A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS
REGARDING USE OF THE AMERICAN RESCUE PLAN ACT (ARPA) FUNDS
WHEREAS, on March 11, 2021 President Biden signed into law HR 1319, the American Rescue
Plan Act of 2021 ("ARPA"), which provides financial assistance to individuals, business, and state
and local government agencies to assist in the economic recovery from the COVID-19 pandemic;
and
WHEREAS, ARPA includes a provision entitled "Coronavirus State and Local Fiscal Recovery
Funds ("LRF") that includes $350 billion in funding for state and local governments of which $65
billion is dedicated to local government agencies; and
WHEREAS, the provision in LRF provide flexibility for each government to meet local needs in
four areas: 1) supporting public response to and economic impacts from the pandemic; 2) provide
premium pay for essential workers; 3) replace lost public sector revenues; and 4) invest in water,
wastewater and broadband infrastructure; and
WHEREAS, the Town of Los Altos Hills ("Town") is classified as a non -entitlement unit agency
with the provisions of LRF and has been informed that its total allocation is $2,014,960 divided
in two equal payments of $1,007,480 with the first payment received on July 13, 2021; and
WHEREEAS, the US Treasury Department ("Treasury") is responsible for administration and
distribution of LRF funds and issued its Interim Final Rule (31 CFR Part 35, RIN 1505-AC77) on
May 10, 2021, that establishes the provision for the use of the LRF funds;
WHEREAS, the Town has identified the projects in the staff report on the uses of the ARPA funds
received in July 2021 and the funds that will be distributed in July 2022;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the Town of Los Altos Hills
as follows:
1. The City Manager, or designee, is authorized to apply for and receive the Town's allocation
of LRF funds from the California Department of Finance.
2. The LRF funds received from Treasury shall be deposited into the Town's funds and said
funds will be tracked and reported in accordance with the provisions of ARPA and the
Interim Final Rule.
3. The Town shall use the funds based on City Council direction as outlined in the staff report.
4.. The FY2021-22 budget shall be amended to incorporate the first tranche revenues of
$1,007,480 in a Special Revenue Fund (Fund 019) and track expenses.

5. Approve the use of ARPA funds for second tranche revenues of $1,007,480 to be received
in July 2022.
The above and foregoing Resolution was passed and adopted by the City Council of the Town of
Los Altos Hills at a regular meeting held on 17th day of February 2022 by the following vote:
