A. Roll Call Present: Mayor Spreen, Vice Mayor Wu, Councilmember Corrigan (participated via teleconference), Councilmember Tankha, Councilmember Tyson Absent: None Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Planning Director Zach Dahl, City Engineer/Public Works Director Nichol Bowersox, Administrative Services Director Sarina Revillar, Principal Planner Steve Padovan, City Clerk Deborah Padovan B. Pledge of Allegiance 1. AGENDA REVIEW There were no changes to the agenda. 2. PRESENTATIONS AND APPOINTMENTS A. Presentation by Foothill College President Thuy Nguyen on Student Educational Needs and Priorities Foothill College President Thuy Nguyen provided an update on the ongoing activities at Foothill College and reported on poll data gleaned from the college community. Council asked questions of President Nguyen and received her responses. No action was taken. B. Annual Presentation of the Finance and Investment Committee Stan Mok, Member of the Los Altos Hills Finance and Investment Committee, presented the annual report of the committee. 2 Regular City Council Meeting Minutes October 17, 2019 The Council thanked the committee for all their hard work throughout the past year. No action was taken. C. Reappointment to the Los Altos Hills Emergency Communications Committee City Clerk Deborah Padovan presented the reappointment request of Ben Hu. MOTION MADE AND SECONDED: Councilmember Corrigan moved to reappoint Ben Hu to the Los Altos Hills Emergency Communications Committee for a second, four-year term. The motion was seconded by Councilmember Tankha. Motion Carried 5 to 0: AYES: Mayor Spreen, Vice Mayor Wu, Councilmember Corrigan, Councilmember Tankha, Councilmember Tyson NOES: None ABSENT: None ABSTAIN: None D. Presentation by OpenFiber Phil Clark, Open Fiber, presented shared infrastructure concepts to bring modern telecommunications to communities. The Council asked questions of Mr. Clark and received his responses. No action was taken. E. Presentation by Santa Clara Valley Water District 7 Director Gary Kremen on Valley Water Projects Santa Clara County Valley Water District Director Gary Kremen provided the Council with a Valley Water District update. Council thanked Director Kremen for the information he provided. No action was taken. 3 Regular City Council Meeting Minutes October 17, 2019 3. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subject not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the Council from acting on items that do not appear on the agenda. Under a Resolution previously adopted by the Council, such items can be referred to staff for appropriate action, which may include placement on the next available agenda. Nancy Couperus, Los Altos Hills, spoke in support of the round pen replacement project. Aakesh Vashee, Silicon Valley Leadership Group, invited the Council to participate in the Turkey Trot on Thanksgiving Day. Rich Urena, Santa Clara County Sheriff Captain, introduced Lieutenant Neil Valenzuela. Lieutenant Neil Valenzuela introduced himself and stated he was happy to be serving the Town again. 4. CONSENT CALENDAR MOTION MADE AND SECONDED: Councilmember Tankha moved to approve the CONSENT CALENDAR as stated. The motion was seconded by Councilmember Tyson. Adoption of Ordinance 584 (Second Reading) Amending Section 3-3.303, Section 9-1.1112, and Article 6 of Chapter 2, Title 10 of the Los Altos Hills Municipal Code Concerning the Pathway Fee and Pathway Fund - Motion to Waive Reading and Adopt the Ordinance (Staff: N. Bowersox) H. Resolution 66-19 to Award the Sewer Rate Study Project to HF&H (Staff: N. Bowersox) I. Approving an Amended Town Hall Facility Use Policy for Council Chambers and Town Hall Meeting Spaces (Staff: S. Robustelli) J. Resolution 67-19 Awarding Contract for Westwind Community Barn Round Pen Replacement Project and Accepting a $15,000 Donation to the Town of Los Altos Hills (Staff: S. Robustelli) 5. PUBLIC HEARINGS A. Consideration of a General Plan Amendment to Update the Town's Master Path Plan to add an Off-Road Pathway Connection from Dianne Drive to East Sunset Drive. The Proposed Pathway would be located between 12780 and 12800 Dianne Drive and along the rear Property Line of 13040, 13208 and 13210 East Sunset Drive; File #238-15-MISC; CEQA Review: Categorical Exemption Per Section 15061(B)(3) (Staff: S. Padovan) Mayor Spreen opened the Public Hearing. Principal Planner Steve Padovan presented the staff report. Ann Duwe, Member of the Los Altos Hills Pathways Committee, provided background on the committee's vote in 2016 and the current committee's position. Craig Kennedy, Los Altos Hills, said that in 63 years there has not been a need for this path and it is not needed now. Sean Suchter, Los Altos Hills, expressed his concerns as the proposed path comes within 25 feet of his bedroom window. Les Earnest, Los Altos Hills, opined that what has been presented is a pack of lies. Mohsen Rahnama, Los Altos Hills, expressed that he is the most impacted property by this proposed pathway. He was not in support of this pathway. 5 Regular City Council Meeting Minutes October 17, 2019 Dominic Gallello, Los Altos Hills, said he does not support this pathway. Mayor Spreen closed the Public Hearing. Ex Parte Communications: Councilmember Tyson said that approximately three weeks ago, he spoke to Mr. Kennedy, who had a general concern; and yesterday he walked the proposed path. Council discussion ensued. MOTION MADE AND SECONDED: Vice Mayor Wu moved to adopt Resolution 68-19 amending the Town's Master Path Plan to include an off-road pathway between Dianne Drive and East Sunset Drive along with connecting roadside paths. The motion was seconded by Councilmember Tyson. Motion Carried 4 to 1: AYES: Mayor Spreen, Vice Mayor Wu, Councilmember Tankha, Councilmember Tyson NOES: Councilmember Corrigan ABSENT: None ABSTAIN: None B. ORDINANCE AMENDMENTS TO TITLE 8 OF THE MUNICIPAL CODE (Building Regulations) to adopt the 2019 California Building Standards Code, including but not limited to Administrative, Building, Residential, Electrical, Mechanical, Plumbing, Energy, Historical Building, Fire, Existing Building, California Green Building and Referenced Standards Codes with local amendments. File #MCA19-0003, CEQA Review: Categorical Exemption per Section 15061(b)(3) (Staff: S. Padovan). Motion to Waive Reading and Introduce the Ordinance Principal Planner Padovan presented the staff report. Mayor Spreen opened the Public Hearing. Seeing no one wishing to speak, Mayor Spreen closed the public hearing. MOTION MADE AND SECONDED: Councilmember Tankha moved to waive reading and introduce the ordinance to amend Chapters 1 through 1.11 of Title VIII of the LAHMC and adopt by reference the 2019 California Building Standards Code with local modifications and amendments. Motion to Waive Reading and Introduce an Ordinance of the Town of Los Altos Hills Amending Sections 6-3.24 of the Los Altos Hills Municipal Code Pertaining to Transfer of Liability for Collecting Delinquent Accounts (Staff: N. Bowersox) Public Works Director Nichol Bowersox presented the staff report. Mayor Spreen opened the Public Hearing. Seeing no one wishing to speak, he closed the Public Hearing. MOTION MADE AND SECONDED: Vice Mayor Wu moved to waive reading and introduce an ordinance amending the Los Altos Hills Municipal Code Title 6, Chapter 3 "Solid Waste" related to solid waste franchise agreements. The motion was seconded by Councilmember Tankha. Motion Carried 5 to 0: AYES: Mayor Spreen, Vice Mayor Wu, Councilmember Corrigan, Councilmember Tankha, Councilmember Tyson NOES: None ABSENT: None ABSTAIN: None 6. REPORTS FROM COMMITTEES, SUB-COMMITTEES, AND COUNCILMEMBERS ON OUTSIDE AGENCIES A. Report by the Undergrounding Subcommittee (Councilmember Tyson) Councilmember Tyson provided an update on the undergrounding subcommittee. There was Council consensus to allow Councilmember Tyson to prepare a letter to PG&E for the Mayor's signature requesting further information on the process, the schedule, and cost. 7 Regular City Council Meeting Minutes October 17, 2019 7. STAFF REPORTS A. City Manager No report. B. City Attorney No report. C. City Clerk City Clerk Padovan reminded the Council that the regular meeting in November was canceled and a special meeting was called by the Mayor for Wednesday, November 20, 2019. D. Planning Director Planning Director Zach Dahl reported on state housing bills. He provided an update on the Fast Track process and stated that out of ten applications, two will be going to Planning Commission for review. The other eight will be going through the Fast Track process. E. Administrative Services Director Administrative Services Director Sarina Revillar informed the Council that Fiscal Year 2019-20 budget book is now available online. F. Public Works Director Director Bowersox said that the stinkwort spraying is completed, the annual pavement CIP has started, and the sewer CIP is completed. 8. COUNCIL INITIATED ITEMS A. Appointment of Subcommittee to Study a Master Park Plan (Councilmember Corrigan) Councilmember Corrigan proposed that the Council form a subcommittee with current councilmembers and previous councilmembers or highly motivated civic leaders with one member from the Parks and Recreation Committee, one member from Los Altos Hills Horseman’s Association, and one member from the Little League, Education Committee or one member from executive staff. She proposed that the Council craft how many people they envision on this subcommittee and then open it up to an application process and let all interested parties submit. 8 Regular City Council Meeting Minutes October 17, 2019 Mayor Spreen suggested an ad hoc subcommittee comprised of Councilmembers Corrigan and Tankha to put together a committee. The subcommittee could then bring back a proposed group for the Council's consideration and appointment. B. Consideration of the Los Altos Hills Fire District Request to Adopt Section R337 of the 2019 California Residential Code Which Includes Regulations on Exterior Materials and Construction Methods to Resist Wildland Fires (Councilmember Tyson) Councilmember Tyson introduced the item. He suggested that the Planning Commission review the request by the District and confirm that it says what the fire department is stating. He then requested that staff look at the potential impact. Council discussion ensued. DIRECTION: The amendments for both for the Reach Codes and Section R337 of the 2019 California Residential Code will come directly to the City Council with appropriate public notice. Councilmember Corrigan expressed the prioritization of upcoming agenda items. Jitze Couperus, Los Altos Hills, said he strongly supports the fire code amendments. Adopt them and do it rapidly. 9.
