RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS
SUMMARILY VACATING THE PATHWAY EASEMENTS
(Lands of Byrne LLC)
WHEREAS, Chapter 4 of the Public Streets, Highways and Service Easement Vacation Law,
commencing with Streets and Highway Code Section 8333, provides for summary vacation of
streets and public service easements; and
WHEREAS, pursuant to the provisions of Section 8330 et seq., of the Streets and Highways
Code, the City Council of the Town of Los Altos Hills seek to summarily vacate the Existing
Easements; and
WHEREAS, there are no public facilities in use or affected on the Existing Easements; and the
City Council intends to summarily vacate the pathway easement described and shown in Exhibit
"A" that is located within the property of 27290 Byrne Park Lane (the sanitary sewer easement
will remain as is.)
NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as
follows:
1. The foregoing recitals are true, correct, and incorporated herein by reference.
2. The Existing Easements described above and in Attachment 1 are hereby
summarily vacated pursuant to Chapter 4 of Division 9, Part 3 of the
California Streets and Highways Code, concerning summary vacation of
easements.
3. The City Cleric is directed to cause a certified copy of this resolution, attested
by the Cleric under seal, to be recorded in the office of the County Recorder of
the County of Santa Clara.
4. From and after the date of this resolution is recorded, the Existing Easements
shall no longer constitute as public service easements.
The above and foregoing Resolution was passed and adopted by the City Council of the Town of
Los Altos Hills at a regular meeting held on 20th of January 2022 by the following vote:
AYES: Tyson, Swan, Mok, Schmidt, Tankha
NOES: None
ABSENT: None
ABSTAIN: None
