Jim Frazier, Los Altos Hills, inquired about the two applications and how they are being
affected by the urgency ordinance.
City Attorney Steve Mattas stated that telecommunications facilities are regulated at both
the federal and state levels. In a broad sense, the federal law can preempt state law. There
have been changes to federal law over the last two to three years that have made it easier,
created more streamlined processes, to get cell facilities approved. Cities do retain some
level of discretion under existing case law. The ordinance that the Council adopted earlier
in the year, was to ensure that the Town has the ability to exercise the authority that it has
under federal and state law. The Town retained as much authority as it could.
