HomeMy WebLinkAbout74-21RESOLUTION 74-21 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ACCEPTING THE OFFER OF DEDICATION OF RIGHT-OF-WAY EASEMENT AND PUBLIC UTILITY EASEMENT WHEREAS, a portion of Natoma Oaks Lane (formerly Charles Avenue) was offered for dedication for right-of-way and utility easements on that certain Document titled Irrevocable Offer of Dedication of Right of Way and Utility Easement, recorded November 15, 1999 as document number 15057834, official records of Santa Clara County and said offer of dedication was acknowledged and rejected by Resolution No. 61-99; and WHEREAS, the right-of-way easement of the Natoma Oaks Lane was offered for public use as a condition of approval of the 9 -lots at Natoma Oaks subdivision; WHEREAS, the City Council has determined that acceptance of the right-of-way easement dedication shall complete the right-of-way for the newly created public street, Natoma Oaks Lane, and serves an important public purpose; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: The Town hereby accepts on behalf of the public the dedication of the right-of-way easement and utility easement described and depicted in Attachment 2 hereto; and that the Mayor is hereby authorized and directed to execute the Dedication on behalf of the Town. Stirling, deceased ("Owner") in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ('7own"). ' A. Ownerowns property in the Town of Los Altos Hills ("Town") consisting of two lots commonly known as 28025 Natoma Road ("Lot 'i ") and 28050 Natoma Road ("Lot 2"), which are more particularly described respectively in Mbit Art and A-2 attached heretg. B. Owner desires to dedicate a right of way and utility easement over Lot 1 to the Town, as more particularly described and shown in Exhibit g attached hereto. C. Town does not wish to accept this Offer of Dedication at this time, but wishes to reserve the right to accept the Offer of Dedication in the future. NOW, THEREFORE, Owner declares as follows: 1. Right of Way. Owner hereby irrevocably offers to dedicate to the Town a right of way and utility easement in the property described in Exh� ibit B attached hereto. 2. NQ Implied AcQ aL4m.
