public Art Committee (Councilmember Waldeck) - continued from the January 18, 2018 City Council meeting Councilmember Waldeck presented the item. Council discussion ensued. DIRECTION: Councilmember Corrigan said she will accept the responsibility to provide focus to the Public Art Committee. C. Discussion on Installation of Security Cameras/License Plate Readers in Town (Councilmember Wu) Councilmember Wu introduced the item. Rajiv Bhateja, Los Altos Hills, presented the case for license plate reading cameras in Town. Council discussion ensued. 15 City Clerk Regular City Council Meeting February 15, 2018 The Council asked questions of Captain Rich Urena and received his responses. A Los Altos Hills resident stated that about a year and half ago someone attempted to burglarize his home. He has state of the art home security, but the burglar had a ski mask. However, if the cameras were stationed appropriately, they could have gleaned information on the getaway car. Meb Steiner, Los Altos Hills, said that she is a long-time resident and said is not a fan of installing cameras in our town due to privacy concerns for friends, family and visitors. Richard Steinberg, Los Altos Hills, said that he opposes the installation of cameras. Jerry Schwarz, Palo Alto, member of the mid-Peninsula Chapter of the ACLU, said that very intrusive surveillance technology should have a clear planning process. Lauren Cory, Palo Alto, Chair of the Mid-Peninsula ACLU, addressed the presentation and said it was one-sided and needs to be looked at more carefully. Irene Wu, Los Altos Hills, said she was in favor of enhancing security in town, but questioned the motives of cameras in town. MOTION MADE AND SECONDED: Councilmember Corrigan moved to continue the meeting past 10 p.m. The motion was seconded by Mayor Pro Tem Spreen. Motion Carried 5 to 0: AYES: Councilmember Corrigan, Councilmember Waldeck, Councilmember Wu, Mayor Pro Tem Spreen, Mayor Radford NOES: None ABSENT: None ABSTAIN: None David Kuettel, Los Altos Hills, said his home burglarized in broad daylight and individuals were in the house for hours. He said that they no longer feel safe in their home. Captain Urena returned to address the issue raised by Mr. Kuettel and the investigation on the case. Anand Ranganathan, Los Altos Hills, stated his opposition to surveillance cameras. 16 City Clerk Regular City Council Meeting February 15, 2018 Council discussion ensued. Mayor Radford asked the Council if anyone wanted to pursue this topic further. As there was no consensus, this item was not continued. No action was taken. Mayor Radford left the meeting at 10:20 p.m. due to illness. D. Examination of Term Limits as Applied to Select Standing Committees that have an Impact on Development (Open Space, Pathways and Environmental Design and Protection) (Councilmember Waldeck) Councilmember Waldeck presented the item. Council discussion ensued. DIRECTION: Councilmembers Corrigan and Waldeck shall work together to propose modifications to the standing committee resolution relating to term limits. 11.
