Mayor Spreen called the Closed Session to order at 5:33 p.m. A. Mayor Spreen called the meeting order at 6:00 p.m. Prior to the Roll Call, Mayor Spreen asked the City Attorney to report out from closed session. City Attorney Steve Mattas stated that there was no reportable action resulting from closed session. A. Pledge of Allegiance 1. AGENDA REVIEW Mayor Spreen reported that Agenda Item #2.C regarding the Los Altos/Los Altos Hills Little League would be removed from the agenda at their request and considered at a later date. He also introduced Administrative Services Director Sarina Revillar. 2. APPOINTMENTS AND PRESENTATIONS A. Presentation by Nancy Hetrick from Management Partners on the April 26, 2019 Goal Setting Session Nancy Hetrick, Management Partners, provided a wrap-up report on the Council's goal setting workshop. The Council received the report. No action was taken. B. Presentation by GreenWaste Recovery, Inc. - Status Update Emily Hansen, GreenWaste Recovery provided a presentation on the roll-out of the new contract. The Council asked questions of Ms. Hansen and received responses. No action was taken. DIRECTION: There was Council consensus to direct staff to work with GreenWaste to address residents who need a second bin grouping and to reduce the collection points. Kit Gordon, Los Altos Hills, said the missing ingredient in the GreenWaste contract was public input. She proposed a policy change, that even before an RFP is issued, there be a public information session. Sue Welch, Los Altos Hills, said their bill has almost doubled after this increase and largely because of the drive-on service cost. Robert Sandor, Los Altos Hills, spoke about contract negotiation and said he has lost trust in the leadership of the Town. Eileen Gibbons, Los Altos Hills, asked a logistic and terminology question about the garbage service. Dru Anderson, Los Altos Hills, had questions about carts and long driveways. 3 City Council Special Meeting Minutes August 21, 2019 C. Presentation by Los Altos/Los Altos Hills Little League - at the request of the Los Altos/Los Altos Hills Little League, this item was removed from the agenda and not considered. D. Reappointment to the Los Altos Hills Pathways Committee City Clerk Deborah Padovan presented the reappointment request of Alisa Bredo. MOTION MADE AND SECONDED: Councilmember Corrigan moved to reappoint Alisa Bredo to the Los Altos Hills Pathways Committee for a second, four year term. The motion was seconded by Councilmember Tankha. Reappointment to the Los Altos Hills Emergency Communications Committee City Clerk Padovan presented the reappointment request of Andrew Kirk. MOTION MADE AND SECONDED: Councilmember Corrigan moved to reappoint Andrew Kirk to the Los Altos Hills Emergency Communications Committee for a fourth, four-year term. The motion was seconded by Councilmember Tyson. Reappointment to the Los Altos Hills Public Art Committee City Clerk Padovan presented the reappointment request of Farah Tabatabai. 4 City Council Special Meeting Minutes August 21, 2019 MOTION MADE AND SECONDED: Councilmember Corrigan moved to reappoint Farah Tabatabai to the Public Art Committee for a second, four-year term. The motion was seconded by Councilmember Tyson. Appointment to the Los Altos Hills History Committee City Clerk Padovan presented the application of Denise Williams to the History Committee. MOTION MADE AND SECONDED: Councilmember Corrigan moved to appoint Denise Williams to the Los Altos Hills History Committee. The motion was seconded by Councilmember Tankha. Annual Report by the Los Altos Hills Open Space Committee Richard Contreras, Co-Chair of the Los Altos Hills Open Space Committee, presented the annual report of the committee. The Council thanked the committee for all of their hard work. There was City Council consensus for the two Open Space Committee events; a bird forum in October 2019 and a plant forum in 2020. 5 City Council Special Meeting Minutes August 21, 2019 I. Annual Report by the Los Altos Hills History Committee Carol Gottlieb, Co-Chair of the Los Altos Hills History Committee, presented the annual report of the committee. The Council thanked the committee for all of their hard work. There was Council consensus for the committee to hold the September 29, 2019 "Tales of Moody Road" event. 3. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subject not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a Resolution previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. Hadas Tepman, Los Altos Hills, spoke in opposition to 5G cell towers. 6 City Council Special Meeting Minutes August 21, 2019 Zubin Irani, Los Altos Hills, spoke in opposition to 5G cell towers. Barry Smith, Los Altos Hills, asked about the application process. Jim Frazier, Los Altos Hills, inquired about the two applications and how they are being affected by the urgency ordinance. City Attorney Steve Mattas stated that telecommunications facilities are regulated at both the federal and state levels. In a broad sense, the federal law can preempt state law. There have been changes to federal law over the last two to three years that have made it easier, created more streamlined processes, to get cell facilities approved. Cities do retain some level of discretion under existing case law. The ordinance that the Council adopted earlier in the year, was to ensure that the Town has the ability to exercise the authority that it has under federal and state law. The Town retained as much authority as it could. Buddy Arnheim, Los Altos Hills, spoke in opposition to 5G cell towers. Brian Croll, Los Altos Hills, said that there is a perception that Los Altos Hills has been asleep at the wheel. Cheryl Evans, Los Altos Hills, informed the audience that individuals can sign up to get copies of agenda of all the meetings via email. Gary Waldeck, Los Altos Hills, spoke about the Santa Clara County Cities Association and strongly expressed that the Town should stay in the organization. Meeting went into Recess at 8:35 p.m. Meeting Reconvened to Open Session at 8:45 p.m. 4. CONSENT CALENDAR MOTION MADE AND SECONDED: Councilmember Corrigan moved to approve the CONSENT CALENDAR with the exceptions of Items 4.F, 4.N, 4.O, 4.P and 4.Q. Resolution 52-19 Awarding a Three-Year Contract for Capital Restoration Work and One-Year of Maintenance and Education Activities with Grassroots Ecology for Town-Owned Open Space Preserves (Staff: N. Bowersox) Councilmember Corrigan asked that additional language be added to the agreement. She suggested that the wording to be added "that the amount not exceed $245,000 in total or $80,000 in a calendar year." Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Corrigan moved to adopt Resolution 52-19 awarding a contract for a three-year restoration work and one-year maintenance and public outreach activities for Town owned open space preserves to Grassroots Ecology as amended to read that the total amount does not exceed $240,000 or $80,000 in a calendar year. The motion was seconded by Councilmember Tankha. Resolution 53-19 Vacating of a Portion of an Existing Open Space Easement; Lands of Evans; 11641 Buena Vista Drive (Staff: S. Padovan) Councilmember Tyson had questions about Agenda Items 4.N, 4.O, 4.P & 4.Q. Interim Planning Director Steve Padovan presented slides explaining the easements and agreements. Council discussion ensued. Sue Welch, Los Altos Hills, said there are areas that were in the existing open space easement that the Open Space Committee asked to remain in the easement. MOTION MADE AND SECONDED: Councilmember Tyson moved to adopt Resolution 53-19 approving a request to vacate a portion of an open space easement at 11641 Buena Vista Drive; Resolution 54-19 Accepting Dedication of an Open Space Easement for Lands of Evans at 11641 Buena Vista Drive; Resolution 55-19 Accepting Dedication of an Open Space Easement for Lands of Evans, APN 182-29- 9 City Council Special Meeting Minutes August 21, 2019 048; and Resolution 56-19 Accepting Dedication of Pathway Easement for Lands of Evans at 11641 Buena Vista Drive. Resolution 56-19 Accepting Dedication of Pathway Easement; Lands of Evans; 11641 Buena Vista Drive (Staff: N. Bowersox) 5. PUBLIC HEARINGS A. CONSIDERATION OF A GENERAL PLAN AMENDMENT to Update the Town's Master Path Map to add an off-road Pathway Connection from Rhus Ridge Road to La Loma Drive. The Proposed Pathway to be Located Between 25263 and 25265 La Loma Drive and along the Private Driveway Between 25223, 25225, 25245 and 25259 La Loma Drive; File #238-15-MISC; CEQA Review: Categorical Exemption per Section 15061(b)(3) (Staff: S. Padovan) Mayor Spreen stated that he owns property within 500 feet of this proposed pathway. He recused himself and stepped down from the dais. Vice Mayor Wu asked for ex parte communications. Councilmember Corrigan said she had a conversation about this property with Roger Spreen and walked it this morning from Rhus Ridge to La Loma and met one of the residents in the area; Councilmember Tankha said she met three or four residents who are impacted by the property and met with Bridget Morgan all on the property while she was walking it and she also met with Ann Duwe; Councilmember Tyson said he has not met with anyone, but had a phone conversation with Ann Duwe; Vice Mayor Wu stated she met with Ann Duwe, drove on the property, walked around the loops, but it did not involve anyone. 10 City Council Special Meeting Minutes August 21, 2019 Vice Mayor Wu opened the public hearing. Interim Planning Director Steve Padovan presented the staff report. Council asked questions of staff and received their responses. Ann Duwe, Los Altos Hills, spoke about the history of the master path map. Richard Herzog, Los Altos Hills, said this has been going on for 14 years and there was no established path. The pathway is there, but he doesn't want it on the map. Steve Devich, Los Altos Hills, said that the path shown on the screen is not correct. He was not in favor of adding the path to the master path plan. Roger Spreen, Los Altos Hills, spoke in support of the pathway. Mr. Herzog replied to Mr. Spreen about emergency access to the pathway. Wayne Kelly, Los Altos Hills, thanked the Council for visiting the site and said he doesn't have an issue with the bicycles. Ginger Summit, Los Altos Hills, spoke in support of this pathway being added to the master path map. Peter Evans, Los Altos Hills, he doesn't believe the homeowners should have to put a path on the property involuntarily. However, this decision is for the future and spoke in support of this pathway being added to the master path map. Linda Swan, Los Altos Hills, said it is an important pathway and should be included on the map. Eileen Gibbons, Los Altos Hills, spoke in support of this pathway being added to the master path map. Teresa Baker, Los Altos Hills, spoke in support of this pathway being added to the master path map. Nick Dunckel, Los Altos Hills, spoke in support of this pathway being added to the master path map. Eric Evans, Los Altos Hills, said that he dedicated a pathway easement across his property because it makes sense. However, the two affected owners do not want the easement and that should be respected. Sue Welch, Los Altos Hills, said that homeowners change over time and please think of the future potential of proposed routes and the map's long term vision. 11 City Council Special Meeting Minutes August 21, 2019 MOTION MADE AND SECONDED: Councilmember Corrigan moved to continue the meeting past 10:00 p.m. The motion was seconded by Councilmember Tyson. Cheryl Evans, Los Altos Hills, said she was not in support of adding this pathway to the map. Kathy Evans, Los Altos Hills, spoke in support of this pathway being added to the master path map. Bridget Morgan, Los Altos Hills, said she was not in support of adding the pathway to the map. Vice Mayor Wu closed the Public Hearing. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Corrigan moved to confirm the Planning Commission's recommendation and deny the proposed path segment between Rhus Ridge Road and La Loma Drive. The motion was seconded by Councilmember Tankha. The City Attorney confirmed that staff does not have direction to either put it on the map or remove it from further consideration. At the conclusion of the item, Mayor Spreen then returned to the dais. B. CONSIDERATION OF A GENERAL PLAN AMENDMENT to Update the Town's Master Path Map to add the Following Proposed Trail Access Connections: * Designate a Future Trail Access Location from the Laura Court Pathway into the Southerly Portion of 24840 Prospect Avenue; * Designate a Future Trail Access Location off the Planned Pathway between La Loma Drive and Laura Court into 25355 La Loma Drive. File #238-15-MISC; CEQA Review: Categorical Exemption Per Section 15061(B)(3) (Staff: S. Padovan) Mayor Spreen opened the Public Hearing. Interim Director Padovan presented the staff report. Council asked questions of staff and received responses. Ann Duwe, Los Altos Hills, said the history was discussed at the Planning Commission meeting and she stated her support of the proposed paths. Eileen Gibbons, Los Altos Hills, spoke in support of the proposed paths. Nick Dunckel, Los Altos Hills, said that the arrows on the map are just pointing out to a developer where an optimum path might be located. Mayor Spreen closed the Public Hearing. Council discussion ensued. MOTION MADE AND SECONDED: Vice Mayor Wu moved to support the Pathways Committee's recommendations to add the two arrows regarding new pathway connection points on the Town's Master Path Map. The motion failed due to lack of a second. MOTION MADE AND SECONDED: Councilmember Corrigan moved to approve the addition of the arrow on 24840 Prospect Drive. The motion was seconded by Vice Mayor Wu. The motion failed due to lack of a second. 6. NEW BUSINESS A. Update on Regional Minimum Wage Efforts and Proposal of a Draft Minimum Wage Ordinance (Staff: C. Einfalt) Management Analyst Cody Einfalt presented the staff report. Council discussion ensued. Karen Lemes, Los Altos Hills, expressed her support of the proposed ordinance. Jay Bahri, Los Altos Hills, spoke in support of the proposed minimum wage ordinance. Priscilla Acuna, Working Partnerships USA, spoke in support of the proposed minimum wage ordinance. John Lemes, Los Altos Hills, spoke in support of the proposed minimum wage ordinance. Allan Epstein, Los Altos Hills, said he was in support of $15 per hour, but no one in town makes less than that and no ordinance was needed. Kjell Karlsson, Los Altos Hills, said he doesn't know anyone making less than $30 per hour in Town. No ordinance is needed. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Tankha moved to direct staff to proceed in drafting a minimum wage ordinance for the Town. The motion was seconded by Councilmember Tyson. Authorizing the Mayor to Sign a Letter Outlining the Town's Concerns Regarding AB 302: Parking for Homeless Students on California Community College Campuses (Staff: C. Einfalt) Management Analyst Cody Einfalt presented the report. Council discussion ensued. Karen Lemes, Los Altos Hills, spoke in support of the assembly bill. Eileen Gibbons, Los Altos Hills, stated she supports the Town sending the letter. Jay Bahri, Los Altos Hills, spoke in support of the assembly bill. Genevieve Kolar, Student Trustee on Foothill-De Anza Board of Trustees, spoke in support of the assembly bill. Kjell Karlsson, Los Altos Hills, asked about Foothill having a designated Red Cross center. If so, students can sleep in the beds in the big room. Council discussion ensued. Isabelle LaSalle, Field Representative for Assemblymember Marc Berman, stated the bill has not been tabled and is currently in the Senate appropriations committee. Further Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Corrigan moved to send a letter to Assemblymember Marc Berman expressing Los Altos Hills' concerns with Assembly Bill 302 and request that the State consider an alternate approach to student homelessness. The motion was seconded by Vice Mayor Wu. Response to the Grand Jury Inquiry Report on Governance of the Valley Transportation Authority (Staff: C. Einfalt) Management Analyst Cody Einfalt presented the proposed letter. Council discussion ensued. MOTION MADE AND SECONDED: Vice Mayor Wu moved to approve the letter to the Santa Clara County Civil Grand Jury Report regarding the Governance of the VTA. The motion was seconded by Councilmember Corrigan. REPORTS FROM COMMITTEES, SUB-COMMITTEES, AND COUNCILMEMBERS ON OUTSIDE AGENCIES A. Request by the Los Altos Hills Environmental Design and Protection Committee for Direction to Update the Fence Ordinance Peter Brown, Chair of the Environmental Design and Protection Committee, requested that staff be directed to work on the fence ordinance with the assistance of the committee. Council discussion ensued. The item was sent back to committee for further review. The Council asked that the committee continue work on the item without adding an extra burden to staff. B. Report by the Undergrounding Subcommittee (Councilmember Tyson) Councilmember Tyson presented a memo summarizing the efforts made by the subcommittee to date. He suggested creating the vision first and then seek partners and funding. No action was taken. 16 City Council Special Meeting Minutes August 21, 2019 C. Request for a Letter Signed by the Mayor Responding to the Correspondence from the Federal Aviation Administration (FAA) Addressing a Reduction in Aircraft Noise Over Los Altos Hills (Vice Mayor Wu) Vice Mayor Wu presented the proposed letter. She thanked resident Jay Sutaria for his assistance in drafting the letter. MOTION MADE AND SECONDED: Moved by Councilmember Corrigan, seconded by Vice Mayor Wu and passed unanimously to approve a letter Signed by the Mayor Responding to the Correspondence from the Federal Aviation Administration (FAA) Addressing a Reduction in Aircraft Noise Over Los Altos Hills (Note: the City Clerk will send the letter for the City Council's review. If there are any changes, the letter will return to the City Council at the next regular meeting). The motion was seconded by Vice Mayor Wu. Planning Director 17 City Council Special Meeting Minutes August 21, 2019 1. Update on the Lehigh Southwest Cement Quarry Reclamation Plan Amendment Application 2. Update on the Stanford University General Use Permit (GUP) Interim Planning Director Padovan provided an updated on the Lehigh Quarry Project. He said the project is still incomplete and it is too early to provide any type of incomplete letter. Council discussion ensued. The Council directed a letter be sent to the County expressing the Town's concerns about the quarry. 9. COUNCIL INITIATED ITEMS Councilmember Corrigan reported that SVCE will be presenting the basic Reach Codes at next month's City Council meeting. She encouraged everyone in Town Hall to stop using single-use water bottles. She requested that single use water bottles no longer be used on the dais for City Council meetings. 10. ADJOURN Pursuant to Ordinance No. 506, the Council Meeting shall adjourn no later than 10:00 p.m., unless otherwise approved by a majority of the Councilmembers present.
