HomeMy WebLinkAbout28-22RESOLUTION 28-22 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DESIGNATING TWO VALLEY OAK TREES AT BYRNE PRESERVE AS HERITAGE TREES WHEREAS, a Heritage tree means any tree that, due to age, size, location, visibility, historic nature, or other unique attribute, has been deemed by the Town to be a heritage tree and accordingly deserves special consideration for preservation and protection; and WHEREAS, the Town's Heritage Tree Ordinance allows for the designation of Heritage Trees by the City Council upon a recommendation by the Environmental Design and Protection Committee at a noticed public hearing; and WHEREAS, on October 19, 2021, the History Committee voted to request that the Environmental Design and Protection Committee recommend that the two Valley Oak, trees at Byrne Preserve be designated as Heritage Trees; and WHEREAS, on November 9, 2021, the Environmental Design and Protection Committee voted to recommend that the two Valley Oak trees at Byrne Preserve be designated as Heritage Trees; and WHEREAS, the Town of Los Altos Hills City Council held a duly noticed public hearing to consider this Heritage Tree designation on March 17, 2022; and WHEREAS, the Heritage Tree designation is categorically exempt from the provision of the California Environmental Quality Act pursuant to Section 15307 because it involves the protection of natural resources. NOW, THEREFORE, the City Council of the Town of Los Altos Hills does resolve that the two Valley Oak trees (Quercus lobata) located at the crest of the hill at Byrne Preserve are hereby DESIGNATED as Heritage Trees pursuant to Section 12-2.401 of the Los Altos Hills Municipal Code. The plan to maintain and protect both Heritage Trees, as required under Section 12-2.402 of the Los Altos Hills Municipal Code, is set forth in Exhibit "A" attached hereto and incorporated by reference. It shall be the responsibility of the current and future property owners of Byrne Preserve to comply with the terms of the protection plan. The above and foregoing Resolution was passed and adopted by the City Council of the Town of Los Altos Hills at a regular meeting held on the 17th day of March, 2022 by the following vote: AYES: Tyson, Swan, Mok, Schmidt, Tankha NOES: None ABSTAIN: None ABSENT: None Resolution 28-22 Page I ATTEST: sy: orge Tyson, ayor Resolution 28-22 Page 2 Exhibit A Heritage Tree Protection Plan Tree Protection Plan Town of Los Altos Hills Heritage Trees #6 and #7 General Protection Measures 1. Designate an exclusion zone to avoid soil disturbance, trenching, grading, and compaction activities. Each excluded area for an individual tree can be regarded as its Tree Protection Zone (TPZ). The TPZ shall be at the dripline in the natural state for either oak tree. 2. Any future fencing shall be installed outside the dripline/TPZ and consist of a split -rail wood fence or equivalent design. 3. Design any new irrigation lines, underground utilities, services, storm drain lines, bioretention features, and swales beyond TPZs. 4. Avoid prescribing herbicide use within a TPZ, and where used on-site, they should be labeled for safe use near trees. Also, liming should not occur or be prescribed within 50 feet of the trees. 5. Any landscape irrigation design should support the oak trees' inherent drought resistance . and avoid any trenching and tilling within their TPZs. 6. Any vehicles utilized to traverse, access, or maintain Byrne Preserve should maintain distance from the oak trees equal to the TPZ even when no fencing is installed. Resolution 28-22 Page 3
