HomeMy WebLinkAbout48-22RESOLUTION 48-22 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DENYING AN APPEAL OF THE PLANNING COMMISSION'S DECISION TO APPROVE A ZONING PERMIT FOR NEW FENCING AT 28001 ELENA ROAD AND IMPOSE CERTAIN CONDITIONS OF APPROVAL WHEREAS, The Town of Los Altos Hills received an application for a Zoning Permit (ZP21- 0047) from Sea Landing LP ("Applicant") for new fencing at 28001 Elena Road ("Project"); and WHEREAS, based on the record presented before it, the Project is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303(e) since the project involves new fencing; and WHEREAS, the Project application was processed in accordance with the applicable provisions of the California Government Code and the Los Altos Hills Municipal Code; and WHEREAS, the Site Development Committee held a duly noticed public hearing on the Project on July 6, 2021 and considered all written documentation and public comments and remanded the project to the Planning Commission; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on August 5, 2021 and considered all written documentation and public comments and continued the Project to a date uncertain; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on October 7, 2021 and considered all written documentation and public comments and continued the Project to a date uncertain; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on January 13, 2022 and considered all written documentation and public comments and continued the Project to a date uncertain; and WHEREAS, the Planning Commission held a duly noticed public hearing on the Project on March 3, 2022 and considered all written documentation and public comments; and WHEREAS, the Planning Commission voted 5-0 to adopt the resolution to approve the Zoning Permit for the proposed fence at 28001 Elena Road with conditions; and WHEREAS, on March 14, 2022, the Applicant submitted a Notice of Appeal to the City Cleric to appeal the Planning Commission's conditions of approval to the City Council; and WHEREAS, the City Council held a duly noticed public hearing to consider the appeal on April 21, 2022, and considered all evidence, testimony, written documentation and public comments; and Resolution 48-22 Page 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills hereby denies the appeal and upholds the Planning Commission's decision dated March 3, 2022 to approve a Zoning. Permit application (ZP21-0047) for fencing at 28001 Elena Road with conditions of approval issued on March 3, 2022. The above and foregoing Resolution was passed and adopted by the City Council of the Town of Los Altos Hills at a regular meeting held on 21St of April 2022 by the following vote: AYES: Tyson, Swan, Molc, Schmidt, Tanlcha NOES: None ABSTAIN: None ABSENT: None By: George Tyson, Mayor ATT ST: Deborah Padovan, City Cleric Resolution 48-22 Page 2
