HomeMy WebLinkAboutPC 07-21RESOLUTION PC 07-21 RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF LOS ALTOS HILLS APPROVING A SITE DEVELOPMENT PERMIT FOR LANDSCAPE SCREENING, LIGHTING, FENCING AND ASSOCIATED HARDSCAPE AT 27800 VIA FELIZ WHEREAS, The Town of Los Altos Hills received an application for a Site Development Permit (SD20-0063) from Ground Studio for landscape screening associated with a previously approved single-family estate home at 27800 Via Feliz ("Project"); and WHEREAS, the Project is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15304(b) since the project includes new landscaping, fencing, and grading; and WHEREAS, the Project application was processed in accordance with the applicable provisions of the California Government Code and the Los Altos Hills Municipal Code; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on June 3, 2021 and considered all written documentation and public comments; and NOW, THEREFORE, the Planning Commission of the Town of Los Altos Hills hereby APPROVES the Site Development Permit (SD20-0063) subject to the Findings contained in Exhibit "A" and the conditions contained in Exhibit "B" and incorporated herein by reference. The above and foregoing Resolution was passed and adopted by the Planning Commission of the Town of Los Altos Hills at a regular meeting held on the 3rd day of June, 2021, by the following vote: AYES: Patel, Indaco, Couperus, Smith, Waschura NAYS: None ABSTAIN: None ABSENT: None By: Rajiv ffitel, Chair ATTEST: 4�E�_ Steve Padovan, Interim Planning and Building Director Resolution PC 07-21 Page 1 of 4 EXHIBIT A FINDINGS 27800 Via Feliz — File # SD20-0063 1. With regard to the Site Development Permit (SD20-0063) to allow for landscape screening at 27800 Via Feliz, the Planning Commission finds in accordance with Section 10-2.802 of the Los Altos Hills Municipal Code as follows: a. The proposed landscape screening plan is in compliance with all regulations and policies set forth in the Site Development ordinance. The proposed landscape screening plan complies with all applicable regulations and policies set forth in the Site Development Ordinance because the plan provides the amount of planting required to adequately screen the new residence, preserves the existing oaks and redwoods on the property, and mitigates visual and privacy impacts. Resolution PC 07-21 Page 2 of 4 EXHIBIT B CONDITIONS OF APPROVAL 27800 Via Feliz — File # SD20-0063 PLANNING DEPARTMENT 1. Any further changes or modifications to the approved plans shall be first reviewed and approved by the Planning Director, prior to planting or commencement of work. 2. All required screening plantings shown on the plans shall be installed prior to final inspection of the new residence. All exposed areas must be treated for erosion control to the satisfaction of the Engineering Department prior to final inspection. The number of non -screening plants should be reduced and a private well should be considered to utilize available groundwater resources. 3. Exterior lighting is approved as shown on the plans and as amended by the following condition. All exterior lighting fixtures shall be down directed, shielded, and non-movable fixtures. No lighting may be placed within setbacks except for two driveway or entry lights. All path lights shall not exceed 200 lumens/2,700 kelvins, step and wall lights shall not exceed 11.0 lumens/2,700 kelvins and all other lighting shall not exceed 600 lumens/3,000 kelvins. In addition, the lighting shall be revised as follows: • All up -lighting shall be removed. • Hanging tree lights shall be fully shielded and limited to only the 10 trees that are surrounded by the new residence. • Remove all L8 or other pathway lights in the meadow area on the north side of the home. • Retain the path lights up to the fountain from the house and the parking area off Avila Court. • Remove the two L9 pathway lights between the house and stairs on the path to the oak grove. • Reduce the FX18 wall lights for the Avila Court parking area from 8 to 5. Any additional exterior lighting requires approval by the Planning Department prior to installation. 4. The existing metal perimeter fencing shall be brought into compliance with the current fence ordinance. All metal spikes on the top shall be removed and a horizontal bar shall be placed across the top of the fence if needed. All metal fencing in the open space/conservation easement shall be removed or relocated to the inside boundary of the easement. Replacement fencing along the Town pathway shall be limited to split rail style fencing. Any additional or modified fencing or gates shall require review and approval by the Planning Department prior to installation. Resolution PC 07-21 Page 3 of 4 5. A Certificate of Completion shall be prepared by the project Landscape Architect, Irrigation Designer, or Landscape Contractor, provided to the Town, and include the following statement: "The landscape and irrigation system has been installed as specified in the landscape design plan and complies with the criteria of the Water Efficient Landscape Ordinance and the permit." The Certificate of Completion shall be submitted at completion of landscape installation (not required prior to final inspection). 6. A $5,000 landscape maintenance and water usage deposit shall be paid to the Town prior to final inspection of the new residence. Two years after the project has been completed, staff will review the water usage for the property and conduct a site inspection to ensure installed landscape screening is still present and has been adequately maintained. Inadequate maintenance of installed landscape screening and/or water usage greater than the annual usage indicated on the approved parcel water budget worksheet, may result in complete forfeiture of this deposit. 7. The property owner shall enter into an Agreement for Open Space Easement with the Town of Los Altos Hills to clarify the uses permitted on the existing open space/conservation easement. All existing fencing shall be removed. No lighting or significant grading or fill shall be permitted and native vegetation along with temporary irrigation systems to establish the native vegetation may be placed within the easement. Any future fencing shall allow for the free movement of wildlife. The grant document shall be signed and notarized by the property owner and returned to the Town prior to final inspection of the residence. 8. Reduce the number of plants placed under existing trees to create more open/natural landscape areas. Replace any invasive species and replace with non-invasive or native plants. New plantings and irrigation proposed within the drip lines of existing oak trees shall be placed no closer than 15 feet to the trunk of the tree. 9. Enclose the proposed generator to the west of the pool house in a noise attenuated enclose. The gate or door into the enclosure shall face to the east. 10. All pavement that encroaches into the yard setbacks in the parking area off Avila Court shall be removed. ENGINEERING DEPARTMENT 11. Any revisions or additions to the approved grading and drainage plan shall be submitted for review by the Engineering Department. The plan shall be reviewed by the Engineering Department and approved prior to commencement of this project. The approved plan shall be stamped and signed by the project engineer and shall supersede the previously approved grading drainage plan. 12. No grading shall take place during the grading moratorium (October 1 and April 30) except with prior approval from the City Engineer. No grading shall take place within ten feet of any property line. Resolution PC 07-21 Page 4 of 4 13. An encroachment permit shall be obtained from the Public Works Department for all work proposed in the public right-of-way. No work within the public right-of-way shall commence without an encroachment permit. 14. Any, and all areas on the project site that have the native soil disturbed shall be protected for erosion control during the rainy season and shall be replanted prior to final inspection. 15. All irrigation systems must be located at least three feet from the Town's pathways and outside of the public right of way and public utility easements. The Town staff shall inspect the site and any deficiencies shall be corrected to the satisfaction of the Engineering Department prior to final inspection. FIRE DEPARTMENT 16. Provide an access driveway and turnaround with a paved all-weather surface capable of supporting apparatus weight at least 75,000 pounds, a minimum unobstructed width of 14 feet, vertical clearance of 13 feet 6 inches, minimum circulating radius of 36 feet outside and 23 feet inside, and a maximum slope of 15% for the driveway and 5% for the turnaround. Installations shall conform to Fire Department Standard Details and Specifications sheet D-1. 17. Gate installations shall conform with the Fire Department Standard Details and Specification G-1 and when open shall have a minimum unobstructed width of 14 feet when in the open position and be equipped with an approved Knox key switch. Project approval may be appealed if done so in writing within 21 days of the date of the approval. Please refer to the Conditions of Project Approval set forth herein. If you believe that these Conditions impose any fees, dedications, reservation or other exactions under the California Government Code Section 66000, you are hereby notified that these Conditions constitute written notice of a statement of the amount of such fees, and/or a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90 -day approval period in which you may protest such fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90 -day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Upon completion of the construction, a final inspection shall be required to be set with the Planning and Engineering Departments two weeks prior to final building inspection approval. NOTE: The Site Development permit is valid for one year from the approval date. All required building permits must be obtained within that year and work on items not requiring a building permit shall be commenced within one year and completed within two years.
